HomeMy WebLinkAboutOrdinance No. 94-O15 ORDINANCE NO. 94-015 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING THE CITY ZONING MAP TO REFLECT THE RECLASSIFICATION OF PROPERTY LOCATED AT 215 EAST SIERRA MADRE AVENUE FROM RA TO R1A AND CERTIFYING THE NEGATIVE DECLARATION FOR SAID PROJECT. THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of Azusa determines and declares as follows: A. The Planning Commission for the City of Azusa held a duly noticed public hearing on June 15, 1994, and, after fully considering all oral and written testimony offered at the aforementioned public hearing, adopted Resolution No. 94-41, recommending to the City Council the adoption of this ordinance. B. The City Council of the City of Azusa held a duly noticed public hearing on August 1, 1994, concerning this ordinance and fully and carefully considered all oral and written testimony offered therein prior to acting on this ordinance. C. The proposed Rla zoning of this parcel would be more consistent with the zoning pattern of the surrounding neighborhood than the current RA zoning. The surrounding area is predominantly single-family residential in character. The RA zone is more applicable to rural residential areas with larger parcels which can be utilized for raising animals or other agricultural uses. The Rla zoning would therefore more appropriately match the existing and future land uses of this property. D. The amendment to the Azusa Municipal Code as set forth in this ordinance is consistent with the public necessity, convenience, general welfare, and good zoning practice and is necessary for the preservation of the public health, safety and general welfare. E. The amendment to the Zoning Map as set forth in this ordinance is consistent with and in conformance to the General Plan of the City of Azusa, and each of the elements thereof and furthers the intent and purpose of Title 19, ZONING, of the Azusa Municipal Code. • F. In taking this action, the City Council has considered the effects of its decision on the housing needs of the region in which the City is located and balanced those needs against the public service needs of the city's residents and available fiscal and environmental resources. SECTION 2 . The Zoning Map of the City of Azusa is hereby amended to reflect the change in zoning for the property located at 215 East Sierra Madre Avenue from RA to Rla. SECTION 3 . Pursuant to the State CEQA guidelines, a negative declaration, a copy of which is attached hereto as Exhibit A, has been prepared and reviewed, finding that the proposed project could not have a significant effect on the environment. The City Council hereby certifies said negative declaration, with the proviso that the mitigation measures, if any, recommended in the initial study, be implemented. -1- SECTION 4. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published in compliance with Chapter 19. 64 of the Azusa Municipal Code.
