SUBJECT: CONSIDERATION OF A RESOLUTION DECLARING A SHELTER CRISIS
BACKGROUND:
The State of California approved $500 million in one‐time funding for large cities and Continuums of
Care (CoC) to address homelessness in the FY 2018‐19 budget through the new Homeless Emergency
Aid Program (HEAP). Eligible uses of funding include emergency aid, prevention, and diversion
programs. While HEAP funding can be used for the provision of homeless services anywhere in the CoC,
in order for a jurisdiction to directly receive funding or have funding expended on capital uses and/or
rental assistance in that jurisdiction, a shelter crisis declaration is required.
RECOMMENDATION:
Staff recommends that the City Council take the following action:
1)Consider adoption of Resolution No. 2018-C63 Declaring a Shelter Crisis pursuant to Senate Bill
850 and California Government Code § 8698.2.
ANALYSIS:
In order for HEAP funds to be expended in the City of Azusa, even by a third party service provider such
as Union Station; the City of Azusa must have declared a shelter crisis. These funds would likely be used
for prevention, diversion and rental assistance. The enactment of a shelter crisis declaration does not
compel the jurisdiction to create or operate new shelters.

The crisis must be declared by a legislative body for the city or by an official designated by ordinance or
resolution adopted by the city’s governing body. The declaration must proclaim that there exists a
situation in which a significant number of persons do not have the ability to obtain shelter, and this
situation results in a threat to their health and safety.
The declaration must be adopted, completed and submitted to Los Angeles County Homeless Authority
(LAHSA) by Thursday November 15, 2018.

RESOLUTION NO. 2018-C63
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AZUSA, CALIFORNIA, DECLARING A SHELTER CRISIS
PURSUANT TO SENATE BILL 850 AND CALIFORNIA
GOVERNMENT CODE § 8698.2 AND AUTHORIZING THE
CITY’S PARTICIPATION IN THE HOMELESS EMERGENCY
AID PROGRAM
WHEREAS, California’s Governor Edmund G. Brown, Jr. and the members of the
California Legislature have recognized the urgent and immediate need for funding at the local
level to combat homelessness; and
WHEREAS, the Governor and Legislature have provided funding to local governments
under the Homeless Emergency Aid Program as part of SB 850 and the 2018-19 Budget Act
(Chapter 48, Statutes of 2018); and
WHEREAS, the Governor and Legislature require jurisdictions seeking an allocation
through the Homeless Emergency Aid Program to declare a Shelter Crisis pursuant to
Government Code §8698.2; and
WHEREAS, the City of Azusa has developed a homelessness plan and undertaken
multiple efforts at the local level to combat homelessness; and
WHEREAS, the City of Azusa affirms its commitment to combatting homelessness and
creating or augmenting a continuum of shelter and service options for those living without
shelter in our communities.
WHEREAS, the city of Azusa finds that 159 persons within the City of Azusa are
homeless and living without shelter;
WHEREAS, the City of Azusa finds that the number of homeless is significant, and
these persons are without the ability to obtain shelter;
WHEREAS, the City of Azusa finds that the health and safety of unsheltered persons in
the County of Los Angeles and the City of Azusa should be addressed with additional shelter
resources; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF AZUSA AS FOLLOWS:
SECTION 1. All facts set forth in this Resolution are true and correct.
SECTION 2. The City Council of the City of Azusa hereby declares that a shelter crises
exists pursuant to Government Code §8698.2 in the City of Azusa and surrounding areas. The
City Council further authorizes staff to participate in the Homeless Emergency Aid Program and
take any actions necessary to implement its participation.

SECTION 3. The Mayor is authorized to execute any necessary agreements on behalf of
the City, with such technical amendments as may be deemed appropriate by the City Manager
and City Attorney.
PASSED AND ADOPTED by the City Council of the City of Azusa at a regular
meeting held on the ___ day of October, 2018.
