HomeMy WebLinkAboutOrdinance No. 91-O16 ORDINANCE NO. 91-fl1 F AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING AMENDMENT NO. 171 TO THE AZUSA MUNICIPAL CODE PERTAINING TO THE REDUCTION OF PERMITTED ZONES FOR NEW MOTELS AND HOTELS THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of Azusa hereby finds, determines and declares as follows: A. The Planning Commission for the City of Azusa held a duly noticed public hearing on August 14, 1991 and, after fully considering all oral and written testimony offered at the aforementioned public hearing, adopted Resolution No. 91-57, recommending to the City Council the adoption of this ordinance. B. The City Council of the City of Azusa held a duly noticed public hearing on September 18, 1991 concerning this ordinance and fully and carefully considered all oral and written testimony offered therein prior to acting on this ordinance. C. Motels and hotels in Azusa generally have had lower occupancy rates than those in similarly situated cities in the County of Los Angeles. As a result, many of the motels, in effect, have been converted into apartment buildings offering long-term tenancies. This has resulted in motels and hotels being used as multi- family residential housing contrary to the zoning classifications and development standards required under Title 19 of the Azusa Municipal Code and the building regulations contained in the State Housing Law and the Azusa Municipal Code. D. The potential exists for land use problems to occur due to the intensity of motel and hotel uses within their permitted commercial zones under the Azusa Municipal Code which raises the probability that new hotels and motels will not succeed in said zones. E. The freeway service (FS) zone adjacent to the Foothill Freeway is not subject to Code Amendment No. 171 and remains a viable zone for motel and hotel uses. F. The amendments to the Azusa Municipal Code as set forth in this ordinance are consistent with the public necessity, convenience, general welfare, and good zoning practice and are necessary for the preservation of the public health, safety and general welfare. G. The amendments to the Azusa Municipal Code as set forth in this ordinance are consistent with and in conformance to the General Plan of the City of Azusa and each of the elements thereof and further the intent and purpose of Title 19, ZONING, of the Azusa Municipal Code. -1- pca/ORD490671 H. In taking this action, City Council has considered the effects of its decision on the housing needs of the region in which the City is located and balanced those needs against the public service needs of the City's residents and available fiscal and environmental resources. SECTION 2 . Code Amendment No. 171 is hereby approved to amend or repeal the text of certain sections of Chapters 19.24, 19.26 and 19.27 of the Azusa Municipal Code to read as follows: "19.24. 030 (30) REPEALED 19. 24 . 030 (42) REPEALED 19.24 . 046 is hereby amended to read: 'MOTELS PROHIBITED. Motels and hotels are prohibited. Existing motels and hotels which have been legally established prior to the enactment of this section shall be permitted uses, and shall not be subject to the requirements of Section 19.40.050. ' 19.26. 025 is hereby amended to read: 'MOTELS PROHIBITED. Motels and hotels are prohibited. Existing motels and hotels which have been legally established prior to the enactment of this section shall be permitted uses, and shall not be subject to the requirements of Section 19.40. 050. ' 19.27. 020 (4c) REPEALED 19.27. 035 is hereby amended to read: 'MOTELS PROHIBITED. Motels and hotels are prohibited. Existing motels and hotels which have been legally established prior to the enactment of this section shall be permitted uses, and shall not be subject to the requirements of Section 19.40.050. '" SECTION 3 . The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published in compliance with Chapter 19. 64 of the Azusa Municipal Code.
