SUBJECT: ACCEPTANCE OF GRANT OF PERMANENT EASEMENT FOR WATER
UTILITY PURPOSES FROM PROPERTY OWNER MERITAGE HOMES OF
CALIFORNIA INC. FOR TRACT 74512-1 PORTIONS OF LOT 1 & B, IN THE
CITY OF COVINA
BACKGROUND:
The property owner at 1162 N. Citrus Avenue is granting Azusa Light & Water (ALW) an
easement to access utility facilities installed at the property.
RECOMMENDATION:
Staff recommends the Utility Board take the following action:
1)Adopt Resolution No. 2018-UB-04 accepting Grant of Permanent Easement for water
utility purposes from property owner Meritage Homes of California, Inc. for Tract
74512-1 of Lot 1 & B in the City of Covina;
2)Acceptance of Grant of Permanent Easement for water utility purposes from property
owner Meritage Homes of California, Inc. for Tract 74512-1 of Lot 1 & B in the City
of Covina; and
3) Authorize the City Clerk to file the easement documents in the Office of the Los
Angeles County Recorder.
ANALYSIS:
The property owner at 1162 N. Citrus Avenue in Covina is building 117 dwelling units called
Citrus Promenade. The Contractor was required to install a 6-inch master meter within the
property to avoid existing underground utilities within the public right-of-way. ALW owns and
operates the inlet water main to the public water meter, including the water meter. A permanent
easement is required for access to the waterline and meter location for operation and
maintenance. The owner is providing a 24-foot by 10-foot permanent easement to Azusa Light

RESOLUTION NO. 2018-UB-04
A RESOLUTION OF THE UTILITY BOARD OF THE AZUSA LIGHT
AND WATER/CITY OF AZUSA ACCEPTING A CERTAIN GRANT OF
PERMANENT EASEMENT AND DIRECTING THE RECORDING
THEREOF.
THE UTILITY BOARD/CITY COUNCIL OF THE CITY OF AZUSA/AZUSA
LIGHT AND WATER DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That Grant of Permanent Easement and Exhibits A and B attached hereto are
accepted as executed by Meritage Homes of California, Inc., under the date of October 22, 2018
to the CITY OF AZUSA, AZUSA LIGHT & WATER (ALW), a Municipal Corporation in Los
Angeles County, State of California, its successors and assigns, the right of perpetual easement
and right of way solely for the purpose of constructing, reconstructing, laying, maintaining,
operating, adding, using, altering, repairing, renewing, replacing, inspecting and relocating
therein and thereupon and / or removing there from water facilities, water pipelines and
appurtenant structures, over, under, in, on, along, and across the following described parcel of all
that real property situated in the City of Covina, within Azusa Light & Water service area, Los
Angeles County, State of California:
As described in Exhibit "A" and depicted in Exhibit “B” attached
hereto and made part hereof Grant of Permanent Easement.
SECTION 2. That the City Clerk is hereby authorized and directed to cause said attached Grant
of Permanent Easement, and Exhibits A and B to be filed for recording in the Office of the Los
Angeles County Recorder.
SECTION 3. That the City Clerk shall certify to the adoption of this Resolution.
PASSED, APPROVED and ADOPTED this 22nd day of October, 2018.
