CITY HALL AZUSA, CALIFORNIA DECEMBER 21,1953
The City Council of the City of Azusa met in
regular session at the above time and place,
opening the meeting with -the Pledge of Alle-
giance to the Flag.
7:30 P.M.
Roll Call: Councilmen: Barry, Johnson, Mem-
sheimer, Jackson
City Attorney, City Engineer,
and City Clerk
Absent: Councilman Ortuno
' Mayor Jackson asked if Council members had re-
ceived written copies of minutes of meetings
Yield December 9th and 14th, and if there were
any objections or corrections. Councilmam
Johnson'stated correction needed on page 115 of
minutes, line 16, the word should be "or"
instead of the word "of"; and questioned.the
wording of paragraph.7, page 121 stating the
phrase Mayor Jackson "admitted falsely informing"
was incorrect.
Councilman Barry stated that the information given
to Council by Mayor Jackson was incorrect, that the
wife of applicant in question had informed Council
of the availability of applicant, and that Mayor
Jackson had stated applicant was not available.
Mayor Jackson repliedthat the information given
to him was passed on to Council and that he had
not verified this information but had stated
only that which was told to him.
The first item on the agenda discussed was the
proposed formation of a Vehicle Parking District.
Councilman Memmesheimer offered the following
resolution entitled:
' RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA,
STATE OF CALIFORNIA, ORDERING_A REPORT UNDER -THE
SPECIAL_ASSESSMENT INVESTIGATION, LIMITATION AND
MAJORITY PROTEST ACT OF 1931, ON THE ACQUISITION
AND IMPROVEMENT.OF CERTAIN LANDS FOR PUBLIC PARKING
PLACES. _
Moved -by Councilman Barry, seconded by Councilman
Jackson and unanimously carried, resolution be '
adopted as read and numbered Resolution No. 2927.
Absent: Councilman Ortuno Correction: Coipc�lman
Johnson voted no
Upon being directed by the Council, City Engineer
Brooks filed with the Clerk the report as required
by the Special Assessment Investigating Limitation
and Majority Protest Act of 1931 as set forth in
Division 4 of the Streets and Highways Code. The
City -Clerk executed the certificate on Title page
and presented the report to the Council.
Councilman Memmesheimer offered the following resolu-
tion entitled:

Councilman Memmesheimer offered the following Ordinance
,for title reading only:
AN ORDINANCE OF THE CITY OF AZUSA, CALIFORNIA, DECLARING
THE INTENTION OF THE CITY COUNCIL OF SAID CITY TO FORM
VEHICLE PARKING.DISTRICT NO. 1 OF SAID CITY.AND TO -
ACQUIRE LANDS FOR,PARKING PLACES -AND TO CONSTRUCT IM-
PROVEMENTS OF SAIDPARKINGPLACES, AS PROPOSED IN THE
PETITION THEREFOR, AND.FIXING THE TIME AND PLACE FOR
HEARING AND GIVING NOTICE THEREOF. .
' ev; Paroulek, a member of the Azusa Ministerial Asso-
ciation, addressed Council regarding the granting of
"On'Sale General"'license to Ralph Enterprises,Inc.
by the Board of Equalization, for the business located
at"1 12 E. Foothill Blvd., stating that protests have
been -received against the ;-,granting of a license.
Councilman Memmesheimer felt a protest should be filed
hgainst-the granting of this license since several
churches had protested and several -citizens also voiced
objections to the granting of -a license.
Moved by Councilman Barry, seconded by Councilman
Johnson, letter of protest be forwarded to the Board
of -Equalization by special messenger stating the
protest of Azusa Ministerial Association and request-
ing a Hearing to be held in Azusa.
Motion carried by unanimous vote.
Councilman Ortuno absent.
Petitions for the formation of a,1911 Improvement Act
Assessment district -South Louise, South Orange and
Jackson Streets -have been checked and Clerk submitted
"Certificate of City Clerk of the City of -Azusa, Calif-
ornia re Petition and Waiver" in which was stated that
signatures of owners of more than 60% of the area in-
volved had been secured.
Moved by Councilman Memmesheimer, seconded by Council-
man Johnson and duly carried, report be accepted and
turned over to City Engineer for necessary arrangements
for scheduling of the 1911 Act proceedings.
Councilman Barry submitted letter recommending that
City employees on duty have a half day holiday begin-
ning at 12:00 o'clock noon on December 24th and em-
ployees who must work after that hour be paid on
holiday basis. He also wished to extend Holiday
Greetings and thanks to all employees for a job well done.
Moved by Councilman Barry, seconded by Councilman Memme-
shAmer and unanimously carried, that employges on duty
receive one half day Christmas holiday with holiday pay
to those employees who must work after 12:00 o'clock noon.

Mayor Jackson read letter submitted by S. G. Coon, Jr.
resigning as member of Planning Commission.
Moved by Councilman Barry, seconded by Councilman John-
' son and,duly carried, resignation be accepted and letter
of commendation for past services to the City be written
by Clerk.
' Mr. 'Bartlett addressed Council regarding the relocation
of house on South side of Paramount Street. The house
has been moved to new location and is on blocks. It was
pointed out that the Planning Commission, at it's meeting
`of November 12th, 1953 did not_approve the relocation at
this time.

Johnson and unanimously carried, in view of the fact that
the house is now on the premises, nothing further towards

Moved by Councilman Memmesheimer, seconded by Council-
man Barry and duly carried, recommendation of Planning
Commission be accepted and provided all building re-
quirements are met.

it was the request of the Planning Commission that
the Council name the street that will extend from Azusa
Avenue through the Rittenhouse property which would
normally be 13th Street.

The Planning Commission recommended that the request
of Mr. Austin Capps, 131 North Cerritos Avenue, to
build a carport 22 ft, from the property line be granted
provided there is an entry at both ends and the carport
is not enclosed.

