RUDISEL,COMMUNITY IMPROVEMENT MANAG VIA: HENRY GARCIA, CITY ADMINISTRATOR DATE: SEPTEMBER 15, 1997 SUBJECT: BUSINESS LICENSE FOR CARNIVAL OPERATOR Facts and Analysis: The Business License Division was contacted today by"MLM Amusements"in order to obtain a Business License to operate a carnival at 405 S. Azusa Avenue on behalf of the "Westside Praise Chapel"on September 19-21, 1997. The amusement operator and the church were unaware of the City Business License, and approval by the City Council, requirement until they submitted an application for a Temporary Use Permit this date. Section 18-20 Azusa Municipal Code requires approval by the City Council prior to the Business License Division issuing a license to the amusement operator. The church has obtained approvals for the carnival from the Police and Fire Department under the Temporary Use Permit requirements. Due to the churches desire to hold the carnival as scheduled, and the requirement for City Council approval of the business license for the amusement operator, a request to submit the license application as a matter of subsequent need is being made at the request of the event organizer Mr. Vincent Margolis. Staff has pointed out to the event organizers that the amusement operator is required to make a written application to the Police Chief for a"Permit"to operate a carnival at least 30 days before the planned carnival pursuant to Section 18-137 Azusa Municipal Code(copy attached),which was not done by the carnival operator. Recommendation: Staffrecommends that the City Council approve the request for a business license and that provisions of Section 18-137 be enforced at the Police Chief's discretion. 9/417 afil • • CRY OFA CITY OF AZUSA 41 o TEMPORARY USE PERMITS - APPROVAL FORM AND CRY OF AZUSAF— PROCEDURE - CHAPTER 88 - DIVISION 11 Any person wishing to conduct a special event within the City of Azusa must obtain approval from the Community Development Department. One-day approval can be granted if the following steps are followed: • Step 1: Obtain and complete this approval form with the necessary signatures from the Police Department, the Fire Department, and the property owner where the event will take place. • Step 2: Return completed form along with a plot plan of the property where event will take place to the Planning Division within the Community Development Department at Azusa City Hall. The plot plan must outline the precise area that will be occupied by the event and include all structures, parking spaces, entrances/exits, landscaping, and surrounding streets (floor plan of building must be included only if event will be taking place indoors). tep 3: Return the form to the Planning Division for final approval and retain a copy; approved copy should be kept on hand at all times during the event. vApplicant's Name: '. (Code 1971, § 5.08.150) Sec. 18-20. City council approval prerequisite to issuance of certain licenses. No license shall be issued by the business license officer for any of the businesses set forth in sections 18-696, 18-698,18-136;:18-10, 18-63, 18-811, and article II of chapter 82 or for any place of amusement, exhibition or entertainment for which a license is required under this Code without the approval of the city council. The application shall be filed with the business license officer upon such forms as the business license officer may prescribe. The city council may impose such terms, conditions and restrictions upon the operation, management and conduct of these businesses,not in conflict with any paramount law, as the council may deem necessary or expedient for the protection of the health, safety and welfare of the city and its inhabitants. (Code 1971, § 5.08.160) Sec. 18-21. Revocation and suspension of licenses. (a) Every license granted under this chapter or any ordinance is granted and used by all parties receiving or using the license subject to the express condition that the city council may revoke the license at any time when it is determined by the city council that: (1) Any state of facts exists upon which it would be authorized to deny an application for such license or permit, if required; (2) The person to whom such license was issued or any of his agents, servants or em- ployees or any other person in charge of or employed about the business for which the license was issued has violated any of the conditions of the license or permit, if any, or terms of this Code or of any law of the state; (3) The license or permit was obtained by fraudulent representations; (4) The holder thereof is an unfit person to be trusted with the privileges granted by the license or has conducted his business in an immoral or disorderly manner or has failed to make every reasonable effort to maintain order among his customers and patrons and to prevent violations of law by them; or (5) The business has been so conducted as to be a public nuisance. (b) No license shall be revoked without giving the holder thereof an opportunity to appear before the city council and be heard in his own behalf. The city council shall cause a notice of such hearing to be given to the holder of such license at a time not less than five days before the hearing. At the time set for the hearing or at the date to which the hearing may be continued by the city council,the holder of the license may be heard and may present any facts to show why such license shall not be revoked, and the city council shall hear statements from other