SUBJECT: REQUEST FOR EXTENSION OF WORKERS’ COMPENSATION SALARY CONTINUATION
–PARK MAINTENACE WORKER III
BACKGROUND:
On October 29, 2015, Park Maintenance Worker III sustained a work injury which resulted in him being placed
off work by a medical doctor as of July 9, 2018.
RECOMMENDATION:
Staff recommends the City Council take the following action:
1) Grant the approval of an extension of leave for Park Maintenance Worker III, for the maximum period of
six months per the ACEA MOU for a work related injury/illness.
ANALYSIS:
As stated in the ACEA MOU:
16.3.1 An employee granted Industrial Leave shall continue to be compensated at his regular rate of pay
in lieu of temporary disability payments.
16.3.3 An Industrial Leave of up to ninety (90) calendar days shall be authorized for each injury or illness
determined to be compensable under the Workers’ Compensation Act. Paid leave may be continued
subject to review by the City Council at the end of such ninety (90) calendar day period to a
maximum of six (6) months. Supporting medical documentation must accompany such requests for
leave and be submitted thirty (30) days prior to expiration date.
Park Maintenance Worker III’s 90 calendar days of Industrial Leave will end on or about October 9, 2018 . Park
Maintenance Worker III has submitted the appropriate medical documentation to certify his absence from work
and has requested an additional 90 calendar day extension, up to a maximum of six months (per the MOU),
which is January 9, 2019. Park Maintenance Worker III has a follow up doctor’s appointment on November 2,
2018, at which time his ability to return to work will be addressed.

FISCAL IMPACT:
This extension would not result in any cost over what was budgeted for the 2018/2019 fiscal year budget.
