HomeMy WebLinkAboutOrdinance No. 96-O12 ORDINANCE NO. 9 6-012 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, APPROVING ZONE CHANGE Z-96-4, AMENDING THE SPECIFIC PLAN IN THE SP2 ZONE, TO REFLECT AN AMENDMENT TO THE AZUSA PACIFIC UNIVERSITY CAMPUS MASTER PLAN, FOR THE EAST CAMPUS AT 901 E. ALOSTA AVE., AND THE WEST CAMPUS AT 701 E. FOOTHILL BLVD. THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN AS FOLLOWS: SECTION l: The City Council of the City of Azusa determines and declares as follows: A. The Planning Commission of the City of Azusa held a duly noticed public hearing on October 16, 1996,and,after fully considering all oral and written testimony offered at the aforementioned public hearing, adopted Resolution No. 96-38, recommending to the City Council the adoption of this ordinance. B. The City Council of the City of Azusa held a duly noticed public hearing on November 18, 1996 concerning this ordinance,and after hearing oral and written testimony, continued the hearing to December 2, 1996, and directed Staff to provide responses to the comments and testimony offered. C. The City Council conducted its continued hearing on December 2, 1996, at which time the applicant agreed to additional amendments to its Specific Plan related to parking resources,traffic management,and assurances that certain lighting would be directed away from residential areas. The City Council then carefully considered the staff report and additional public comments and testimony. D. In adopting Zone Change Z-96-4,the City Council makes the following findings: Based upon the facts set forth in the Planning Commission and City Council staff reports, and upon the evidence and testimony submitted to the Planning Commission and City Council, the proposed changes in the Specific Plan and APU Campus Master Plan will allow the University to better fulfill its mission, will more fully integrate the university with its surroundings, and encourage the vitality of an important community institution. The implementation of the revised Campus Master Plan will bring important benefits to the general welfare of the residents of Azusa and the surrounding region. The amendment to the Specific Plan as set forth in this ordinance is consistent with and in conformance to the General Plan of the City of Azusa, and furthers the intent and purpose of Chapter 88, Zoning, of the Azusa Municipal Code. E. In taking this action,the City Council has considered the effects of its decision on the housing needs of the region in which the City is located and balanced those needs against the public service needs of the City's residents and available fiscal and environmental resources. SECTION 2: Pursuant to the State of California Environmental Quality Act, a Negative Declaration, a copy of which is attached hereto as Exhibit A, has been prepared and reviewed, finding that the proposed project, as amended, could not have a significant effect on the environment. The City Council hereby adopts said Negative Declaration. SECTION 3: The Specific Plan of the SP2 Zone is hereby amended, as attached hereto as Exhibit B, and incorporated herein by reference, as though set out in full and at length. SECTION 4: The City Clerk shall certify the adoption of this ordinance and shall cause the same to be published as required by law. PASSED AND APPROVED thisl6 th day of December, 1996.