persons who may attend the hearing and present reasons why the license should or should not be revoked. License tax. - tie oar \ o Ci c i t u l \- S e 1 'Z Every person engaged in the business of exhibiting, conducting, managing or operating a circus, wild west show, carnival or other exhibition or entertainment at which feats of horse- manship, acrobatic feats or trained or wild animals are exhibited or displayed or other similar show or exhibition shall pay a license tax of $180.00 for the first day and $60.00 for each additional day. (Code 1971, § 5.28.010) Sec. 18-137. Permit procedure. (a) Written application for a permit for any circus, carnival or traveling show of a like character shall be filed with the police department at least 30 days before the first date for which such permit is to be effective.There shall be filed with the application a list of the names and addresses of all owners, agents and employees of such circus, carnival or traveling show who will participate in the operations for which the permit is requested. If there is any change in the personnel after the filing of the application and before the permit is issued, written notice of such change,including the names and addresses of any additional personnel, shall be filed with the police department. (b) The chief of police shall cause each such owner, agent and employee to be photo- graphed and fingerprinted and shall collect a service charge of$10.00 for each such person so photographed and fingerprinted. (c) The application, list, photographs and fingerprints shall be filed with and remain a part of the permanent records of the police department. (d) No permit shall be issued until the photographing and fingerprinting of the persons named on the list has been completed and application has been made to the business license officer for the required business license. No facilities shall be erected, installed or moved into place until the permit is issued. (e) Members of any local organization that contracts for or sponsors such circus, carnival or other show and who perform services therefor without personal compensation shall not be considered as owners, agents or employees within the meaning of this section. (Code 1971, § 5.28.020) Sec. 18-138. Police supervision of permitted activities. (a) The chief of police may require as part of any permit that the person engaged in the business of exhibiting, conducting, managing or operating a circus, wild west show, carnival or other exhibition or entertainment at which feats of horsemanship, acrobatic feats or trained or wild animals are exhibited or displayed or other similar show or exhibition employ police officers or approved special guards as may be deemed necessary to ensure that the public peace will be kept and to ensure that the provisions of this Code, the permit and state law will be CD18:25 § 18-138 AZUSA MUNICIPAL CODE obeyed. The number of such police officers or special guards will be determined by the chief of police.The chief of police may attach to the permit any conditions necessary for the protection of the public health, welfare or safety. (b) The applicant and all persons participating in the management or supervision of the proposed business shall abide by all statements contained in the application,by all applicable laws and ordinances and by the terms and conditions set forth in the permit. (Code 1971, § 5.28.021) Sec. 18-139. Permit revocation, suspension. (a) Any permit issued pursuant to this division may be revoked or suspended at any time by the chief of police for any of the following reasons: (1) The conduct or operation of the circus, wild west show, carnival or other similar exhibition or entertainment violates the conditions of the permit or this division. (2) The conduct of the circus, wild west show, carnival or other similar exhibition or entertainment does or will endanger in any manner the public welfare or the peace, health or safety of the city or its inhabitants. (3) The owner or person in charge thereof violates or permits any infraction of any state law or city ordinance. (b) Such revocation or suspension shall be by delivering a notice of suspension or revo- cation,with the reasons therefor,to the applicant or to the person in charge of the circus,wild west show, carnival or other similar exhibition in person. A copy of the notice shall also be mailed to the address of the applicant as set forth in the permit application. Such suspension or revocation shall be effective immediately following personal delivery of notice of suspension or revocation. (Code 1971, § 5.28.022) Sec. 18.140. Hearing on permit suspension or revocation. (a) When any permit required in this division has been revoked or suspended,the person to whom the permit was issued may appeal in writing the revocation or suspension to the city council within five days of such suspension or revocation. The city council shall hold a public hearing as soon as practicable after receiving such appeal and shall consider all facts and evidence bearing on the reason for the suspension or revocation. (b) After hearing all facts and evidence, the city council shall, if the suspension or revo- cation appears warranted, affirm such suspension or revocation. Otherwise, it shall reinstate the permit. Under the 457 deferred compensation program, employees can defer income to be invested until retirement years. This is similar to 401(k) plans frequently available to private sector