HomeMy WebLinkAboutOrdinance No. 2338 ORDINANCE NO. 2338 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA ADDING SECTIONS 2. 04 . 050 AND 2 . 28. 015, AMENDING SECTIONS 2 . 12. 010, 2. 16 . 020, 2 . 18 . 020 AND 2 . 76. 015 AND REPEALING SECTIONS 2 . 12 . 090, 2 . 16. 090, 2. 18. 050 AND 2. 76 . 017 OF THE AZUSA MUNICIPAL CODE, ALL RELATING TO APPOINTMENT AND REMOVAL OF MEMBERS OF CITY BOARDS AND COMMISSIONS BY THE MAYOR WITH APPROVAL OF CITY COUNCIL. THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN AS FOLLOWS: SECTION 1 . Section 2. 04. 050 is hereby added to the Azusa Municipal Code to read as follows: "2 . 04 . 050 APPOINTMENT AND REMOVAL OF MEMBERS OF CITY COMMISSIONS AND BOARDS. The appointment of persons to and the removal of members from the Planning Commission, Parks and Recreation Commission, Cultural and Historical Landmark Commission, Personnel Board, Public Library Commission, and such other bodies as the Council may designate (hereafter "Board of Commission") shall be in accordance with the following procedures: A. At least ten (10) working days prior to selection of a person to fill a vacancy on a board or commission, the Council shall announce the vacancy and shall establish a period for the filing of applications by persons interested in filling the vacancy. B. All persons interested in filling the vacancy, including incumbents, shall file an application on a form approved by the Council within the designated filing period. A person may file one application for all vacancies which may occur on particular boards or commissions within the calendar year that the application is received, provided, that a new application must be filed for vacancies in succeeding calendar years . C. Prior to the Mayor' s appointment of a person to any board or commission, the Council shall interview all persons who have submitted an application for the position and who are interested in and available for the interview. The interviews shall be conducted in open sessions of the Council. The Council shall select the date or dates for the interviews and may decline to interview any person who is not available to be interviewed on the date or dates selected. D. Upon completion of the interviews, the Mayor with the approval of the Council shall appoint a person, from the applications submitted, who, in his judgement, is the best qualified to fill the vacancy. ,E. Members of boards and commissions over which the Mayor has appointing authority shall serve at the pleasure of the Mayor and Council and may be removed from office for any reason by the Mayor with approval of the Council or by the Council. SECTION 2. Section 2 .12. 010 of the Azusa Municipal ,Code is hereby amended to read as follows: "2. 12. 010 APPOINTMENT-MEMBERSHIP. There is created and established a Planning Commission to be known as the "Planning Commission of the City of Azusa" which Planning Commission shall consist of seven members, none of whom shall be officers or employees of the City. One member of the Council to be selected by the Mayor with the approval of the Council; the City Engineer and the City Attorney shall serve the Planning Commission in an advisory capacity. The members of the Planning Commission shall be appointed by the Mayor with the approval of Council and may be removed from office pursuant to Section 2 . 04 .050 . " SECTION 3. Section 2 .12.090 of the Azusa Municipal Code is hereby repealed. SECTION 4. Section 2. 16 . 020 of the Azusa Municipal Code is hereby amended to read as follows : "2. 16 .020 APPOINTMENT. The Park and Recreation Commission shall consist of five members, each appointed for a three-year term of office. Two members shall be appointed by the Mayor with the approval of the City Council pursuant to Section 2 . 04 . 050. The Mayor with the approval of the City Council, shall appoint two members recommended by the governing board of the Azusa Unified School District. One member shall be selected by the above four appointees . Members over which the Mayor has appointing authority may be removed from office pursuant to Section 2. 04 .05 . All members of the Commission shall be appointed for a term expiring on June thirtieth of the appropriate year and shall serve for the term provided herein until their successors are appointed. " SECTION 5. Section 2. 16 .090 of the Azusa Municipal Code is hereby repealed. SECTION 6. Section 2. 18. 020 of the Azusa Municipal Code is hereby amended to read as follows: "2. 18. 020 APPOINTMENT. The Cultural and Historical Landmark Commission shall consist of seven members, none of whom shall be officers or employees of the City. Of the members of the Commission first appointed, two shall be appointed for terms of one year; two for terms of two years ; two for terms of three years; and one for a term of four years. The successors of the members of the Commission first appointed shall be appointed for terms of four years . All members shall be appointed by the -2- i r I Mayor with approval of the City Council pursuant to Section 2. 04. 050. Members of the Commission may be removed pursuant to Section 2 . 04. 050. Vacancies occurring in the Commission shall be filled in the same manner as provided for in the initial appointment. Members of the Commission shall hold office until their reappointment or until their successors have been appointed and have qualified. " SECTION 7 . Section 2. 18. 050 of the Azusa Municipal Code is hereby repealed. SECTION 8. Section 2 . 28. 015 is hereby added to the Azusa Municipal Code to read as follows : "2. 28. 015 APPOINTMENT-COUNCIL PROCEDURES. The two members of the Personnel Board to be appointed by the City Council shall be appointed to, and may be removed from, the Personnel Board pursuant to Section 2 . 04 . 050 . " SECTION 9. Section 2 . 76. 015 of the Azusa Municipal Code is hereby amended to read as follows : "2. 76. 015 CITY LIBRARY COMMISSION - COMPOSITION - APPOINTMENT, TERM OF MEMBERS. A City Library Commission consisting of five members is hereby created. Members of the Commission shall be appointed by the Mayor with the approval of the City Council pursuant to Section 2 . 04. 050. Members may be removed from office pursuant to Section 2 . 04 . 050. The City Library Commission shall meet at such times and places as the Commission may fix by resolution. " SECTION 10. Section 2. 76. 017 of the Azusa Municipal Code is hereby repealed. SECTION 11. The City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be published as required by law. PASSED AND APPROVED this 19th day of January, 1987. THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN AS FOLLOWS: SECTION 1. Section 2. 04 . 010 is hereby added to the Azusa Municipal Code to read as follows : 2. 04 . 010 LOCATION AND TIME OF CITY COUNCIL MEETINGS. The City Council shall hold its meetings in the Civic Auditorium of the City of Azusa, 213 E. Foothill Blvd. , Azusa, provided however, that the Council may order a meeting to be held at another location if necessary or convenient for the conduct of City business. The Council shall, by resolution, set the day and time for Council meetings. SECTION 2. The City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be published as required by law. PASSED AND APPROVED this 19th day of January, 1987.
