HomeMy WebLinkAboutOrdinance No. 2350 ORDINANCE NO. 2350 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING SECTION 11.60.020 OF THE AZUSA MUNICIPAL CODE RELATING TO THE RIDING OF BICYCLES, SKATEBOARDS AND OTHER WHEELED TOYS IN BUSINESS AREAS AND PUBLIC ASSEMBLY AREAS WITHIN THE CITY THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of Azusa does hereby find, determine and declare that: A. Pursuant to California Vehicle Code Section 21967, a local authority may adopt rules and regu- lations prohibiting or restricting persons from riding or propelling skateboards in roadways. B. Pursuant to California Vehicle Code Section 21968, no motorized skateboard may be propelled on any sidewalk, roadway, or any other part of a highway or on any bikeway, bicycle path or trail, equestrian trail, or hiking or recreational trail. C. A riding of bicycles, skateboards and wheeled toys in public areas, including sidewalks, business districts, public assembly areas and shopping centers constitutes a distinct threat to the public health and safety because of the fact that many people congregate in such areas for the purpose of assembling, shopping, conducting business or walking and the use of bicycles, skateboards or other wheeled toys is incompatible with such activities. Further, sidewalks in front of business districts and public assembly areas offer only limited space for walking or assembling and the use of bicycles, skateboards or wheeled toys on such locations could cause collisions between pedestrians and the bicycles, skateboards or wheeled toys or could force pedestrians off the sidewalks onto roadways or parking areas where the potential exists for conflicts with motor vehicles. SECTION 2. Section 11.60.010 of the Azusa Municipal Code is hereby amended to read as follows: "11.60.020 Bicycle, Skateboard and Other Wheeled Toy Operation Restrictions. A. No person shall ride or propel a bicycle, skateboard or other wheeled toy upon any sidewalk in front of any church, school, or place of public assembly while persons are entering or leaving said place of public assembly or while such assembly is in progress. B. No person shall ride or propel a bicycle, skateboard or other wheeled toy upon the public sidewalk in front of a business or office or in a shopping center . C. Prior to the enforcement of the provisions of Subsection B, a sign clearly visible to members of the public shall be posted. D. Where the use of a bicycle, skateboard or other wheeled toy is permitted on a sidewalk, the rider shall give the right-of-way to pedestrians. E. No person shall ride a skateboard, skooter, skoot-skate, wheeled sled, or similar device except when in an upright position with one foot on the device. F. The rider of a bicycle, skateboard or other wheeled toy on the roadway shall ride as nearly as practical within five feet of the righthand curb or edge of the roadway. G As used in this section, the term "other wheeled toy" shall mean, but not be limited to, the use of a skateboard, skooter, skoot-skate, roller skates, tricycle, wheeled sled, or such other similar toy or device which has wheels and is pro- pelled by the rider thereof. " SECTION 3. The City Clerk shall certify the passage of this ordinance and shall cause the same to be published in the manner required by law. PASSED AND APPROVED this 4th day of May 1987.
