HomeMy WebLinkAboutOrdinance No. 93-O6 ORDINANCE NO. 93-06 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING THE CITY ZONING MAP TO REFLECT THE RECLASSIFICATION OF VARIOUS CITYWIDE PROPERTIES FROM P TO R3C, CBD, C2 AND M2 AND CERTIFYING THE NEGATIVE DECLARATION FOR SAID PROJECT. THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of Azusa determines and declares as follows: A. The Planning Commission for the City of Azusa held a duly noticed public hearing on February 24, 1993 , and, after fully considering all oral and written testimony offered at the aforementioned public hearing, adopted Resolution No. 93-15, recommending to the City Council the adoption of this ordinance. B. The City Council of the City of Azusa held a duly noticed public hearing on March 15, 1993 , concerning this ordinance and fully and carefully considered all oral and written testimony offered therein prior to acting on this ordinance. C. The existing P zoning classification is outdated and needs to be eliminated. The original intent of this classification was to provide parking for adjacent commercial and industrial areas. As this zone also allows for residential uses, few parcels so zoned are developed with the types of uses for which this zone was intended. Rezoning of all P zoned parcels to designations which more closely match existing and future land uses should be accomplished. D. The amendment to the Azusa Municipal Code as set forth in this ordinance is consistent with the public necessity, convenience, general welfare, and good zoning practice and is necessary for the preservation of the public health, safety and general welfare. E. The amendment to the Zoning Map as set forth in this ordinance is consistent with and in conformance to the General Plan of the City of Azusa, as amended by City Council Resolution No. 93-C41 (General Plan Amendment No. GPA-93-1) , and each of the elements thereof and furthers the intent and purpose of Title 19, ZONING, of the Azusa Municipal Code. F. In taking this action, the City Council has considered the effects of its decision on the housing needs of the region in which the City is located and balanced those needs against the public service needs of the city's residents and available fiscal and environmental resources. SECTION 2 . The Zoning Map of the City of Azusa is hereby amended to reflect the change in zoning for the property located at 632 North Alameda Avenue from P to CBD. SECTION 3 . The Zoning Map of the City of Azusa is hereby amended to reflect the change in zoning for the property located at 633 North Angeleno Avenue from P to C2 . SECTION 4. The Zoning Map of the City of Azusa is hereby amended to reflect the change in zoning for the properties located on the west side of Alameda Avenue from 501 to 627 North Alameda Avenue and on the east side of Alameda Avenue from 612 to 628 North Alameda from P to R3c. -1- SECTION 5. The Zoning Map of the City of Azusa is hereby amended to reflect the change in zoning for the properties located at 629 Angeleno Avenue and the east side of Angeleno Avenue from 602 to 634 North Angeleno Avenue from P to R3c. SECTION 6. The Zoning Map of the City of Azusa is hereby amended to reflect the change in zoning for the properties located at 845, 849, 905 and 907 North Alameda Avenue and 118 East Ninth Street from P to R3c. SECTION 7 . The Zoning Map of the City of Azusa is hereby amended to reflect the change in zoning for the properties located at 1045 West Hollyvale Street and 1038 West Third Street from P to M2. SECTION 8. Pursuant to the State CEQA guidelines, a negative declaration, a copy of which is attached hereto as Exhibit A, has been prepared and reviewed, finding that the proposed project could not have a significant effect on the environment. The City Council hereby certifies said negative declaration, with the proviso that the mitigation measures, if any, recommended in the initial study, be implemented. SECTION 9. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published in compliance with Chapter 19. 64 of the Azusa Municipal Code. Project involves the potential rezoning of several small areas in the city, along with concurretn general plan amendments. Several small lots would be changed from residential to commercial zoning to reflect their actual uses. One half block would be downzoned from a high residential density to a medium density. Two parking lots would be rezoned to reflect the industrial uses which they serve. Other parcels would be rezoned to prohibit future use as parking lots. These changes would result in increased 3 consistency between the land use patterns and their zoning class- ifications. 12. 1 four-unit apartment building would become a nonconforimg use. I find that although the proposed project could have a 1 significant effect on the envir=ent, there will not be a significant effect in this case because the mitigation measures described on an attached sheet have been added to the project.
