AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF AZUSA AMENDING TITLE 19 OF THE AZUSA MUNICIPAL
CODE TO ADD A NEW SECTION 19.16.020(9) , A NEW
SECTION 19.24.040(8) AND A NEW CHAPTER 19.62
(CODE AMENDMENT 187 . )
WHEREAS, on April 15, 1992, the Planning Commission of
the city of Azusa adopted Resolution No. 92-36 which recommended
text amendments to the Zoning Code of the City of Azusa; and
WHEREAS, on May 18, 1992, the City Council reviewed the
proposed code amendments for senior citizen housing requirements
and approved them in concept instructing the City Attorney to
prepare this ordinance to formally adopt them;
NOW, THEREFORE, THE CITY COUNCIL OF ME CITY OF AZUSA
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. A new Section 19. 16.020 subdivision (9) is
hereby added to Chapter 19.24. 020, subdivision (8) is added to
Chapter 19.24 of Title 19 of the Azusa Municipal Code to read as
follows:
"19. 16.020 (9) Senior citizen apartments, in conformance
with the requirements of Chapter 19.62, may be permitted after a
public hearing in each case under a conditional use permit obtained
in accordance with procedures stated in Chapter 19. 60"
"19.24. 020(8) Senior citizen apartments, in conformance
with the requirements of Chapter 19. 62, may be permitted after a
public hearing in each case under a conditional use permit obtained
in accordance with procedures stated in Chapter 19.60"
SECTION 2. A new Chapter 19. 62 is hereby added to Title
19 of the Azusa Municipal Code and the old Chapter 19.62 is hereby
deleted. The new Chapter 19. 62 shall read as follows:

19.62.010 DEFINED. "Senior citizen apartments" means an
apartment complex designed to be occupied only with senior citizens
as primary residents. Said apartment units will contain facilities
for independent living of the tenants, as well as common amenities
for all residents as described within this chapter.

19. 62 . 020 CONDITIONAL USE PERMIT REQUIRED. Development
of senior citizen apartments requires the approval of a conditional
use permit issued under the requirements of Chapter 19.60.
19.62.030 FINDINGS. In determining whether a
conditional use permit will be granted, or if granted, the nature
and extent of conditions imposed thereon, the Planning Commission
shall consider the following:
(a) Nature and use of real property within five hundred feet
of the proposed site;
(b) Adequate buffering from incompatible land uses,
utilizing, where necessary, increased setbacks, vegetation,
screening walls, location of windows, and building design or
orientation;
(c) Access and proximity to shopping areas, medical services
and other senior citizen service providers;
(d) Adequacy of and proximity to public transportation;
(e) Appropriate common open space and recreational
facilities.
19. 62 .040 HEIGHT LIMITS. The maximum building height
shall be two stories or thirty-five feet from natural grade level.
19. 62 . 050 OFF-STREET PARKING. For each dwelling
unit, one parking space within a carport shall be provided. One
open parking space shall also be provided for every four units.
All spaces shall meet the size requirements of Section 19.48.030.
All parking calculations resulting in a fraction shall be rounded
to the next highest whole number.
19.62.060 DENSITY. A maximum density of forty units per
acre shall be permitted.
19.62 . 070 UNIT SIZES. The following minimum unit sizes
shall be required for all apartments:
(a) One bedroom, one bathroom units: five hundred and fifty
square feet;
(b) Two bedroom, one bathroom units: six hundred square
feet;
(c) Two bedroom, two bathroom or larger units: seven hundred
square feet.
19. 62 . 080 LOT COVERAGE. A maximum of sixty percent of
the gross site area shall be covered by buildings or paved
surfaces.
19.62 .090 YARD REQUIREMENTS. There shall be established
and maintained:
(a) A front yard having a depth of not less than twenty feet,
with at least fifteen feet between the building and any
private patio wall;
(b) An interior side or rear yard of not less than ten feet;
(c) A side or rear yard of not less than fifteen feet on the
street side of a corner lot.
All required setback areas shall be fully landscaped.
19.62 . 100 MINIMUM QUALIFYING AGE. The primary resident
for each dwelling unit shall be a minimum of fifty-five years of
age, with the exception of physically handicapped residents.

19. 62. 110 OPEN SPACE. At least sixty square feet of
private open space, and 125 square feet of common open space with
a minimum dimension of fifteen feet, shall be provided for each
dwelling unit.
19. 62 . 120 ADDITIONAL AMENITIES. Each dwelling unit
shall be provided an oven and stove; a garbage disposal; at least
one hundred fifty square feet of indoor storage, including closets;
and central heating and air conditioning.
19. 62.130 SECURITY REQUIREMENTS. Each apartment complex
shall include the following security measures: electrically
monitored entry gates accessed at a central location; 24-hour
medical alarm security system to the manager's unit; smoke
detectors in all units, corridors and common areas; and any other
security measures deemed necessary by the Azusa Police Department
and the Planning Commission. "
SECTION 3. This Ordinance shall become effective 30 days
after adoption. The City Clerk shall certify to the passage and
adoption of this Ordinance; shall cause the same to be entered in
the book of original ordinances of said City; and shall cause the
same to be published or posted in the manner required by law.
