The City Council of the City of Azusa met to hear protests in
the matter of the vacation of streets and alleys
according to the provisions of Ordinance No. 462.

The City Council of the City of Azusa met in regular
session at the above time and. place.
Present at Roll Call: Councilmen: Jackson, Hernandez,
Seltzer, Memmesheimer, Jones,

Each member present acknowledged receipt of a written
copy of the minutes of the meeting of April 6th, 1953•
The Mayor asked if there were any objections or cor-
rections. There being none, the minutes of April 6th MINUTES
were approved as written. APPROVED
Councilman Memmesheimer offered a resolution entitled:
"A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AZUSA, LOS ANGELES COLrNTY, CALIFORNIA, ORDERING
THE VACATION OF THE STREETS AND ALLEYS SITUATE
IId TRACT 8507 IN THE CITY OF AZUSA, AS HEREIN-
AFTER DESCRIBED, AND AS DESCRIBED IN ORDINANCE
N0, 162 OF SAID CITY ADOPTED BY THE CITY COUNCIL
OF SAID CITY MARCH 16, 1953."
Moved by Councilman Seltzer, seconded by Coun-
cilman Hernandez that resolution be adopted as
read and numbered Resolution No, 2762.
Carried by the following vote of Council:
Ayes: Councilmen: Jackson, Hernandez, Seltzer,
Idemmesheimer, Jones
Noes: None Absent: None
Mr. Cruz offered to donate 351 of property fron-
ting on Grandview Drive in an effort to have the
street completed with curbs, gutters, paving, etc.
since the present condition is unsightly and he
' feels the ditch used for drainage creates a hazard.
The City Engineer estimated the cost of this im-
provement approximately 10/ per square foot.
Moved by Councilman Hernandez, seconded by Coun-
cilman Jackson that further study be made of the
situation and additional information obtained.

Moved by Councilman Seltzer, seconded by Coun-
cilman Hernandez that resolution be adopted as
read and numbered Resolution No, 2762.

The Planning Commission recommaded the request of
Mr. Olson for permission to relocate building to
be moved from the Monrovia Airport to 821 W. Foot-
hill Blvd, be approved.
Moved by Councilman Seltzer, seconded by Council-
man Memmesheimer that the recommendation of the
Planning Commission be accepted. Motion duly
carried.
The Planning Commission recommended the request of
Mr. Mathew Mariscal be approved for permission to
relocate residence building to 236 E. Fourth Street
with a 15 foot setback as stated to be included.
Moved by Councilman Seltzer, seconded by Councilman
Memmesheimer and duly carried the recommendation be
accepted with the 15 foot setback included.
The Planning Commission recommended the request of
Mr. John Mendoza for permission to relocate the
house from 1601 Myrtle Avenue, Monrovia to 218 No.
Pasadena Avenue be approved.
;Moved by Councilman Hernandez, seconded by Coun-
cilman Seltzer that this be tabled until the next
regular meeting for further study of the require-
ments and zoning ordinance covering this property.

The Planning Commission recommended the request of
Mr. Merle K. Mead for permission to move a,>796 Sq.
Ft. house with an addition of 270 sq. ft, from 235
Grand Avenue, Pasadena to 315 North Coney Avenue
' be approved.
:Roved by Councilman Memmesheimer, seconded by Coun-
cilman Seltzer and duly carried that recommendation
of Planning Commission be accepted with all stipu-
lations.
The Planning Commission recommended that the request
of Pomona Builders, Inc, to construct a 960 sq. ft,
dwelling at 216 North Alameda Avenue be approved and
that the existing dwelling will be removed within
30 days after the new home is completed subject to
the inspection of the Building Inspector.
Moved by Councilman Memmesheimer, seconded by
Councilman Hernandez and duly carried that recom-
mendation of Planning Commission be accepted.
The Planning Commission recommended the request be
approved of Mr. M. C. Davis for permission to re-
locate building from 1053 Cummings Street, Los
Angeles to 513 No. Soldano Avenue.
Moved by Councilman Hernandez, seconded by Council-
man Seltzer and duly carried recommendation be ac-
cepted and old building be moved within 30 days
after new building has been relocated.
City Attorney Snidow was instructed to draw an
Ordinance amending Section 54Ordinance 409.-
Mayor Jones read the findings of the Personnel
Board regarding the charges brought by Council-
man Hernandez against Chief Kendrick of the
Police Department; also a report from Saul Win-
okur, member of the Personnel Board.
Moved by Councilman Seltzer seconded by Council-
man Hernandez the minutes o this meetingg show re-
ceipt of both the majority and minority Tindings of
the Personnel Board and show the findings, also they
be placed on file. Carried by the following vote:

