HomeMy WebLinkAboutE-05 Staff Report - 90 day Extension Workers CompensationCONSENT ITEM E-5 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: TANYA BRAGG, DIRECTOR OF HUMAN RESOURCES & RISK MANAGEMENT VIA: SERGIO GONZALEZ, CITY MANAGER DATE: JULY 16, 2018 SUBJECT: REQUEST FOR EXTENSION OF WORKERS COMPENSATION SALARY CONTINUATION - METER READER BACKGROUND: On Monday, February 5, 2018, Meter Reader sustained a work injury which resulted in him being placed off work by a medical doctor as of April 3, 2018. Meter Reader continues to remain off work. RECOMMENDATION: Staff recommends the City Council take the following action: 1)Grant the approval of an extension of salary continuation for Meter Reader, for the maximum period of six months per the IBEW MOU for a work related injury/illness. ANALYSIS: As stated in the IBEW MOU: 20.9.1 An employee granted Industrial Leave shall continue to be compensated at his regular rate of pay in lieu of temporary disability payments. 20.9.3 An Industrial Leave of up to ninety (90) calendar days shall be authorized for each injury or illness determined to be compensable under the Workers’ Compensation Act. Paid leave may be continued subject to review by the City Council at the end of such ninety (90) calendar day period to a maximum of six (6) months. Supporting medical documentation must accompany such requests for leave and be submitted thirty (30) days prior to expiration date. Meter Reader’s 90 calendar days of Industrial Leave will end on or about July 3, 2018. Meter Reader has submitted the appropriate medical documentation to certify his absence from work and has requested an additional 90 calendar day extension, up to a maximum of six months (per the MOU), which is October 3, 2018. Meter Reader will be evaluated again by a physician on July 27, 2018, at which time his ability to return to work will be addressed. APPROVED CITY COUNCIL 7/16/2018 Extension of Workers Compensation Salary Continuation July 16, 2018 Page Two FISCAL IMPACT: This extension would not result in any cost over what was budgeted for the 2017/2018 and 2018/2019 fiscal year budget.
