HomeMy WebLinkAboutOrdinance No. 95-O4 ORDINANCE NO. 95-04 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA ADDING SECTION 46-128 TO THE AZUSA MUNICIPAL CODE PERTAINING TO THE ESTABLISHMENT OF A JUVENILE DAYTIME LOITERING ORDINANCE IN AN EFFORT TO REDUCE TRUANCY FROM SCHOOLS AND THE REDUCTION OF DAYTIME CRIME. WHEREAS, the City Council of the City of Azusa desires to adopt an ordinance enabling the Police Department to enforce compulsory education laws enacted in the State of California; and WHEREAS, the enforcement of the compulsory education laws will help ensure that our youth receive the education they need to become productive members of society; and WHEREAS, the need for both parents to work and the resulting lack of supervision of school age youth makes it imperative that our society find a way to keep children in school; and WHEREAS, the City Council finds it in the best interest of the public safety, welfare and integrity of the City to (1), empower police officers to enforce this ordinance in order to reduce truancy and daytime crime associated with juvenile offenders during daytime hours, and (2), that parents and guardians be made aware of their children's truancy from school. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN AS FOLLOWS: SECTION 1. Section 46-128 is hereby added to the Azusa Municipal Code to read as follows: Section 46-128 . Juvenile Daytime Loitering. (a) Any minor under the age of eighteen who is subject to compulsory education or to compulsory continuation education cannot be in or upon the following places between the hours of 8:30 a.m. and 1:30 p.m. on days when school is in session: (1) Public streets; (2) Highways; (3) Roads; (4) Alleys; (5) Parks; (6) Playgrounds; (7) Other public grounds, public places, public buildings, places of amusement and eating places, vacant lots; and (8) Any unsupervised place. PEL\5285.0 (b) The provisions of this section do not apply: (1) When the minor is accompanied by his or her parent, guardian or other adult person having the care and custody of the minor; (2) When the minor is on an emergency errand at the request of his or her parent or guardian or other adult person having the care and custody of the minor; (3) When the minor is going to or coming directly from his or her place of employment; (4) When the minor is going to or from a medical appointment; or (5) When the minor is a student who has permission to leave campus for lunch or school related activity, and has in his or her possession a valid, school-issued, off-campus permit. (c) Each violation of the provisions of this section is a separate offense and is a misdemeanor. SECTION 2. This ordinance shall be published once in the local newspaper and shall be effective 30 days after the date of adoption. SECTION 3. The City Clerk shall certify as to the adoption of this ordinance and shall cause it to be processed in the manner required by law.