In accordance with Section 11 of the Civil

complaint of Joseph A. Hernandez, councilman
of the City of Azusa, hereto attached and marked

1. That Chief Kendrick during his tenure as
Chief of the City of Azusa has failed to organize
and to administer the Police Department in such a
manner as to make proper provision for the public
safety and welfare.
2. That the Board finds that the Maty day
suspension without pay as imposed by the City
Council an adequate penalty.
The above findings are hereby certified to
the City Council of the City of Azusa.

In accordance with Section 11 of the Civil

Personnel Board of the City of Azusa, Alvin W. Hahn
appearing as counsel for the complainant, and Peter

Kendrick, and the Personnel Board having heard the
testimony and having examined the proof offered
by the respective parties, and the case having
been submitted to the Personnel Board for decision
and the Personnel Board being fully advised in the
premises, I make my Findings as follows:

1. That Chief Kendrick during his tenure as
Chief of the City of Azusa has failed to organize
and to administer the Police Department in such a

2. That the thirty day suspension without
pay as imposed by the City Council is an adequate
penalty, as far as it goes.
' 3. That he be demoted to the last rank he
held in the department, which was patrolman.
The above findings are hereby certified to
the City Council of the City of Azusa.

Further motion made by Councilman Jackson, sec-
onded by Councilman Memmesheimer that the pen-
alty meted to Chief Kendrick was too severe for
what was proven at the Hearing and that Council
accept the findings of the Personnel Board as
final and conclusive and Council be bound by its'
decision.
Councilman Memmesheimer questioned Councilman
Hernandez' right to vote on the findings of the
Personnel Board stating that he had previously
disqualified himself. The Chair stated it was
his privilege to vote or disqualify as he wished.
Motion failed to carry by the following vote of
Council:

Absent: None
Superintendent Smith recommended that Barbara
Johnson and Muriel Harkee, account clerxs of
the Water and Light Department are eligible for
a salary raise to the third step. No action taken.
The resignation of Arthur Wolfe, Supt, of Streets,
was read.
Moved by Councilman Memmesheimer, seconded by
Councilman Seltzer and duly carried, that resig-
nation be accepted and City Attorney instructed
to prepare resolution.
The following named applicants for the office of
City Clerk were read: Lee Becker, Virginia
Goodale, James Miller, Victor Jabsen and Harold
Reid. The Chair instructed members of Council
to voice their preference as to the one they felt
could fill the vacancy satisfactorily rather than
call for a vote. After this was done the Council
cast a unanimous vote for one applicant.
'Councilman Jackson offered the name of Lee Becker, Councilman Hernandez named James Miller, Council-
man Seltzer named James Miller, Councilman Memme-
sheimer offered no preference, Councilman Jones
named James Killer. Councilman Jackson then with-
drew the name of his preference. Councilman Her-
nandez moved that James Miller be appointed City
Clerk, appointment effective June 1, 1953 and to
be paid for the intervening time at a rate set by
the present City Clerk. Councilman Hernandez
withdrew his motion.

Moved by Councilman Seltzer, seconded by Council-
man Hernandez that City Attorney Snidow be dir-
ected to draw resolution appointing James Miller
City Clerk effective June 1, 1953.

Mayor Jones read a letter signed by D. T. Dawe,
District Superintendent of Schools relative to
year -around recreation program and the use of
the Lee School building for civic purposes, also
a copy of a resolution signed by the Board of
Trustees, Azusa City School District, agreeing
to cooperate with the City of Azusa in promoting
recreation in this district by paying one half of
the operating costs, exclusive of director's
salary, with the further understanding that the
cost to the school district for the fiscal year
1953-54 not exceed $7,500.00.
Moved by Councilman Memmesheimer, seconded by
Councilman Seltzer the City Attorney be instructed
to draw aresolution expressing councils' intention
to enter into an agreement with the Azusa City
School District in promoting recreation in this
district by paying one-half of the operating costs,
exclusive of director's salary, with the further
understanding that the cost for the fiscal year
1953-54 not exceed $7,500.00.

