AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF AZUSA APPROVING A ZONE CHANGE
FROM R1C (SINGLE FAMILY) TO R2 (TWO
FAMILY RESIDENTIAL) FOR THE PROPERTY
LOCATED AT 238-254 WEST TENTH STREET
(APPLICANT: JOHN MARTINEZ; CASE NO.
Z-90-1)
THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN
AS FOLLOWS:
SECTION 1. The City Council of the City of Azusa
does hereby find, determine and declare that:
A. The subject property is located at 238-254
West Tenth Street, Azusa, at the southeast corner
of Angelino Avenue and Tenth Street. The property
was originally subdivided as a single lot measuring
50 feet by 140 feet. This property has since been
split into two parcels. The easterly portion is
67.5 feet wide and 50 feet deep, and is developed
with a duplex and two attached one car garages.
The westerly lot is 73.5 feet and 50 feet deep, and
is developed with a single family residence and a
detached one car garage.
B. The owner of the easterly parcel has requested
that his property be rezoned from R1C to R2 in
order to legalize the use of the property for two
dwelling units. As the westerly parcel would
remain the only R1C zone parcel on this side of the
block, these changes are being reviewed for this
lot as well. A precise plan of design and general
plan amendment are being processed concurrently
with this zone change.
C. On April 11, 1990, the Planning Commission
held a duly noticed public hearing on said
application, at which time the Planning Commission
recommended to the City Council by Resolution No.
90-37 that the zone change classification proposed
for the subject property be approved.
D. On May 21, 1990, the City Council held a duly
noticed public hearing on the zone change
application and has carefully considered all of the
evidence and public comments received at said
hearing.
SECTION 2. In consideration of all the oral and
written evidence presented at said public hearings, the City
Council further finds, determines and declares that:
A. The requested R2 zone and medium density
residential land use designation would allow the
existing duplex to remain as a permitted use,
without encouraging further development of these
two parcels. This zoning would be consistent with
the zoning and land use patterns to the south, and
would eliminate this isolated portion of R1C zoned
properties. The consistency created by this
request is consistent with good zoning practice and
the principles for orderly development contained
within the land use element of the Azusa General
Plan.
B. In taking this action, the City Council has
considered the effects of the decision on the
housing needs of the region in which the City is
located and balanced those needs against the public
service needs of the City residents and available
fiscal and environmental resources.
C. The zone change for the subject property is
consistent with the General Plan of the City of
Azusa and each of the elements thereof.
D. The public necessity, convenience, general
welfare and good zoning practice require that the
zone change to R2 as set forth in this Ordinance be
made.
SECTION 3 . Notwithstanding the provisions of
Section 19.06.010 of the Azusa Municipal Code, the Zoning
Map referred to therein, the subject property described in
this Ordinance is hereby placed into the R2 (two family
residential) zone.
SECTION 4. Upon the effective date of this
Ordinance, the Director of Community Development shall
revise the official Zoning Map of the City of Azusa to
reflect the change in the zoning of the subject property.
SECTION 5. The City Clerk shall certify to the
passage of this ordinance and shall cause the same to be
published as required by law.

do hereby certify that the foregoing Ordinance No. 2449
was regularly introduced and placed upon its first reading
at a regular meeting of the City Council on the 4th day of
June , 19 90 . That thereafter, said Ordinance was
duly adopted and passed at a regular meeting of the City
Council on the 18th day of June , 1990 , by the
following vote, to wit:
