The City Council of the City of Azusa met in
adjourned session at the above time and place.

The minutes of the Park and Recreation meeting of
February 25th were submitted to the Council.
' Request was made to the Council for use of City
power equipment for the cutting of base paths at Request for

Ortuno and unanimously carried, request be referred
to the"Department of Public Works for consultation
with Mr. Turner and with power to act on needed work.

The Park -and Recreation Commission recommended to the
Council for approval, the renewal of the contract between
Los Angeles County and the City of Azusa for the services
of Mr."John E. Huffstutter as Director of Recreation in
Azusa."

Moved by Councilman Barry, seconded by Councilman contract-
Orturio and unanimously carried, request be referred J. Huffstutter
to the City Attorney for checking of contract and
report to Council.
Mayor Jackson recommended Councilman Memmesheimer and
Councilman'Ortuno to serve on the committee to study
possible use of Lee School as a memorial hall for
public use as both were long time residents of Azusa.
Councilman Barry stated his desire to serve on
.this committee, as it was through his motion that
'the.committee was formed, and Councilman Ortuno ap-
proved the'suggestion stating his lack of time to
serve and desiring his name to be excluded.
Moved by Councilman Ortuno, seconded by Councilman
Barry; that Councilmen Memmesheimer and Barry be
appointed as Council representatives to the committee.

Councilman Barry restated his wish to be included
on the committee for study of lee school. Mayor
Jackson stated his reasons for his recommendations.
Councilman Memmesheimer moved that Mayor Jackson
appoint Councilmen Barry and Memmesheimer as members.
Motion seconded by Councilman Ortuno and carried by
the following vote of Council:
Ayes: Councilmen: Barry, Ortuno, Memmesheimer
Noes: Councilmen: Johnson, Jackson
Absent: None
Notice from the Board of Equalization regarding the
application for Off Sale -Beer and Wine license at
771 No. Vernon Avenue by Parks Beverage Company
and,A transfer of their beer and wine wholesale
license from 801 No. Alameda Avenue.

Mayor Jackson read letter from Rev. Barnhart, Presi-
dent of the Azusa -Ministerial Union, favoring the
plan of having an invocation at the beginning of Invocation at

It was suggested that the plan be handled through Rev.
Barnhart directly as chairman of the Ministerial Union.
Moved by Councilman Memmesheimer, seconded by Council-
man•Ortuno and 'unanimously carried, that the procedure
as,recommended by Rev. Barnhart be followed and notifi-
cation be'forwarded by the Clerk. Also that the Mayor
'be contacted by the representative who will officiate.
The dates of the meetings will be the first and third
'Mondays of each month.
Mayor Jackson read letters from Roy Barni, President
of the Civitan Club of Azusa seeking financial sup-
port in the manner of taking a full page ad in their
program for the Junior College Baseball-Tornament and
the donation of twenty miniature bronze baseballs and
nine miniature gold balls as trophies.
It -was suggested by Councilman Memmesheimer that re-
quest be handled through the Chamber of Commerce.
Moved -by Councilman Memmesheimer,seconded by Council-
man,Ortuno and carried by unanimous vote of Council,
that.Chamber of Commerce be authorized to make the
necessary expenditures and reimbursement to be made
by the City for such expense through the'Musie and
Promotion Fund.

Request was made by the Sister Klizabeth'Kenny Founda-
tion for approval of the 1954 annual campaign to be Sister Kenny
held from May 1 to 31, 1954 for the raising of funis. Foundation Fund
Moved'by Councilman Barry, seconded by Councilman Campaign
Memmesheimer and unanimously carried, that request
be granted and the Foundation be so advised.
Clerk suggested workers be issued permits to `solicit
funds in order to identify them as being legitimate.
It was requed;ed that permission be granted to solicit
funds from the City of Hope by setting up 2 card tables
near the main intersection and at Safeway Market and
Market Basket on two Saturdays. City of Hope
Moved by Councilman Memmesheimer, seconded by Coun- Fund raising

