HomeMy WebLinkAboutOrdinance No. 98-O13 ORDINANCE NO. 98-013 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA ESTABLISHING A MORATORIUM ON THE STANDARD LIMITING THE MAXIMUM HEIGHT OF WALL SIGNS AS APPLIED TO EXISTING COMMERCIAL CENTERS UNDERGOING SIGN REFURBISHMENT, INCLUDED IN SECTION 88-1615, TABLE 88-1615 OF THE AZUSA MUNICIPAL CODE WHEREAS,the City undertook a comprehensive revision of its Zoning Ordinance on September 25, 1996, and WHEREAS, a significant project, a sign program that is part of the rehabilitation and refurbishment of the Edgewood Center,was approved by the Planning Division in conformance with the Zoning Ordinance, and WHEREAS, Section 88-1615, Table 88-1615 of the Azusa Municipal Code limits the maximum height of wall signs to 10%of the wall height, and WHEREAS, work has begun on the sign refurbishment of the Edgewood Center and the maximum height for wall signs has been found to be inadequate in meeting the signage requirements of current and prospective tenants, and WHEREAS, the sign program and wall signs are essential components of the success of the refurbished Center and ultimately the success of the economic revitalization of the south part of the City, and WHEREAS, Section 88-1615, Table 88-1615, of the Azusa Municipal Code, regulates the maximum area of wall signs through a standard of two square feet per linear foot of building frontage, and WHEREAS,it is necessary to establish a moratorium on the maximum height of wall signs as applied to existing commercial centers undergoing sign refurbishment, as set forth in the Azusa Municipal Code,as provided herein,to take effect immediately to facilitate the rehabilitation and refurbishment of the Edgewood Center and ultimately the south part of the City and throughout, and WHEREAS,the immediate moratorium on the provision restricting the maximum height of wall signs will allow City staff time to study this issue and develop standards for wall signs which are adequate to accommodate the signage needs of current and future businesses, and WHEREAS, the immediate moratorium of the provision restricting the maximum height of wall signs on centers undergoing sign refurbishment will be in the interest of the public health, safety and general welfare and will help to attain the foregoing objectives, and WHEREAS, the California Government Code Section 36937 authorizes the City Council to adopt,by a four-fifths vote, an urgency ordinance which is necessary for the immediate preservation of the public peace, health or safety; THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN AS FOLLOWS: SECTION 1. A moratorium is established on item 2 under"Size Restrictions"in Table 8-1615 of Section 88-1615 of the Azusa Municipal Code, applicable to existing commercial centers undergoing sign refurbishment. SECTION 2. That the passage of this Urgency Ordinance is necessary in order to preserve the public peace, health and safety for the reasons set forth in the Recitals hereto. SECTION 3. The Urgency Ordinance shall take effect immediately upon its adoption. SECTION 4.The Urgency Ordinance was adopted by the necessary four-fifths vote of the members of the City Council pursuant to Government Code Section 36934 and 36937. A summary of this Ordinance shall be published in the manner required by law.
