HomeMy WebLinkAboutOrdinance No. 2376 ORDINANCE NO. 2376 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING CHAPTER 5 OF THE AZUSA MUNICIPAL CODE, BUSINESS LICENSES AND REGULATIONS, BY THE ADDITION THERETO OF SECTION 5.08.185 RELATING TO THE ADDITION OF A FLAT FEE ON BUSINESS LICENSE TAXES AND AMENDING SECTION 5. 08.240 OF THE AZUSA MUNICIPAL CODE ESTABLISHING AN ANNUAL PERCENTAGE INCREASE IN CERTAIN BUSINESS LICENSES AND OTHER TAXES, PROVIDING FOR DESIGNATION OF DEPOSIT OF REVENUES, AND PROVIDING FOR AN ELECTION THEREON THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN AS FOLLOWS: SECTION 1. Section 5. 08. 185 of the Azusa Municipal Code is hereby added to read as follows: "5. 08. 185 SURCHARGE. Every business category required to have a license under the provisions of this title shall pay a flat fee to the City in the amount of forty dollars ($40. 00) which will be added to the total of each and every business license effective January 1, 1989. SECTION 2 . Section 5. 08.240 of the Azusa Municipal Code is hereby amended to read as follows: "5. 08.240 ANNUAL ADJUSTMENT OF RATES; PROCEEDS. A. The rates of business licenses as set forth in Title 5 shall be increased annually commencing January 1, 1989. The percentage of increase shall be the percentage increase for the year ended on the prior June 30 in the California Consumer Price Index (for all items) as determined by the California Department of Industrial Relations pursuant to the provisions of Section 2212 of the Revenue and Taxation Code, less the "real growth" in business license revenues as calculated below, but in no case less than zero. B. "Real Growth" in business license revenues shall be the year-to-year percent change in business license revenues, taking into consideration the minimum increase defined in paragraph A, and as per the financial statements of the City as at the prior June 30, but in no case less than zero. C. The revenues collected from the taxes imposed and levied by Title 3 and Title 5 of this Code shall be deposited into the General Fund of the City. SECTION 3 . The City Council may amend this Section 5. 08.240 of the Azusa Municipal Code without a vote of the people to the extent necessary to implement the procedures for collection of the tax and to the extent permitted pursuant to Government Code Sections 53720, et. seq. SECTION 4. This ordinance, being for the enactment and imposition of a general tax, shall be submitted to a vote of the people at the general election scheduled for November 8, 1988. This ordinance shall become valid and binding if a majority of the voters voting thereon vote in its favor at said election and shall be effective on the date that the City Council certifies the results of said election. If the provisions of Government Code Sections 53720, et seq. , are duly repealed or amended, or interpreted by the courts so that a vote of the people is not required for enactment of said Section 5. 08.240, then this Ordinance shall take effect as provided for all other City ordinances and may be amended in the same manner as all other City ordinances. SECTION 5. The City Clerk shall certify the adoption of this ordinance and shall cause it to be published in the manner required by law.
