HomeMy WebLinkAboutE-09 Staff Report - Extension of Workers Compensation 90 day ext STREET MAINTENANCE CREW SUPERVISORCONSENT ITEM E-9 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL VIA: SERGIO GONZALEZ, CITY MANAGER FROM: TANYA BRAGG, DIRECTOR OF HUMAN RESOURCES & RISK MANAGEMENT DATE: OCTOBER 1, 2018 SUBJECT: REQUEST FOR EXTENSION OF WORKERS’ COMPENSATION SALARY CONTINUATION –STREET MAINTENANCE CREW SUPERVISOR BACKGROUND: On November 21, 2017, Street Maintenance Crew Supervisor sustained a work injury which resulted in him being placed off work by a medical doctor as of June 29, 2018. RECOMMENDATION: Staff recommends the City Council take the following action: 1) Grant the approval of an extension of leave for Street Maintenance Crew Supervisor, for the maximum period of six months per the SEIU MOU for a work related injury/illness. ANALYSIS: As stated in the SEIU MOU: 17.3.1 An employee granted Industrial Leave shall continue to be compensated at his regular rate of pay in lieu of temporary disability payments. 17.3.3 An Industrial Leave of up to ninety (90) calendar days shall be authorized for each injury or illness determined to be compensable under the Workers’ Compensation Act. Paid leave may be continued subject to review by the City Council at the end of such ninety (90) calendar day period to a maximum of six (6) months. Supporting medical documentation must accompany such requests for leave and be submitted thirty (30) days prior to expiration date. Street Maintenance Crew Supervisor’s 90 calendar days of Industrial Leave will end on or about September 29, 2018. Street Maintenance Crew Supervisor has submitted the appropriate medical documentation to certify his absence from work and has requested an additional 90 calendar day extension, up to a maximum of six months (per the MOU), which is December 29, 2018. Street Maintenance Crew Supervisor will be evaluated again by a physician on October 1, 2018, at which time his ability to return to work will be addressed. APPROVED CITY COUNCIL 10/1/2018 Extension of Workers Compensation Salary Continuation October 1, 2018 Page Two FISCAL IMPACT: This extension would not result in any cost over what was budgeted for the 2018/2019 fiscal year budget.
