The -City Council of -the City of Azusa met to hear protests -in -,the -matter of proposed work, or the extent of assessment district; or on the grades under Resolution -of Intention, Resolution No, 2794, providing for -the construction of certain street work on Virginia Avenue and other streets. Present at Roll Call: Councilmen: Jackson, Hernandez, Seltzer, Memmesheimer, Jones City Attorney and City Clerk, Absent: City Engineer - The City Clerk presented affidavits of posting, publication and mailing of Assessment District No. 1953-6. Moved by Councilman Memmesheimer, seconded by Councilman Jackson Council approve said documents and City Clerk be instructed to file all documents. Motion carried unanimously. 343 Hearing on 1911 Act So. Virginia Av@ Affidavits presented Mayor Jones asked the City Clerk if there were any written protests. The -Clerk responded there were none.. No protests City Engineer Brooks entered the meeting and was seated. The Mayor then asked if there were any oral protests. There were no oral protests. Councilman Memmesheimer offered the following resolution entitled: - RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA,,,MAKING-FINDINGS_AND'OVERRULING PROTESTS AND OBJECTIONS. (Assessment.District_No.1953-6)-_ ^Whereas, this City Council by its Resolution No. 2794, adopted on the 15th day of June, 1953, declared its intention to order the construction of certain street -work and appurtenances and -appurtenant work under -the Improvement Act of 19112 Division 7 of the Streets and Highways Code, and in said resolution fixed the -20th day of -July 1953, at the hour of 7:30 o'clock P. M. in the Council Chambers of this City Council,. -as the time and place for the hearing before this City Council of protests and objections; and WHEREAS: at the time and place fixed in said Resolution -No 2794, a hearing was duly held by this City Council at which no written protests or objections were presented and read, there having been none filed, and -this City Council gave all persons present an op- portunity.,to be heard in respect of -any matter relating to the work proposed in said Resolution No 2794 or the - boundaries of the assessment district described therein, or in any way relating to the proceedings proposed by said Resolution No 2794; and Resolt4tion offered ORB I � � � 0 9ITY HALL AZUSA, CALIFORNIA MONDAY JULY 20, 1953 7:30 P:M. 2 WHEREAS, all persons desiring to appear and ~ be,heard-,have been heard, and this City Council has taken evidence relating to said proposed -work, the boundaries of the proposed assessment district and the benefits to the property to be included in the proposed assessment district, and is fully informed in the permises; ' NOW; THEREFORE, the City Council of the City Of Azusa, California DOES -HEREBY FIND, RESOLVE, DETERMINE AND ORDER as-follows:-- Section s_follows:_Section 1. That protests or objections have not been made -by the owners of one-half of the area of the property to be assessed for said proposed work. Section 2. That all protests and objections are hereby overruled and denied. Section 3. That no changes are to be made in the boundaries of the proposed assessment district or in the work proposed to be done, and the boundaries of the assessment district are defined and established as the boundaries described in the resolution of Intention, to wit, Resolution No. 2794, and the work proposed to be done is likewise --defined and established as the work described in said Resolution No. 2794, and reference is hereby made to said Resolution No. 2794 for a full and complete description of said work and of the assessment district and for further particulars. Section 4. That this resolution- shall be entered upon the minutes of this City Council. ADOPTED, SIGNED AND APPROVED this 20th day of July, 1953. Councilman Seltzer favored -the bids and recommended the lowest bid be accepted. Moved by Councilman Seltzer, seconded by Councilman Memmesheimer lowest bid be accepted and supervision Lowest bid of work be made by Mr. Marlowe Madison, compensation accepted. for Mr. -Madison to be set at 5%..of contract price less M. Madison to discount; work to be completed -within six weeks from supervise date and -Mayor be authorized -to sign contract with J. N. Hutchinson, contractor; bid bond to be returned to unsuccessful bidder. Motion carried by unanimous vote. City Engineer reported on the bids submitted for accoustical changes to be made in auditorium and Report on bids prices sumbitted from five companies. for Acoustical Moved by Councilman Memmesheimer, seconded by tile Councilman Seltzer, lowest bid be accepted with 3/4 inch accoustical-tile to be used. Of the two bids sub- for Plunge mitted the lowest was accepted and purchase made of vacuum cleaning equipment from Paddock Pool & Equip- ment Company, The Personnel Board submitted the following list of certified names of applicants for position of Groundsman Certified Gardener with the Park Department: list for 1; Harold Shulse, 2, Anastacio•Rivera, 3, E. W; Butts, Gardners 4, John Weatzel, 5, James Ayon, 6, R. B. Emery, 7, Sev- erina Valdivia. Kendrick, discharged chief of Azusa Police Department, who had asked for a review of his -case. - The findings of fact were: 1. A. L. Kendrick had served as Chief of Police from August 1, 1949 to July 6, 1953 and was serving in that capacity upon the adoption - of the Civil Service Ordinance of April 11,1950, 2. That the city -Council -by resolution #2809 did dismiss said Albert L. Kendrick without filing written charges with -the Personnel Board as re quired by Section 11 of Civil Service Ordinance, Resolution 2817 adopted Letter of report on hearing asked by Kendrick signed by Benson Reed & Decker 3. The conclusions of Law were: 1. That Albert L. Kendrick is a full time employee and was "blanketed" in under Civil Service Ordinance and is entitled to Civil Service status. 2. That the City Council dischargd A. L. Kendricks as chief of police in violation of Section 11 of the Civil Service Ordinance and is ordered rein- stated and..entitled to be paid him the salary to which he had been entitled had he not been dis- missed. Wesley�Kloepfer and Saul Winokur, disagreed with the -majority opinion of -the Personnel Board, They Report signed reasoned that: the Board should not have heard.the by Kloepfer and appeal, it lacked jurisdiction as the Ordinance does Winokur read not provide for an appeal back to the Board after ' action by the City Council. The Ordinance states in effect "In event -of bad faith or lack of evidence, the Council -shall be the final -review board and the Counoilts action will be final.' - The finding of guilty by the Board, and transpiring events between the time the verdict was sent to the Council and the action of the -Council substantiates the fbad faith" provision of the Ordinance. The Council acted within their right to correct the situation, and the Personnel Board was presump- tious in sitting in judgement in such action. A letter from Saul Winokur, member of the Personnel Letter from Board regarding the. -,hearing held July 13th, 1953 at Winokur read the request of A. L. Kendrick, -gave an opinion that the Personnel Board is an administrative body, not a'judicial body and may not be properly called upon to decide the legality or illegality of City Council actions. The conclusion is that the Civil Service Ordinance - does not give the Personnel -Board -power to counter- mand City Council actions irrespective of whether the Council action was proper or not.
