HomeMy WebLinkAboutOrdinance No. 2323 ORDINANCE NO. 2323 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA CHANGING THE ZONE OF PROPERTY GENERALLY LOCATED AT 247 NORTH DALTON AVENUE, FROM RESTRICTED COMMERCIAL TO MULTI-FAMILY RESIDENTIAL - ZONE CHANGE CASE NO. Z-250. The City Council of the City of Azusa does ordain as follows: SECTION 1. The City Council of the City of Azusa does hereby find, determine and declare that: A. The Applicant, Angela Hernandez, has applied to the City for a change of zone of the subject property from C-2 ( restricted commercial) to R-3c (multi-family residential) . The subject property is generally described as 247 North Dalton Avenue within the City of Azusa and is legally described as: Lot 1 of Block 67, in the City of Azusa, County of Los Angeles, State of California, as per map recorded in Book 15, Page 93, et seq. of Miscellaneous Reports in the office of the County Recorder of said County, and as shown on a Map on file with the City Clerk. B. The change in amendment to the zoning ordinance set forth below for the subject property was duly initiated, and notice of public hearings thereon were duly given and published in accordance with applicable law. C. Public hearings were duly held by the Planning Commission of the City of Azusa on July 9, 1986, and by the City Council of the City of Azusa on August 4, 1986. D. On July 9, 1986, the Planning Commission of the City of Azusa by Resolution No. 2339 recommended to the City Council that the zone change classification proposed to be adopted for the subject property be approved. E. The City Council has considered all the information presented to it at the public hearing held on August 4, 1986, and finds, determines and declares that the public necessity, convenience, general welfare and good zoning practice require that the zone text amendment and zone change set forth in this Ordinance be made. F. The City Council further finds, deter- mines and declares that the zone text amendment and zone change for the subject property is consistent with the general plan of the City of Azusa and the elements thereof. In taking this action the City Council considered the effects of the decision on the housing needs of the region in which the City is located and balanced those needs against the public service needs of the City residents and available fiscal and environmental resources. The change in zone is stated by the applicant to be for the purpose of constructing a senior citizen apartment complex which would permit a density bonus. SECTION 2. Notwithstanding the provisions of Section 19.06.010 of the Azusa Municipal Code and the Zoning Map referred to therein, the subject property described in this Ordinance is hereby placed in the R-3c (multi-family residential) zone. SECTION 3. Upon the effective date of this Ordinance, the Director of Community Development shall revise the official zoning map of the City of Azusa to reflect the change in zone of the subject property. SECTION 4. The City Clerk shall certify the passage of this Ordinance and shall cause the same to be published in the manner required by law. PASSED AND APPROVED this 2nd day of Sentember, 1986.
