HomeMy WebLinkAboutOrdinance No. 91-O17 ORDINANCE NO. 91-017 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA REPEALING SECTION 19 . 80. 020 (e) , AMENDING SECTIONS 19. 24 . 030 (1) AND 19 . 27. 020 (a) AND ADDING 19. 04 . 022 TO THE AZUSA MUNICIPAL CODE PERTAINING TO REQUIREMENTS FOR ANTIQUE STORES (CODE AMENDMENT NO. 178) THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of Azusa hereby finds, determines and declares as follows: A. The Planning Commission for the City of Azusa held a duly noticed public hearing on September 25, 1991 and, after fully considering all oral and written testimony offered at the aforementioned public hearing, adopted Resolution No. 91-69, recommending to the City Council the adoption of this ordinance. B. The City Council of the City of Azusa held a duly noticed public hearing on November 4, 1991 concerning this ordinance and fully and carefully considered all oral and written testimony offered therein prior to acting on this ordinance. C. A better definition is needed for "antique shops" for the purpose of distinguishing them from second hand stores and similar shops in order to zone their permitted use under Title 19, ZONING, of the Azusa Municipal Code. D. Antique shops are to be permitted in restricted commercial, central business district, and other zones as specified under Title 19, ZONING, of the Azusa Municipal Code. E. The amendments to the Azusa Municipal Code as set forth in this ordinance are consistent with the public necessity, convenience, general welfare, and good zoning practice and are necessary for the preservation of the public health, safety and general welfare. F. The amendments to the Azusa Municipal Code as set forth in this ordinance are consistent with and in conformance to the General Plan of the City of Azusa and each of the elements thereof and further the intent and purpose of Title 19, ZONING, of the Azusa Municipal Code. G. In taking this action, the City Council has considered the effects of its decision on the housing needs of the region in which the City is located and balanced those needs against the public service needs of the City's residents and available fiscal and environmental resources. -1- pca/ORD903781 (11/14/91) SECTION 2 . Code Amendment No. 178 is hereby approved to amend or repeal the text of certain sections of Chapters 19. 80, 19.24 and 19. 27 of the Azusa Municipal Code and add Section 19. 04 . 022 thereto, as follows: A. Section 19. 80. 020 (e) of the Azusa Municipal Code is hereby repealed. B. Section 19.24 . 030 (1) of the Azusa Municipal Code is hereby amended to read as follows: " (1) Antique Shop;" C. Section 19.27 . 020(a) of the Azusa Municipal Code is hereby amended to read as follows: " 'Antique Shop;" D. Section 19. 04. 022 of the Azusa Municipal Code is hereby added to read as follows: Antique Shop means a commercial business which sells only bonafide antiques, which are defined as items which are over forty years old or collectible items manufactured within the last forty years. Final determination of merchandise suitable for sale shall be made by the Community Development Director or his designee. " SECTION 3 . The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published in compliance with Chapter 19. 64 of the Azusa Municipal Code.