OF SAID CITY AT THE NEXT GENERAL MUNICIPAL ELECTION TO introduced
BE,HELD.ON APRIL 13, 1954 AN ORDINANCE RELATING TO
GAMBLING AND DINDRED OPERATIONS: DECLARING ALL EQUIPMENT
USED IN CONNECTION THEREWITH TO BE A NUISANCE AND PRO-
VIDING FOR THE ABATEMENT THEREOF AND FIXING THE PENALTIES
FOR_ITS VIOLATION.
Moved -by Councilman Johnson, seconded by Councilman Jackson,
resolution be adopted as read.
Councilman Barry stated as follows:
"In my opinion, this measure is a political vote -getting scheme,
pure and simple. The Council was given no opportunity to stidy
it. It appears that'it cannot provide any protection against
-the menace of gambling that is not already provided by existing
laws: Ib appears that kt would work a severe hardship on all
religious and other worthwhile community organizations by pro-
hibiting lawn fetes and similar fund raising activities, none
of which constitute a menace. The funds thus raised being truly
contributions used, for the most part, for religious, educa-
tional, and charitable causes.
Let's face facts, if this ordinance contributes nothing
to the control of gambling racketeers, but attacks, instead,
such things as worthwhile fund raising activities of the
Parish Hall, the Eagles, the Knights of Columbus, the V. F. W.,
the American Legion, the Kiwanis, and even the afternoon
bridge games enjoyed by clubwomen, I'm against it. Until I
have a chance to study it, I must vote against it.
I cannot commit hundreds of dollars of taxpayer's money to
advertise this voluminous thing and get it on the ballot simply
for the purpose of providing political advertising for Mrs.
Martha Johnson. I wish to advise Mrs. Johnson that if she is
sincere in believing that additional anti -gambling legislation
is needed and knows of specific cases, such laws could be passed
by this'Council by motion without spending hundreds of dollars
even before this ordinance is voted on. I stand ready as one
member of the Council to lend every assistance in this matter.
The manner of presenting this ordinance to the council at
the last minute, allowing no possible opportunity for study or
planning,'is wrong. 'It is just as wrong for an anti -gambling
ordinance as it is for resolutions firing a City Engineer,
stopping all work on the much needed reservoir, the new
recreation center and park improvements. These important issues
were also handled in the same manner; some introduced only five
minutes before adjourning time; none of them appearing, as they
should have, on the agenda. Issues of such importance to the
citizens of 'Azusa and the future of the City require study and
planning.. This is not good City government."
The following statement was made by Councilman Ortuno:

"I wish to go on record as being against the proposed
"Anti -Gambling Ordinance for the following reasons:
We now have Federal and State laws, County and City
ordinances which I feel adequately protect Azusa from any
"organized gambling syndicates."
The reasons given for writing this new and asinine
ordinance is that the present ordinance is too "old and
' outmoded" and should be replaced by a new and sharper
law. If'this be true, floes the author of our new proposed
ordinance feel that the Constitution of the United States
Is too old and should be re -written?
I sincerely believe that our police personnel should
be used in more pressing and vital matters."
The following statement was made by Councilman Johnson:
"Like most people, I have been amazed and puzzled by the
vicious and bitter character of politics in the City of
Azusa.* This is a small city, and the salary and powers
of a councilman are very small. I have wondered what could
be behind'all of this strife and controversy.
I have talked to many well-informed people in Azusa
and in_the'League of California Cities. After much study
I have become convinced that the key to the puzzle lies

'Why should any City Council want to control
the office of Chief of Police?'
In my oRinion, the hidden reason for this is to prepare
the way for COMMERCIALIZED GAMBLING". The only law against
gambling in Azusa is an ordinance prohiliiting draw poker which
was passed by the City Council on April 24, 1899. 'This ordinance
' is inadequate. It could be repealed in two weeks by this Council
or any future council. Thereafter licenses could be issued allow-
ing the operation of "Polaer Palaces" and other gambling games,
such as now exist in other California cities.
Control of the police department is essential for the
smooth operation of Commercial Gambling and its allied activities.
I believe that it is wise to lock the door before it is too
late. I have therefore proposed a strong "Anti -Gambling" ordin-
�ante to be voted on by the people. The approval of this ordinance

--by the people will make it impossible for ANY City Council to
legalize gambling in this city without the consent of the voters.
THIS IS THE ONLY REASON FOR MY ACTION.
I am well aware that this ordinate will'be misrepresented by
'those who favor or dondone gambling, as a "Blue -Nose" attempt to
interfire with the private affairs of people in their homes. This
is simply false. This ordinance will NOT interfere with legitimate
fund-raising campaigns or with the private pleasures of anyone,
anywhere. It strikes only at Commercial Gambling for profit.
Attorney Tscharner, as a citizen, made the following statement:
"I have known Mr. Barry only since I have been associated with
the Council and, in my opinion, he is the most politically
,minded man I have ever seen. He has been charging everyone
around here with political accusations. It is not fair for a
member to make such statements. I challenge him to show here
anything that, in the past, would not have it's merits."
Councilman Barry referred Itty. Tscharner to the written record
and stated he would reply in the near future to the statement
made.

Councilman Memmesheimer suggested that, in view of -the
severity of the proposed ordinance; the possibility of
placing Ordinance #23 on the ballot be considered 1n order
to protect the City against the possible organization of
professional gambling. He further recomm6nded'-adJourned
meeting of Council be held for the purpose'o£ studying
Ordinance No. 23 for placing on the ballot. The -enforce-
ment of the proposed ordinance in its entirety might -be
difficult, and since protection from the -state and county
' is adequate Ordinance X23 would be sufficient.
At this time personal protests were made by -members of
the audience in behalf of various organizations stating
their need for raising funds for the maintenance of these
organizations and also for the benefit of -the community
through donations to welfare organizations.
Mr. Karl Jones spolae in behalf of the -Holy Name Society
and.Knights of Columbus stating the need of'the Society
Por ways of raising funds for the purchase of{such*neeessi-
ties as school books, and that other methods of controlling
.gambling could be used in place of the costly.placing of
this ordinance on the ballot.
Edward Lightbody, of the American Legion, st"ressed.the need
of organizations for methods of raising funds „'in"addition
to the community being benefitted by the entertainment offered.
Michael'MaGarron questioned the possibility of raising funds
without violating this ordinance.
Wesley Kloepfer questioned the legality of sale of'tickets
since it would be in violation of the ordinance as it stands.
'Discussion followed regarding the possibility -of service,
religious and fraternal organizations being unable to raise
funds under the proposed ordinance.
Adoption of the resolution failed by the following vote of
Council:

Moyed by Councilman Memmesheimer,-seconded by Councilman Adjourned
Ortuno and unanimously carried, that Council hold an ad- meeting to
journed meeting and members be furnished with copies of be held
Ordinance No. 23 for study to consider the possibility of
placing this Ordinance on the ballot for the people to show
their wishes one way or another. Copies of Ordinance X23
to be furnished to any interested parties and to the Council
members prior to Monday, March 8th at 8:00 PM. at which time
the Council will meet in adjourned session.

and unanimously carried, that Councilman Memmesheimer be
appointed temporary chairman on Monday in the absence of
Mayor Jackson,

The City Council of the City of Azusa does
hereby resolve as follows:
SECTION 1: WHEREAS, there will be a regular
Municiapal Election as provided by law, held -in
the City of Azusa, Los Angeles County, California
on the 13th day of April, 19543 and
SECTION 2: WHEREAS, it is the judgment of -the -City
Council of the City of Azusa that election -precincts
established for holding State or County elections

and unanimously carried, resolution be adopted and numbered
Resolution No. 2974 with the compensation to board members
to be in the amount of $18.00 for inspectors and $15.00 for
judges and clerks.
Report of L. F. Pack, City Engineer, read by Mayor Jackson
and -stating that an inspection of the drainage problem at Report of
the extension of West 10th Street had been made. It was City Eng.
recommended that a grade be established and no curbs cons-
tructed'thereby allowing the water to flow over the street
and into it's natural course.
Morvedtby Councilman Memmesheimer, seconded by Councilman
Ortuno and unanimously carried, authorization be granted to
proceed with the recommendation as made.
It'was announced by the Clerk that payment in the amount of
$8,110.56 was made to the City constituting 2 per cent of the
gross receipts derived by the General Telephone Company for
the period of 12 months ending Dec. 31, 1953 as per franchise

Mayor Jackson read letter from J. A, Abel, Auditor and
Assistant Treasurer stating the check inclosed in the
amount of $3,951.56 was payment for the year ended Dec.
31,"1953 for the use, operation and possession of the
franchise granted by Ordinance 341.
Written complaint from Mr, and Mrs. Ray Kelly, 1014 Palm
Drive was read stating that branches from trees on Rain-
' bow.Angling Club property were falling on their private
property endangering individuals thereon, and asking
' action to'be taken by the City.

Announcement was made of the meeting of the Metro-
politan Transportation'Engineering Board on Monday
March let regarding Monorail Transportation.
Request was made by the Clerk for the employment of'a
stenographer in the Clerk's office and by other -depart- Request for

of doing work required and reporting back at next meeting,
if possible.
Recommendation was made by Mayor Jackson that the City
purchase tickets for City officials to attend the banquet
`of joint Chambers of Commerce to be held at the Angling

held on rate increase adked by the General Telephone General

of the Planning Commission regarding the wrecking
of cars and auto parts scattered over'the'property
at 712 W. Duell Street, which are being sold without
