SUBJECT: REQUEST FOR EXTENSION OF WORKERS’ COMPENSATION SALARY CONTINUATION
–WATER DISTRIBUTION CREW SUPERVISOR
BACKGROUND:
On August 1, 2018, Water Distribution Crew Supervisor sustained a work injury which resulted in him being
placed off work by a medical doctor as of August 23, 2018.
RECOMMENDATION:
Staff recommends the City Council take the following action:
1) Grant the approval of an extension of leave for Water Distribution Crew Supervisor, for the maximum
period of six months per the IBEW MOU for a work related injury/illness.
ANALYSIS:
As stated in the IBEW MOU:
20.9.1 An employee granted Industrial Leave shall continue to be compensated at his regular rate of pay
in lieu of temporary disability payments.
20.9.3 An Industrial Leave of up to ninety (90) calendar days shall be authorized for each injury or illness
determined to be compensable under the Workers’ Compensation Act. Paid leave may be continued
subject to review by the City Council at the end of such ninety (90) calendar day period to a
maximum of six (6) months. Supporting medical documentation must accompany such requests for
leave and be submitted thirty (30) days prior to expiration date.
Water Distribution Crew Supervisor’s 90 calendar days of Industrial Leave will end on or about November 23,
2018. Water Distribution Crew Supervisor has submitted the appropriate medical documentation to certify his
absence from work and has requested an additional 90 calendar day extension, up to a maximum of six months
(per the MOU), which is February 23, 2019. Water Distribution Crew Supervisor has a follow up future doctor’s
appointment which will determine his ability to return to work.

FISCAL IMPACT:
This extension would not result in any cost over what was budgeted for the 2018/2019 fiscal year budget.