Mayor Jones appointed Councilmen Memmmesheimer and
Seltzer a committee of two to investigate the USE 01' LEE SCHOOL
possibility of using the Lee School for civic
activities.
The San Gabriel Valley Protective Association
deficit was discussed. Moved by Councilman Seltzer
seconded by Councilman Hernandez that City Attorney
obtain necessary information pertaining to actual
amount of deficit, and city's position with regard
to payment of the amount.

City Attorney presented the following:
1. Petition of Pacific Electric to the Public
Utilities Commission regarding a fare raise.

cilman Seltzer that City Attorney draw resolution
of protest against the increase in fares applied
for by the Pacific Electric Railway Company.

The acquisition of R/W for widening on Para-
mount Avenue west of Orange Avenue will be
referred to City Engineer for further infor-
mation regarding prices, etc. of property.
The request to have city install curbs, paving,
etc. on Sunset Avenue north of Foothill Blvd.
was discussed with Mr. Brooks reporting on
condition of street at present time.

grade level stakes with the owner paying cost

The request of Elmer A. and Rose A. Erickson
for continuance of liquor license was read and
no action taken. LIQUOR LICENSE
Mr. V. D. Smith recommended the City Clerk ad-
vertise for bids on transformers, poles, light
meters, water meters, valves and fire hydrants.
Moved by Councilman Seltzer, seconded by Coun-
cilman Hernandez that city Clerk be authorized CLERK INSTRUCTED
to advertise for bids on transformers, etc., TO ADVERTISE FOR
bids to be opened May 4th. Motion duly carried. BIDS
Alpha Beta Market requested the use of the Audi-
torium from May 25th to 29th inclusive at 1:00
to 3:30 P. M. for the purpose of holding a public
cooking school.
Moved by Councilman Seltzer, seconded by Coun-
cilman Jones and duly carried that authorization USE OF AUDITORIUM
be given the City Clerk to grant use for period
mentioned.
Letter from Mr. Frank B. Rossi requesting the
city to construct a water line to his property
on Georgia Place was read.

Discussion followed as to the necessity of ex-
tending a 6 inch line or less considering the
future needs in that locality.
Moved by Councilman Seltzer that owner be ad-
vised as to cost of installing 6 inch line that
he may decide whether he wishes instillation.
Councilman Seltzer withdraws motion.
Moved by Councilman Jackson, seconded by Coun-
cilman Memmeshetmer and dull* carried that matter
be referred to Superintendent of Water Department
' and reported on the next regular meeting of
Council.
Letter from Louis J. Kroeger and Associates
relative to a salary survey was read and referred
to the Personnel Board.
A copy of the "minutes of the Board of Directors'
Meeting of the Los Angeles County Division, League
of California Cities" was submitted by Raymond S.
Talbot, Secretor;-,, Police Department, Santa Monica.
Moved by Councilman Seltzer, seconded by Councilman
Hernandez and duly carried this be referred to
Personnel Board.

tees of the Azusa Public Library held on Thurs-
day, April 2, 1953 were submitted and ordered
placed on file.
Communication from the Eoard of Supervisors,
County of Los Angeles, on the proposed annexation
of a portion of ?Sancho Los -".migos was ordered

Councilman Jackson offered a resolution entitled:

Discussion followed regarding the renting of
the Auditorium to religious groups.
Moved by Councilman Jackson, seconded by
Councilman Hernandez and duly carried, that
requests from any religious group wishing to
use the auditorium be referred to the Minis-
terial Union for approval.
Moved by Councilman Hernandez, seconded by
Councilman Seltzer, and duly carried, that
Personnel Board be authorized to hold exam-
ination for position of Superintendent of
Public Works.
Mr. Dawe, Superintendent of Schools, requested
the rental of city equipment on Saturday.

cilman Memmesheimer that request be granted
provided party using equipment pay the opera-
tor's cost for use of equipment.

Councilman Jackson disqualified himself from
' voting.
Councilman Jackson moved that three patrolmen
be hired on a temporary basis at a rate of
$273.00 per month until s,ich time as examin-
ations be given for probationery men. This
temporary basis will not include the five per
cent examination bonus ordinarily given.