Councilman Johnson offered the following resolution

DIRECTING THAT.HIS UNPAID SALARY AS ORDERED BY THE Reinstating
COURT BE PAID, A.L.Kendrick
Moved by Councilman Memmesheimer, seconded by Coun-
cilman Jackson and duly carried, resolution be
adopted as read and numbered Resolution No. 2929.
Councilman Barry stated "This court action was
based on a technicality and in noway vindicates
Chief Kendrick of recently proven guilt and mal-
feasance in office. The trial was merely a test of
the present Civil Service Ordinance and I would like
to point out the greatly improved conditions in the
Police Department, which improvements incurred under
the leadership of Captain McDonald, with regard to
' departmental morale, officer.taining, departmental
organization, and effective handling of the narcotic
situation in the City. I feel the case should be
appealed to a higher court.
I move that the City Council request that Chief
Kendrick shall resign from the City Police Depart-
ment in the best interests of the City.
Motion failed for lack ofsecond.

h City Attorney stated he felt the statement of
Councilman Barry was wrong, it is not based on
fact, was not a technicality and I make the state-
ment that it was not a technicality partly because
the dismissal was illegal and it did have to go to
court. Furthermore, Chief Kendrick, prior to the Statement of
time of dismissal, had met every requirement of City Atty.
the Civil Service Commission; he paid the penalty,
as directed and the Civil Service Commission which,
on it's own motion, recommended that Chief Kendrick
be not dismissed but reinstated; that the action of
the court at that time was contrary to and in viola-
tion of Civil Service Ordir►anier,. I am inclined
to agree that there has been some improvement in
the,Police Department, for which I am grateful, and
the improvement is due to the fact that they now
understand that the Ordinance covering employees
is effective and cannot be violated at will.
Mr. LaVern Rueter addressed Council requesting a re-

Councilman Barry stated the action taken in relieving
Chief Kendrick of the position of Police Chief was
taken in answer to petitions signed and submitted with Statement of

Civil Service employees who had resigned because of
conditions existing under Chief Kendrick.
Attorney Tscharner stated that the records before
' the Commission show that the employees resigned
did so because of being lowest on certified list
of those examined and were not recommended to the
position desired.
Councilman Memmesheimer stated Councilman Barry's
mention of peitions presented asking for dismissal
of Chief Kendrick and according to Councilman Barry's
statement caused Council to take action dismissing
Kendrick may be taken in good faith by that Council
but Council was also aware the method used was def-
initely improper and had they chosen to remove Ken-
drick for any other reason than to express their
personal animosity, they would have used the method
provided in Civil Service Ordinance and would have
proven charges brought against him and for which no
evidence was produced, other than being too generous
with his employees.
I definitely feel Chief Kendrick was and is a good
Chief of Police, and he has definitely lived up to
the oath given to him when sworn to office.
Councilman Barry stated his opinion was made as a
result of the open hearing only, and that he had no
other motives or sources of information.

Superintendent Smith of Tight and '•later nenartment re-
ported on tentatiafve price for proposed well site which
was agreeable to property owners in the area where well
is desired. Proposed site would be approximately 75 x
423 ft and cost would be X3500.

Mayor Jackson read letter of condolence from the City
to Mrs. Walter Malone in her recent bereavement. Letter to

Report was submitted to the Council by Mr. Ivan D. Turner
regarding condition of present bath house as requested by
Park and Recreation Commission.

and duly carried, matter be referred to Chairman of Public
Works and City Engineer for further investigation and re-
port to Council.
Letter submitted by City Clerk recommending step raise
for Mrs. Adelaide Johns placing her on permanent status
as Account Clerk, Step #2, City Clerk's office.
Moved by Councilman Johnson, seconded by Councilman
Barry recommendation of Clerk be accepted and step raise
granted. City Attorney to draw resolution to that effect.
Motion carried unanimously.
Request of James Stringfellow, custodian, for vacation
pay, in lieu of vacation, submitted by Supt. of Public
Works. (Acting)
Moved'by Councilman Barry, seconded by Councilman John-
son, and duly carried, request be granted and James
Stringfellow be paid in lieu of vacation.
Request submitted by General Telephone Company to
install underground conduit in alley east of Azusa
Avenue.

man Barry and duly carried, matter be referred to City
Erigineer, Attorney and Street Department for report to
Council.
Engineer Brooks reported on bids submitted for standby
pump stating that Pomona Pump Sales and Service sub-
mitted lowest bid for 15 H. P. motor manufactured by
Fairbanks -Morse.

man Barry and duly carried low bid be accepted and bid
bonds or checks be returned to unsuccessful bidders.

City Engineer reported on approximate cost of
constructing footbridge across wash on Azusa
Avenue, and stating cost to be $1600.00.
Moved by Councilman Memmesheimer, seconded by
Councilman Barry City Engineer contact State
Division of Highways for encroachment permit in
order to construct footbridge.
Motion carried unanimously.
Absent: Councilman Ortuno
City Engineer reported further on Virginia Avenue
improvements, on proposed well site and reservoir
plans.
Mayor Jackson recommended these matters be tabled
until next meeting.
Letter of resignation submitted by Mrs. Leora Shuck,
Utilities Collector of Light and Water Department.
Moved by Councilman Memmesheimer,.seconded by Council-
man Johnson and unanimously carried, resignation be
accepted and letter of regret and commendation to
be written by Clerk to Mrs. Shuck.
Letter submitted by Supt. Smith requesting Personnel
Board be instructed to hold interdepartmental examina-
tion for filling of Vacancy caused by the resignation
of Mrs. Shuck.

man'Johnson and unanimously carried, directing,Per-
sonnel Clerk to hold interdepartmental examination for
