AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF AZUSA AMENDING THE AZUSA MUNICIPAL CODE TO
ADD NEW SUBSECTIONS (f) , (g) , (h) , (i) , AND (j)
OF SECTION 19.08.191 OF CHAPTER 19.08 OF
TITLE 19 OF THE AZUSA MUNICIPAL CODE
REGARDING MINOR DEVIATIONS FOR SINGLE FAMILY
RESIDENTIAL ZONES.
WHEREAS, on May 13, 1992 the Planning Commission of the
City of Azusa recommended the adoption of technical changes to
the zoning ordinance of the City of Azusa which would permit City
staff to approve minor deviations as exceptions to the
development standards of the R-1 Zone in certain limited
circumstances; and
WHEREAS, on June 1, 1992 the City Council approved in
concept the recommendation of the Planning Commission and
directed the preparation of this ordinance;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AZUSA
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Section 19.08. 191 of Chapter 19.08, Title
19 of the Azusa Municipal Code is hereby amended to add new
subsections (f) , (g) , (h) , (i) and (j ) to read as follows:
" (f) Additions to houses which have nonconforming
side yard setbacks, if the additions encroach no
further into the required setbacks than the existing
house, and meet the minimum Building Code requirements
for side yards.
(g) A rear yard having a depth of less than twenty-
five feet, provided that the rear yard is at least as
deep as the average depths of the rear yards of the
adjoining lots on either side. In calculating the
average, a vacant lot or a lot occupied by a house with
a rear yard of more than twenty-five feet shall be
considered as having a rear yard of twenty-five feet.
(h) Additions to properties where the main building has
historical or cultural significance, as determined by
the Director of Community Development, which result in
reduced setbacks, if a finding is made that the
additions are designed in such a way as to preserve the
character of design of the original building, and that
alterations to conform to the setbacks would
significantly compromise the integrity of the design of
the original building.
(i) Additions to existing structures which deviate no more
than five percent from the required yards or building
height.
(j ) New fences or walls which deviate no more than five
percent from the maximum height. "
SECTION 2 . This Ordinance shall take effect thirty
(30) days from the date of adoption. The City Clerk shall
certify to the passage and adoption of this Ordinance; shall
cause the same to be entered in the book of original ordinances
of said City; and shall cause the same to be published or posted
in the manner required by law.
