AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA
AMENDING SECTION 19. 80. 020 (C) OF THE AZUSA MUNICIPAL
CODE PERTAINING TO A REVISED DEFINITION FOR SECONDHAND
STORES (CODE AMENDMENT NO. 170) AND APPROVING THE
NEGATIVE DECLARATION
THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY ORDAIN
AS FOLLOWS:
SECTION 1. The City Council of the City of Azusa
determines and declares as follows:
A. The Planning Commission for the City of Azusa held
a duly noticed public hearing on September 26, 1990, and,
after fully considering all oral and written testimony
offered at the aforementioned public hearing, adopted
Resolution No. 90-86, recommending to the City Council
the adoption of this ordinance.
B. The City Council of the City of Azusa held a duly
noticed public hearing on November 5, 1990, and further
continued hearings on May 3, 1993 and June 6, 1993
concerning this ordinance and fully and carefully
considered all oral and written testimony offered therein
prior to acting on this ordinance.
C. The current definition of secondhand stores is too
broad, and includes certain businesses which sell only a
small percentage of goods which are used or reconditioned
articles. An amendment is necessary which would exclude
retail businesses which have inventories of used
merchandise which amounts to less than 25% of their
inventory.
D. The amendment to the Azusa Municipal Code as set
forth in this ordinance is consistent with the public
necessity, convenience, general welfare, and good zoning
practice and is necessary for the preservation of the
public health, safety and general welfare.
E. The amendment to the Azusa Municipal Code as set
forth in this ordinance is consistent with and in
conformance to the General Plan of the City of Azusa and
each of the elements thereof and furthers the intent and
purpose of Title 19, ZONING, of the Azusa Municipal Code.
F. In taking this action, the City Council has
considered the effects of its decision on the housing
needs of the region in which the City is located and
balanced those needs against the public service needs of
the city's residents and available fiscal and
environmental resources.
SECTION 2 . Section 19.80. 020 (C) of the Azusa
Municipal Code is hereby amended to read as follows:
"19.80. 020 DEFINITIONS
C. 'Secondhand store' shall mean a place of business
where more than twenty-five percent (25%) of its
inventory is made up of used or reconditioned articles
which are sold to the public whether or not such activity
is done for profit, or charitable purposes by a person,
firm, corporation or organization. "

SECTION 3 . Pursuant to the State CEQA guidelines, a
negative declaration, a copy of which is attached hereto as Exhibit
A, has been prepared and reviewed, finding that the proposed
project could not have a significant effect on the environment.
The City Council hereby certifies said negative declaration, with
the proviso that the mitigation measures, if any, recommended in
the initial study, be implemented.
SECTION 4. The City Clerk shall certify to the
passage of this ordinance and shall cause the same to be published
in compliance with Chapter 19. 64 of the Azusa Municipal Code.

I HEREBY CERTIFY that the forgoing Ordinance No. 93-012
was subject to a first reading at a regular meeting of the City
Council of the City of Azusa on the 21st day of June
1993. That thereafter, said Ordinance was duly adopted and passed
at a regular meeting of the City Council on the 6th day of
July , 1993 , by the following vote, to wit:
