AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF AZUSA ADDING SECTION 46-350 TO THE AZUSA
MUNICIPAL CODE PERTAINING TO THE REGISTRATION
OF AMMUNITION SALES.
WHEREAS, the City Council of the City of Azusa desires to
adopt an ordinance relating to the registration of ammunition sales
within the City of Azusa; and
WHEREAS, the City Council finds that the State of California
has not preempted the enactment of a municipal ordinance related to
the registration of ammunition sales. The City Council has heard
testimony from its police department that the availability of such
ammunition sales records can aid the police department in
investigations of major crimes, homicides and shootings. It is the
intent of the City Council, within the constitutional and statutory
limits of local control, to discourage illegal sales of ammunition,
including sales to juveniles, and to treat the sale of ammunition
as a serious matter similar to restrictions on other potentially
dangerous substances, or substances that can be used in the
commission of a crime, such as spray paint.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AZUSA DOES
ORDAIN AS FOLLOWS:
SECTION 1. Section 46-350 is hereby added to the Azusa
Municipal Code to read as follows:
A. Definitions.
As used in this chapter, "ammunition" shall mean
projectiles expelled by force of an explosion, for use in pistols
and revolvers, as defined in California Penal Code 12001,
notwithstanding that the ammunition may also be used in rifles or
shotguns.
"Vendor" shall mean any individual, gun store, firm or
corporation having a business license to sell ammunition.
B. Record of Ammunition Sales.
Every holder of a business license to sell ammunition
shall maintain records pertaining to ammunition sales prescribed by
this chapter on the licensed premises and in the manner prescribed
herein.
The record shall show:
1. the date of the transaction;
2 . the purchaser's name, address and date of birth;
3 . the purchaser's driver's license no. or other I.D.
and state where issued;
4. the brand of ammunition purchased;
5. the type and amount of ammunition purchased; and
6. the purchaser's signature.
The information required by this section shall be completed in
the log at the time of the purchase.
Such information shall be recorded in the following format:
AMMUNITION SALES REGISTRATION LOG
STORE:
DATE NAME ADDRESS DOB
LICENSE/ID AMMUNITION AMMUNITION TYPE PURCHASER
AND STATE BRAND AND AMOUNT SIGNATURE
The record shall be maintained in chronological order by date
of sale of the ammunition, and shall be retained on the licensed
premises of the business licensee for a period of two (2) years
following the date of the purchase of the ammunition.
At the direction of the police chief or his designee, Azusa
police officers may enter the premises of any licensed vendor of
ammunition during regular business hours for the purpose of
examining or inspecting any record required by this chapter.
C. Violation/Penalty.
It is unlawful for any licensed vendor or person engaged in
the retail sale of ammunition knowingly to make a false entry in,
or fail to make appropriate entry, or fail to properly maintain any
such record, or refuse to exhibit the ammunition sales log to an
Azusa police officer immediately upon request for such inspection.
Any person or business violating any provision of this chapter
is deemed guilty of a misdemeanor, and upon conviction thereof
shall be punished in accordance with Chapter 1 of the Azusa
Municipal Code.
SECTION 2. This ordinance shall be published once in the
local newspaper and shall be effective 30 days after the date of
adoption
SECTION 3. The City Clerk shall certify as to the adoption of
this ordinance and shall cause it to be processed in the manner
required by law.
SECTION 4. One year from the effective date of this
ordinance, the City Council shall review and evaluate the impact of
the ordinance within the City.

I HEREBY CERTIFY that the foregoing Ordinance No. 95-06 was
subject to a first reading at a regular meeting of the City Council
of the City of Azusa on the 3rd day of April , 1995. That
thereafter said Ordinance was duly adopted and passed at a regular
meeting of the City Council on the 17th day of April ,
1995, by the following vote, to wit:
