AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA
AMENDING CHAPTER 14 OF THE AZUSA MUNICIPAL CODE AND ADOPTING
BY REFERENCE THE UNIFORM BUILDING CODE, 1994 EDITION,UNIFORM
BUILDING CODE STANDARDS, 1994 EDITION, UNIFORM MECHANICAL
CODE, 1994 EDITION, UNIFORM SWIMMING POOL,SPA AND HOT TUB
CODE, 1994 EDITION,THE UNIFORM PLUMBING CODE, 1994 EDITION,
THE UNIFORM SIGN CODE, 1994 EDITION,AMENDING SECTIONS 14-51,
14-53, 14-55, 14-91, 14-111, 14-150 OF THE CITY CODE REFERENCING UNIFORM
CODE ADOPTIONS,AND ADDING SECTION 14-8 BUILDING OFFICIAL DEFINED
AND SECTION 14-56 APPEALS TO THE CITY CODE
THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN AS FOLLOWS:
SECTION 1. Section 14-1 of the Azusa Municipal Code is hereby amended to
read as follows:
"14-1 CODES ADOPTED
Subject to the changes and amendments set forth in this Chapter,those certain
Codes entitled Uniform Building Code, 1994 Edition,the Uniform Building Codes and Standards
(Volumes 1, 2, & 3) 1994°Edition, Uniform Mechanical Code, 1994 Edition, Uniform Swimming
Pool, Spa and Hot Tub Code, 1994 Edition, and Uniform Sign Code, 1994 Edition, and all
appendices,modifications,and supplements(published by the International Conference of Building
Officials), the Uniform Plumbing Code, 1994 Edition(published by the International Association
of Plumbing and Mechanical Officials), the National Electrical Code 1993 Edition, the
Administrative Code for the 1993 National Electrical Code, 1993 Edition, and all appendices,
modifications, and supplements (published by the National Fire Protection Association), each of
which have been filed in the Office of the City Clerk and each of which are incorporated herein by
reference as though set forth in full,shall be the standards,provisions,and conditions to be observed
and followed in the regulation and control of design, construction, quality, and materials,pse, and
occupancy, location and maintenance of all buildings, structures, and certain equipment regulated
by this Chapter within the City of Azusa. In the event there is any inconsistency between the
provisions of the codes and modifications adopted by this Chapter,and other provisions of the Azusa
Municipal Code,then the more restrictive provision with respect to building regulations shall apply."
SECTION 2. Section 14-8 is hereby added to Chapter 14 of the Azusa
Municipal Code to read as follows:
"Sec. 14-8. Building Official Defined
As used in this Chapter and any other state, local, or federal reference,the term
"Building Official" shall mean the City of Azusa Community Development Director, or his
designee."
SECTION 3, Section 14-51 of the Azusa Municipal Code is hereby amended
to read as follows:
"Sec. 14-51. Generally.
The Uniform Building Code 1994 Edition, as adopted by reference in
accordance with by section 14-1,is amended,added to or modified as set out in this division. If there
is any inconsistency between the provisions of the Uniform Building Code 1994 edition,as adopted,
and the modifications adopted by this division and other provisions of this Code,the more restrictive
provision with respect to building regulations shall apply."

SECTION 4. Section 14-53 of the Azusa Municipal Code is hereby
amended to read as follows:
"14-53. Roof coverings.
(a)
The roof covering of any building, structure, or architectural projection
hereinafter constructed, regardless of type of occupancy classification or building type, shall be of
a Class A or B roof covering-assembly as defined in Chapter 15 of the Uniform Building Code 1994
Edition
(b)
Every building hereinafter constructed, regardless of occupancy classification
or building type,using wood shake or wood shingle as a siding on a vertical surface shall be pressure
treated fire retardant type.
(c1
The provisions of subsection (a) of this section shall apply to repairs or
replacements of roof coverings on existing buildings, structures, or architectural projections. When
repairs or replacements involve more than twenty percent (20%) of the roof area, the entire roof
covering shall be of a Class A or B roof covering-assembly. If the repair or replacement involved
is less than twenty percent (20%) of the entire roof area, and does not utilize contrasting or un-
matching materials of roof covering this subsection does not apply.
(d)
Any asphalt,fiberglass shingle, or similar type roof covering, shall have a roof
decking of a minimum of 1/2" CDX grade plywood or better and installed as per the manufacturer's
instructions.
(e)
No rolled or built-up roof covering-assembly shall be applied or installed to any
building, structure, architectural projection, or addition when the roof pitch is 2 in 12 or greater.
(Example: 2 foot vertical rise in a 12 foot horizontal distance.) When installed on less than a 2 in
12 roof pitch, and on a R-3/M-1 group occupancy building, said rolled or built-up roof shall be
constructed as follows:
(1) Roof Deck to consist of 1/2" plywood(grade CDX or better).
(2) 30#underlayment and/or interlayment.
(3) Minimum of 90#fiberglass covering.
(4) This roof covering system shall be applied in a hot mopped application
unless the new covering is installed on a covered patio not exceeding 300
sq.ft.
(0 Any attic vents, ventilators, ventilation turbines, or dormer vents shall be
painted the same color as the roof covering it is penetrating or surrdiinding
unless deemed not necessary by the building official.

(g) Subsections (C) and (D) are hereby deleted from Section 3204 of the
Uniform Building Code, 1994 Edition.
(h) This section shall be added to the Uniform Building Code 1994 Edition as
adopted by Section 14.1."
SECTION 5. Section 14-55 of the Azusa Municipal Code is hereby amended
to read as follows:
"Sec. 14-55. Reference to city engineer.
(a)This section shall refer only to appendix chapter 33 of the Uniform Building
Code 1994 Edition,as adopted by section 14-1.
(b) For purposes of this section only, in appendix chapter 33 of the Uniform
Building Code 1994 Edition,as adopted by reference, any reference to building official referred to
therein shall mean the city engineer or his or her designee."

SECTION 6. Section 14-56 is hereby added to Chapter 14 of the Azusa
Municipal Code to read as follows:
"Sec. 14-56. Appeals
Any reference to a board of appeals or appeals procedures outlined in any code
adopted by reference in this chapter is herein amended as follows:
(a) In order to hear and decide appeals of orders, decisions or determinations
made by the building official,or his designee(s),relative to the application and interpretation of the
codes contained in this chapter there shall be and is created an Appeals Administrator who shall be
designated by the City Administrator.
(b) The Appeals Administrator shall be an independent third party, not on the
staff of the city,and shall conduct hearings and receive evidence in the same manner, and under the
same rules as provided for in Section 14-416 of the Code. The Appeals Administrator may also
conduct such other independent investigations as may be deemed necessary to render a decision in
the matter being appealed.
(c) Appeals shall be in writing on a form provided by the City of Azusa Building
Division and shall contain the appellants name, address,telephone number, the location for which
an appeal is being sought, the property owner's name, address, and telephone number if different
from the appellant, and shall be signed by the appellant and property owner if the appellant is
different than the property owner. The appellant shall attach a copy of any written order, decision,
or determination for which an appeal is filed. The appellant shall state with specificity the reason
for the appeal and why the application or interpretation of the order,decision,or determination made
by the building official,or his or her designee,is in error and what relief is sought. All appeals shall
be filed within five(5)working days of the date such written notice is received by the appellant, or
posted on the location to which it applies.

(d) The Appeals Administrator shall upon conclusion of receiving any evidence,
or conducting such investigation deemed appropriate, render a written order confirming, denying,
or modifying the order, decision, or determination for which an appeal was filed. The decision of
the Appeals Administrator shall be the final and conclusive administrative remedy subject only to
judicial review under Section 1094.6 of the California Code of Civil Procedure within ninety (90)
days following the Appeals Administrator's final decision."
SECTION 7. Section 14-91 of the Azusa Municipal Code is hereby amended
to read as follows:
"Sec. 14-91. Generally.
The National Electrical Code 1993 Edition, as adopted by section 14-1, is
amended,added to or modified as set out in this division. If there is any inconsistency between the
provisions of the National Electrical Code, as adopted, and the modifications adopted by this
division and other provisions of this Code,the more restrictive provision with respect to building
regulations shall apply."
• SECTION 8. Section 14-111 Azusa Municipal Code is hereby amended to
read as follows:
"Sec. 14-111. Amendments.
If there is any inconsistency between the provisions of the Uniform Mechanical
Code 1994 Edition,as adopted by section 14-1,and any modifications hereafter adopted under this ,,
article and other provisions of this Code,the more restrictive provision shall apply."

,SECTION 9, Section 14-150 of Azusa Municipal Code is hereby amended
to read as follows:
"Sec. 14-150. Generally. `'

The Uniform Plumbing Code,as adopted in section 14-1, is amended, added to
or modified as set out in this division. If there is any inconsistency between the provisions of the
Uniform Plumbing Code, as adopted, and the modifications adopted by this division and other
provisions of this Code, the more restrictive provision with respect to building regulations shall
apply."
SECTION 10. Section 14-191 Azusa Municipal Code is hereby amended
to read as follows: '
"Sec. 14-191. Generally.
The Uniform Sign Code, as adopted in section 14-1, is amended, added to or
modified as set out in this division. If there is any inconsistency between the provisions of such
Uniform Sign Code,as adopted,and the modifications adopted by this division and other prdvisions
of this Code, the more restrictive provision with respect to sign regulations shall apply."

SECTION 11. The City Clerk shall certify the adoption of this Ordinance and
cause the same to be published in the manner required by law.
