HomeMy WebLinkAboutOrdinance No. 2311 ORDINANCE NO. 2311 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA CHANGING THE ZONE OF PROPERTY GENERALLY LOCATED AT 1151 WEST ARROW HIGHWAY FROM R3a (MULTIFAMILY RESIDENTIAL) TO R3c (MULTIFAMILY RESIDENTIAL) - ZONE CHANGE CASE NO. Z-248 THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN AS FOLLOWS : SECTION 1. The City Council of the City of Azusa does hereby find, determine and declare that: A. The applicant, Mr. Barry A. Cottle on behalf of R.C. Hobbs Development Corporation has applied to the City for a change of zone of the subject property from R3a (Multifamily Residential) to R3c (Multifamily Residential) . The subject pro- perty is generally described as 1151 West Arrow Highway within the City of Azusa and is legally described as : The E220 ' of the SW 1/4 of the SW 1/4 of the SW 1/4 of Section 3, Township 1 South, Range 10 West, San Bernardino Meridian Except a strip of land 25 ' wide of the south side thereof for road purposes and as shown on a map on file with the City Clerk. B. The change and amendment to the Zoning Ordinance set forth below for the subject property was duly initiated, and notice of public hearings thereon were duly given and published in accord- ance with applicable law. C. Public hearings thereon were duly held by the Planning Commission of the City of Azusa on February 19, 1986, and by the City Council of the City of Azusa on April 15, 1986. D. On February 19, 1986, the Planning Commission of the City of Azusa by Resolution No. 2280 recommended to the City Council that the zone change classification proposed to be adopted for the subject property be denied. E. Thereafter, the applicant filed a notice of appeal of the Planning Commission' s decision with the City Clerk within the time required by law. F. The City Council has considered all of the information presented to it at the public hearing held on April 15, 1986, and finds, determines and declares that the public necessity, convenience, general welfare and good zoning practice require that the zone text amendment and zone change set forth in this ordinance be made. G. The City Council further finds, determines and declares that the zone text amendment and zone change for the subject property is consistent with the General Plan of the City of Azusa and the elements thereof. H. In taking this action the City Council con- sidered the effects of the decision on the housing needs of the region in which the City is located and balanced those needs against the public service needs of the City residents and available fiscal and environmental re- sources. SECTION 2. Notwithstanding the provisions of Section 19. 06. 010 of the Azusa Municipal Code and the Zoning Map referred to therein, the subject property described in this Ordinance is hereby placed in the R3c (Multifamily Residential) zone. SECTION 3. Upon the effective date of this Ordinance, the Director of Community Development shall revise the Official Zoning Map of the City of Azusa to reflect the change in zone of the subject property. SECTION 4. The City Clerk shall certify the passage of this Ordinance and shall cause the same to be published in the manner required by law.
