The City Council of the City of Azusa met in
adjourned session at the above time and place.
Present at Roll Call: Councilmen: Jackson, Her-

City Clerk declared the result of votes cast in
Special Election of the City of Azusa held on
September 29, 1953s and certified to the follow-
ing:

The following resolution was offered by Councilman
Seltzer, and was read in full:
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA,
COUNTY.OF_LOS ANGELES, STATE.OF-CALIFORNIA RECORDING
THE RESULT_OF THE_SLECTION TO-FILL_THE,VACANCIES-
ARISING AS A_RESULT_OF THE RECALL_ELECTIQN_HELD.IN
SAID.CITY..ON AUGUST 14,1953..
The -City Council of the City of Azusa does hereby
Adoption of
resolve as follows:
Res. No.2884
SECTION 1: WHEREAS, a Special Municipal Election
was held in the City_of Azusa, Los Angeles County,
State of California, on August 14,1953, and,whereas
pursuant to Resolutinn No.2858. The members of the
City Council were recalled at said election and
whereas the Clerk of the City of Azusa pursuant to
the Provisions of Law called a Special Election to
fill..the vacancies -arising as a..result of said Re-
call Election, which said election was held September
29,1953, and whereas the City Clerk has canvassed and
declared the result of said election and reported to
the City Council of the City of Azusa and whereas the
Election Officials were appointed and supplies furn-
nished as in all Special Elections. The election was
held and conducted and the returns thereof made and
declared in a manner provided by Law in the State of
California. The City Clerk having consolidated the
precincts in the manner set forth in the Resolution
No.2829 of the City of Azusa and the City Clerk

having reported an accounting of all votes and
the absentee Votes in the manner required by Law.
SECTION 2: NOW THEREFORE, it is resolved -and
declared that said -election was held and conducted
on September 29,1953, in the manner form andItime
as required by Law. That there were eight (8) voting
precincts for the purpose of holding said election
consisting of a consolidation of the regular pre-
cincts, That the whole number of votes cash in
said election in the City of Azusa was 2367. Said
votes being cast in the respective Consolidated
Precincts as follows:

man Memmeshei.mer, resolution be adopted as read and
numbered Resolution No, 2884.
Motion carried by following vote of Council:

Noes: None
The Oath of Office and Loyalty Oath was administered
to the following newly elected Council members by the
City Clerk: Anthony M. Ortuno, Martha M. Johnson and
Stephen Barry, Jr.

SECTION3: IT IS THEREFORE resolved that Stephen V.

Barry,
Jr., Martha M. Johnson, be_and hereby declared elected for
Members of the City Council for the term ending April 20,
1954 and that Anthony M. (Tony) Ortuno be and elected for
Member of the City Council of the City of Azusa for the
term ending April 17, 1956.
.SECTION - 4: It is further resolved that the Mayor
shall -sign -this resolution and the City Clerk shall
attest the same and certify as to the passage and
adoption hereof.

City Clerk acted as temporary Chairman and declared
nominations were open for Mayor.
Councilman Barry nominated Councilman Johnson,
Councilman Memmesheimer nominated Councilman
Jackson,
Councilman Ortuno moved, seconded by Council-
man Barry, nominations be closed.
The following vote was taken on the nomination
of Councilman Johnson for Mayor:
Ayes: Councilmen: Barry, Ortuno,
Noes: Councilmen: Jackson, Memmesheimer
Councilman Johnson passed on voting.
The following vote was taken on the nomina-
tion of Councilman Jackson for Mayor:
Ayes: Councilmen: Johnson, Memmesheimer, Jackson
Noes: Councilmen: Barry, Ortuno
Thereupon Hickory Jackson was declared Mayor of
the City of Azusa and addressed members of Coun-
cil and interested persons present.
Joe Hernandez addressed Council regarding the
le§al status of a "passing" vote stating it was
a yes vote and, in his opinion, Councilman
Johnson would then be Mayor.
City Attorney, whose opinion was requested,
stated it was not a "yes" vote.
Mayor Jackson read letter of resignation signed
by City Attorney H. A. Snidow.
Moved by, -Councilman Memmesheimer, seconded by
Councilman Johnson, resignation of City Attorney
' be accepted.
Councilman Barry stated that, as a new Member of
the Council, he had no knowledge that the attorney
was not capable of handling the position and did
not feel that it was in -the interest of the City
to accept the resignation at this time.
Motion carried by following vote of Council:
Ayes: Councilmen: Johnson, Memmesheimer, Jackson
Noes: Councilmen; Barry, Ortuno
Victor Jabsen addressed Council proposing that
future Council meetings be opened with all members
of Council pledging Allegiance to the Flag of the
United States of America.
Moved by Councilman Memmesheimer, seconded by
Councilman Ortuno that future meetings of the
Council of the City of Azusa be opened with the
pledge of Allegiance to -the Flag of the United
States of America.
Motion carried unanimously.
Moved by Councilman Memmesheimer, seconded by
Councilman Jackson, that P. J. Tscharner be
appointed as City Attorney for the City of Azusa.
Motion carried by the following vote of Council:
Ayes: Councilmen: Johnson, Memmesheimer,.Jackson
Noes: Councilmen: Barry, Ortuno
Mayor Jackson then appointed Mr. P. J. Tscharner
City Attorney for the City of Azusa.
Mr. Rude Smith addressed Council stating his con-
gratulations to the newly appointed City Attorney,
Mr. Henry Adems addressed Council inviting the members
of Council -to participate in the Azusa Days parade on
October 31st. Mayor Jackson accepted the invitation
in behalf of the Council members.

cilman Johnson, members, Councilmen Barry and Temporary
Ortuno, Auditing

Demands were then presented including those
for expenses authorized for members who will
attend the San Francisco Conference of the
League of California Cities,
Moved by Councilman Ortuno, seconded by Council-
man Memmesheimer and duly carried, Council adjourn
until Thursday, October 15, 1953 at 7:30 P:M.