employees. In 1994, the California Public Employees Retirement System (CaIPERS) announced that the Board of Administration approved a 457 Deferred Compensation Plan (the "PERS" Plan) to be made available to public agencies. Subsequent to the announcement, City employees expressed a desire to learn more about the PERS Plan. CaIPERS made a presentation about the PERS Plan to City association and union representatives. After the presentation, representatives requested that it be included as one of the companies administering the city's 457 deferred compensation program. The distinct advantage is that the City is able to save costs by centralizing the administration of benefits. Currently, CaIPERS administers not only the retirement system but also the City's health benefits program under the Public Employees' Medical and Hospital Care Act. The benefits provided through CaIPERS are offered state-wide resulting in more options at lower costs and with better service. Even more recently, CaIPERS has added another benefit of long-term care to the list of benefits offered state-wide. The attached PERS Plan includes the recently-enacted Small Business Job Protection Act requirements to deferred compensation plans; and pursuant to Government Code 21677, the CaIPERS Board of Administration has appointed State Street Bank and Trust Company and State Street Bank and Trust Company of California to perform administrative services under the PERS Plan and to act as the Board's agent in all matters relating to administration of the PERS Plan. In addition to core funds, the City may elect to include the Self-Managed Account(SMA)thereby enabling a wide range of investment choices. The SMA offers the maximum amount of investment flexibility available. RECOMMENDATION It is recommended that Council approve the attached Resolution adopting the California Public Employees Deferred Compensation Plan to include the CaIPERS 457 Self-Managed Account Option and authorize the Mayor to sign the agreement adopting the Plan. However, since adequate funding was secured and the base bid came in more than $500,000 under projected cost estimates, the scope of work and construction materials were revisited. The roof of the jail and existing evidence room, were two areas that suffered during this cut back period. They were removed from the list of areas to receive new roofing and scheduled to go untouched. Also, a lighter and less expensive caliber of tapered roofing insulation material for the north, central and south buildings was called for. Findings Change Order#4 allows for roof replacement in the jail and evidence room areas, a higher quality of tapered roofing insulation for the three buildings, and related roofing improvements. These improvements include replacing existing roof platforms, additional parapets, and improved lead flashing. This approach will provide the Department with an upgraded and more reliable roofing system, as well as address those areas that were cut from receiving new roofing. On February 18, 1997, Council awarded the contract to the lowest responsive bidder, the Hazama Corporation, and a"Notice to Proceed"was issued on May 1, 1997. However, all bids were based on drawings that were in the"back-check" stage of the plan checking process through the City. Once an approved set of drawings were received back from the City's plan checker, blueprints stamped with "Approved for Construction" were issued to the Hazama Corporation. This set of drawings is then reviewed for an increased scope of work and/or materials and supplied to the appropriate sub-contractors. The sub-contractors then provide the general contractor with an adjusted cost for their effected trades. Findings The Hazama Corporation and the Architectural Firm of WMM Associates have reviewed the increased scope of work and adjusted costs submitted by the sub-contractors. The conclusion was reached that based on those items required by plan check, the adjusted figures are reasonable. Painting and also water cleaning of existing painted areas were reviewed by WMM Associates as the least expensive. These solutions were not considered acceptable solutions for a attractive complex of buildings. The final Construction Documents included plastering the entire new center building. No final conclusion and action was made for the existing buildings due to the uncertainty of the cutback in budget. The decision was tabled in waiting for the final bid results. Findings Several approaches were considered for a total exterior refinishing of the facility. The most cost effective approach(respecting longevity, cost and appearance) is a combination of finishes. The north building, south building and new site walls should be plastered due to the high visibility of the surfaces and would match the new center building and existing plastered site walls. The existing plastered site walls will only receive a color coat to match the new color scheme. The rear jail structure would receive a "Tex-Cote" finish that has a similar appearance to plaster, reduces the masonry lines showing through and provides a ten year maintenance warranty. Finally, the less visible existing site walls,new site walls, and parking structure behind the north and central buildings would receive paint only to match in color the rest of the complex. Recommendation Staff recommends that pending the approval of LaSalle National Bank, Change Order#6 be approved as attached in the amount of$64,207.
