HomeMy WebLinkAboutOrdinance No. 91-O18 ORDINANCE NO. 91-018 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING SECTION 19. 04 . 180 TO THE AZUSA MUNICIPAL CODE PERTAINING TO A REVISED DEFINITION FOR DRIVE-IN BUSINESSES (CODE AMENDMENT NO. 179) THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of Azusa hereby finds, determines and declares as follows: A. The Planning Commission for the City of Azusa held a duly noticed public hearing on September 25, 1991 and, after fully considering all oral and written testimony offered at the aforementioned public hearing, adopted Resolution No. 91-70, recommending to the City Council the adoption of this ordinance. B. The City Council of the City of Azusa held a duly noticed public hearing on November 4, 1991 concerning this ordinance and fully and carefully considered all oral and written testimony offered therein prior to acting on this ordinance. C. The primary impacts reviewed under a conditional use permit for drive-in businesses involve parking and circulation. However, the current definition for drive-in businesses contained in Chapter 19. 04 of the Azusa Municipal Code also includes businesses that serve walk-up customers. These other businesses may be adequately reviewed separately without the requirement of a conditional use permit. In order to clarify this distinction, an amendment to the definition of drive-in businesses is needed. D. The amendment to the Azusa Municipal Code as set forth in this ordinance is consistent with the public necessity, convenience, general welfare, and good zoning practice and is necessary for the preservation of the public health, safety and general welfare. E. The amendment to the Azusa Municipal Code as set forth in this ordinance is consistent with and in conformance to the General Plan of the City of Azusa and each of the elements thereof and furthers the intent and purpose of Title 19, ZONING, of the Azusa Municipal Code. F. In taking this action, the City Council has considered the effects of its decision on the housing needs of the region in which the City is located and balanced those needs against the public service needs of the City's residents and available fiscal and environmental resources. -1- pca/ORD509284 (11/14/91) SECTION 2 . Section 19. 04. 180 of the Azusa Municipal Code is hereby amended to read as follows: "19. 04. 180 BUSINESS, DRIVE-IN. Drive-in business means any business where business or service is directly to an automobile and/or its occupants or rendered through the use of an automobile drive-up window and drive-through lane. In cases where there is a question, the Planning Commission shall rule whether a use falls within the intent or purpose of this definition. " SECTION 3 . The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published in compliance with Chapter 19. 64 of the Azusa Municipal Code.
