HomeMy WebLinkAboutOrdinance No. 92-O21 ORDINANCE NO. 92-021 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING THE LAND USE ELEMENT OF THE GENERAL PLAN TO CHANGE THE LAND USE DESIGNATIONS FOR PROPERTY LOCATED AT 777 EAST FOOTHILL BOULEVARD FROM PID TO SP AND PROPERTY LOCATED AT 428-432 NORTH SAN GABRIEL AVENUE FROM H TO GC. WHEREAS, Government Code section 65356 and 65358 permit the City to amend its General Plan by an action of the legislative body; and WHEREAS, the property owners for the property located at 428-432 North San Gabriel Avenue and 777 East Foothill Boulevard have submitted requests to the City for changes in land use designation and corresponding zoning regarding said properties; and WHEREAS, the Planning Commission has reviewed these requests and has recommended to the City Council that said requests be granted and that the General Plan be amended to reflect these changed land use designations; and WHEREAS, concurrent with the introduction and adoption of this ordinance separate ordinances amending the zoning of said properties to change the zoning so that it is consistent with the changes in land use designation accomplished by this ordinance are also before the City Council. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The land use designation in the Land Use Element of the Azusa General Plan for the property located at 428-432 North San Gabriel Avenue is hereby amended to reflect a change in land use designation from H (High Density Residential) to GC (General Commercial) . SECTION 2. The land use designation in the Land Use Element of the Azusa General Plan for the property located at 777 East Foothill Boulevard is hereby amended to reflect a change in land use designation from PID (Planned Industrial Development) to SP (Specific Plan) . SECTION 3 . The amendment effected by Section 1 herein of this ordinance shall become effective 30 days after adoption. SECTION 4. The amendment effected by Section 2 of this ordinance shall not become effective until a deed vesting title in the property at 777 East Foothill Boulevard in Azusa Pacific University shall be recorded with the County Recorder of Los Angeles County. However, under no circumstances shall Section 2 of this ordinance become effective sooner than 30 days from the date of adoption. If Section 2 of this ordinance has not become effective within 180 days from the date of the adoption of this ordinance it shall, on midnight of the 180th day become null and void and of no further possibility of effect. The nullness and voidness of Section 2 shall not affect the validity and effectiveness of Section 1 which shall take effect independently of the effectiveness of Section 2. SECTION 5.
