SUBJECT: REQUEST FOR CONTINUANCE OF PAID LEAVE DURING INDUSTRIAL LEAVE
RECOMMENDATION
It is recommended that the City Council grant the request for a continuance of paid leave in
accordance with Civil Service Rule 6.6, Workers' Compensation and Section 16.3 of the
Memorandum of Understanding between the City of Azusa and the Azusa City Employees'
Association (ACEA).
BACKGROUND
All employees are covered by Workers' Compensation coverage in accordance with the Labor
Code and State Laws. Under Section 16.3,of the Memorandum of Understanding between the
City of Azusa and the ACEA, an "industrial leave" of up to ninety (90) calendar days shall be
authorized for each injury/illness determined to compensable under the Workers' Compensation
Act. Upon review by the City Council, paid leave may be continued at the end of the ninety (90)
calendar day period to a maximum of six (6) months.
FISCAL IMPACT
There are sufficient funds in the Transportation Division fund balance designated for
compensated absences.

BACKGROUND
On May 8, 2001, Bus Driver Laurie Patrick filed an occupational injury/illness report for an injury
sustained on March 28, 2001. Ms. Patrick's workers' compensation claim is for back injuries
sustained from pulling a water hose utilized by the Transportation Division to rinse off vehicles.
Ms. Patrick received treatment at Irwindale Medical Industrial Clinic (the City's industrial medical
provider), and was released to return to work with no restrictions on July 2, 2001. On October 19,
2001,Ms. Patrick received medical treatment for back pain from her personal physician. (Workers'
Compensation law allows an injured worker to continue treatment with their personal physician for
a work related injury after 30 days following the injury.)
Ms. Patrick was referred to an orthopedic specialist, Dr. John Sasaki, M.D. Ms. Patrick received
specific treatment for her upper back pain and was discharged from treatment. Ms.Patrick returned
to her personal physician for a follow-up visit November 19, 2001,who continued her medical leave
of absence for one month. Ms. Patrick was scheduled to see her physician for the follow-up visit
on December 13, 2001. To date, we have not received final results of her condition.
Ms. Patrick has requested to return to work and the Transportation Division will be working to
accommodate any restrictions, should she be released to return to work.
