HomeMy WebLinkAboutOrdinance No. 2300 ORDINANCE NO. 2300 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA REZONING PROPERTY LOCATED AT 1041 WEST ARROW HIGHWAY FROM R3 TO C3 TO BRING ZONING INTO CONFORMANCE WITH EXISTING COMMERCIAL USES ( ZONE CHANGE CASE NO. Z-246) THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of Azusa does hereby find, determine and declare that: A. The zone change of the subject area described as 1041 West Arrow Highway, and legally described as THE EASTERLY 240 ' OF THE SOUTHERLY 160 ' OF THE SOUTHEAST QUARTER OF THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 3, TOWNSHIP 1, SOUTH RANGE 10 WEST, OF THE SAN BERNARDINO MERIDIAN, described in the map designated "Exhibit A" attached hereto and incorporated herein, was initiated by the City Council of the City of Azusa in order to bring zoning into conformance with existing commercial uses after parcel was inadvertently pre-zoned for residential use by Zone Change No. Z-232 prior to Annexation No. 88. B. The change and amendment to the Zoning Ordinance set forth below prezoning the subject area was duly initiated, notice of public hearing thereon was duly given and published in accordance with applicable law; C. Public hearings thereon were duly held by the Planning Commission of the City of Azusa on November 6, 1985, and by the City Council of the City of Azusa on December 16, 1985; D. On November 6, 1985, the Planning Commission of the City of Azusa by Resolution No. 2236 recom- mended to the City Council that the zone change classification proposed be adopted upon annexation of the subject area; E. The City Council has considered all of the information presented to it at the public hearing held on December 16 , 1985, and determines that the public necessity, convenience, general welfare and good zoning practice require that the following amendment and zone change be made; F. In taking this action the City Council considered the effects of the decision on the housing needs of the region in which the City is located and balanced those needs against the public service needs of the City residents and available fiscal and environmental resources; G. This zone change is consistent with the General plan of the City of Azusa and all elements thereof; SECTION 2. Notwithstanding the provisions of Section 19 . 06.010 of the Azusa Municipal Code and the zoning map referred to therein, the subject properties described CDG/RES2359 herein are hereby changed from a R3a zone (Multi-Family Residential) to a C3 zone (General Commercial) . SECTION 3 . Upon the effective date of this ordinance the Director of Community Development shall revise the official zoning map of the City of Azusa to reflect the changes in zone of the premises described herein. SECTION 4. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published as required by law.
