HomeMy WebLinkAboutOrdinance No. 98-O7 ORDINANCE NO. 98-07 AN URGENCY ORDINANCE OF THE CITY OF AZUSA, CALIFORNIA AMENDING SECTION 88-1615, TABLE 88- 1615 OF THE AZUSA MUNICIPAL CODE CONCERNING MONUMENT SIGNS WHEREAS, the City undertook a comprehensive revision of its Zoning Code on September 25, 1996,and needed to make certain subsequent corrections for internal consistency and to achieve the original intent of the Code, and WHEREAS,the Planning Commission considered a list of code corrections as part of Code Amendment No. 199, in a duly-noticed public hearing held on February 25, 1998, and recommended to the City Council approval of said Code Amendment, and WHEREAS, the City Council, in its consideration of the Planning Commission's recommendation for approval, questioned certain aspects of the proposed code amendment and desired to discuss this matter in a joint workshop with the Planning Commission,thereby declining adoption of the code amendment, and WHEREAS,a significant project,a sign program that is part of the rehabilitation and refurbishment of the Edgewood Center, was dependent upon Code Amendment No. 199 being adopted, and is now in limbo, and WHEREAS, one of the provisions of proposed Code Amendment No. 199 would have changed the standards to allow a larger site such as Edgewood Center to have additional monument signs, and WHEREAS, work has been halted on the sign refurbishment of the Edgewood Center, pending City approval of the monument sign location standard, and WHEREAS,the sign program and monument signs are essential components of the success of the refurbished Center and ultimately the success of the economic revitalization of the south part of the City, which are now on hold, and WHEREAS,the Planning Commission did review this proposed amendment as part of Code Amendment No. 199 and recommended approval to the City Council,who did not express concerns regarding the standard for location of monument signs, and WHEREAS, it is necessary for the amendment to the Azusa Municipal Code, as provided herein,to take effect immediately so that the standards,as set forth in the amendment,can be applied immediately to implement the economic revitalization in the south part of the City and throughout, and WHEREAS, the immediate amendment of the provisions allowing additional monument signs for shopping centers with additional street frontages will be in the interest of the public health, safety and general welfare and will help to attain the foregoing objectives, and WHEREAS, California Government Code Section 36937 authorizes the City Council to adopt,by a four-fifths vote,an urgency ordinance which is necessary for the immediate preservation of the public peace, health or safety; THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN AS FOLLOWS: SECTION 1. Item 3c under"Number Permitted"in Table 88-1615 of Section 88- 1615 of the Azusa Municipal Code is hereby amended to read as follows: "c. Either 2 monument signs or 1 freestanding sign, plus an additional monument sign for each street entrance from the primary street of access if the lot has more than one street frontage." SECTION 2. That the passage of this Urgency Ordinance is necessary in order to preserve the public peace, health and safety for the reasons set forth in the Recitals hereto. SECTION 3. This Urgency Ordinance shall take effect immediately upon its adoption. SECTION 4. This Urgency Ordinance was adopted by the necessary four-fifths vote of the members of the City Council pursuant to Government Code Sections 36934 and 36937.
