Mayor Memmesheimer called the adjourned meeting to order.

The Mayor announced that the hour of 7:30 having arrived,
and this was the date and place to hear protests in the
matter of re -zoning from R-1 to C-1 of that property
described as:
Lots 8 and 16, Block C of Subdivision No. 1
of lands of Azusa Land and Water Company,
315 E. Gladstone Avenue, Azusa, California
as recorded on the Maps of Azusa, located
between Gladstone Avenue and Russell Street,
North and South and Azusa Avenue and Pasadena
Avenue, East and West.
Heretofore, the Planning Commission of the City of Azusa
having held Public Hearings as required by law, have
recommended said zone change to the City Council.
Notices setting forth the day and hour for hearing
protests having been published and mailed to property
owners as required by Ordinance 409, the City Council
will now hear protests from any member of the audience.
There were no oral protests. No written protests had
been received in the office of the City Clerk.
There having been no protests entered, it was moved
by Councilman Johnson, seconded by Councilman Ortuno
and unanimously carried that the City Council accept
the recommendation of the Planning Commission for the
re -zoning of this property.
Councilman Ortuno offered an Ordinance entitled:
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA
COUNTY OF IAS ANGELES, STATE OF CALIFORNIA, AMENDING
ORDINANCE NUMBER 409 OF THE CITY OF AZUSA, ENTITLED:
"AN ORDINANCE ESTABLISHING A ZONING AND DISTRIBUTING
PLAN WITHIN THE CITY OF AZUSA, CREATING THIRTEEN USE
ZONES, REGULATING THE USE OF PROPERTY, HEIGHT AND AREA
OF STRUCTURES AND OPEN SPACES FOR LIGHT, AIR AND VENTI-
LATION; ADOPTING A MAP OF SAID ZONES; DEFINING TERMS
USED; PROVIDING FOR THE ADJUSTMENT ENFORCEMENT, AND
AMENDMENT THEREOF; PRESCRIBING PENALTIES FOR VIOLATION;
AND REPEALING ALL ORDINANCES IN CONFLICT THEREWITH",
AS SAID ORDINANCE IS AMENDED BY ORDINANCES NUMBER 421,
441, 455, 458, 467, AND ALL OTHER ORDINANCES AND PARTS
OF ORDINANCES INSOFAR ONLY AS THE PROVISIONS OF SAME
CONFLICT THEREWITH.
To be placed upon its first reading. The title of the
Ordinance was read.
Moved by Councilman Fawcett, seconded by Councilman
Johnson, and unanimously carried, that further reading
of the Ordinance be waived.
Mayor Memmesheimer asked for a report on the bids for
the Recreation Building. The City Engineer reported
that he and Mr. Ben Parker, the Architect, and the City
Attorney analyzed the bids. There was just:one question
that arose concerning this, and that was the bid for
the laminated beams which were to support the roof.
These were to be supplied by a concern not considered
desirable, although it was pointed out that all the low
bidders named this same concern in their bids. He also
stated that Mr. Hummer, the low bidder, has agreed to
have the beams furnished by a bidder acceptable to the
City at no extra cost. It was recommended that the
Mayor be authorized to sign the contract after the
Committee has reported to him that the matter of delivery

has been satisfactorily guaranteed. The City Engineer
stated they could insert a penalty clause on the
contract between Mr. Hummer and the sub -contractor
calling for a $25.00 per day penalty if the beams are
not delivered by predetermined date. The date will
be set in consultation with the contractor. Mayor
Memmesheimer then asked, on the low bid, what portion
of the Recreation Center would be built first. The
Engineer stated the -entire building would be built on
the contract price of $169,987. It was brought out in
further discussion that the second lowest bidder was a
contractor from Azusa, but due to the fact that all labor
must be -obtained through the Union, it would be of no
extra benefit to the City to have the bid go to a local
man.'
Moved by Councilman Johnson, seconded by Councilman
Ortuno and unanimously carried that the entire structure
be built at this time.
Moved by Councilman Romero, seconded by Councilman Ortuno
and duly carried, that the contract for the construction
of the Recreation Building be awarded to the Hummer
Construction Company on condition that the element
of the laminated beams be clarified and accepted by
the bidder, and that the Mayor be authorized to sign
the contract, based on the plans and specifications,
at such time as the committee, consisting of the City
Engineer, the Architect, and the City Attorney, file
a written statement in the office of the Clerk that all
conditions of the contract have been approved and are
satisfactory; that the bid bonds of the unsuccessful
bidders be returned at that time.
A letter from John Avedesian was submitted to Council
requesting the cancellation of the existing contract
for rubbish collection he has with the City of Azusa,
A letter was also submitted from Councilman Fawcett
recommending that this contract be abrogated, in the
interests of the citizens of Azusa, by mutual consent
of both parties. Discussion was held about what was
considered rubbish, what was to be picked up and what
was not to be picked up. The City Attorney reported
that he had examined Avedesian's contract, and if
Avedesian was to stay strictly within his contract and
remove only that which he was directed by virtue of the
terms of his contract, there would be a great amount of
trash still to be done ways with, either by the City or
by the property owners themselves. If Avedesian lives
up only to his contract, the trash situation in Azusa
will be impossible. It was brought out in discussion
that before this contract was let, rubbish was picked
up by City trucks, and owners themselves would dump
their rubbish in the'City Dump, but now that we no
longer have this dump, it is impossible for people to
do this.
Moved by Councilman Fawcett, seconded by Councilman
Romero, that the contract with John Avedesian be
abrogated by mutual agreement, and that the termination
to be absolute on December 31, 1954, on the condition
that in the meantime Avedesian carry out the terms of
his contract without restriction.
Motion passed by the following vote:
AYES: Councilmen: Fawcett, Ortuno, Romero, Memmesheimer
NOES: Councilman: Johnson
ABSENT: None
Mr. Avedesian appeared before Council and stated that
although he had been blamed for many things, the most
complaints were concerning the schedule of pick-ups

and not -what was picked up. He stated he felt he hadn-It
failed to keep the terms of the contract, and that he
would want to be in a position to be considered on
other bids for the City.
The City Attorney addressed Council saying he would
like to make a statement for the records:
"As City Attorney I have approved the action of the
Council terminating the contract of Mr. Avedesian, and
upon the conditions under which it is terminated, for
the reason that the present contract existing between
Mr. Avedesian and the City requires Mr. Avedesian to
pick up -.only a part of the rubbish in that it defines
what rubbish is. To hold him to the contract, in my
opinion, would create a condition where the citizens
of the City would be compelled to haul away a big part
of their rubbish or the City would have to have another
contract to take care of that rubbish which is not
embraced within the contract with Mr. Avedesian or do
£he work itself. That would create great confusion
not only for the City but for its citizens, and probably
it would be just as expensive to the City as it would
be for the City to take all of the rubbish away or
possibly leave it to another bid."
Supt, of Public Works submitted a letter requesting
permission to hire three temporary employees at $1.50
per hour, for a period not to exceed 90 days.
Moved by Councilman Fawcett, seconded by Councilman
Romero and unanimously carried, that the recommendation
of the Supt. of Public Works be accepted, and permission
be granted to employ three temporary employees at $1.50
per hour for a period not to exceed 90 days, and the
Supt, of Public Works to furnish these names at the next
meeting.
Mayor Memmesheimer asked Supt, of Public Works to give
these names to the City Attorney in order that he might
have the resolution prepared for the next meeting.
The State Employees Retirement System submitted a new
contract for making an Actuary Survey which would
determine the additional amount that would be contributed
by the employees and the City, if the proposed amendments
to the original retirement contract were adopted. The
contract price for the survey is set at $385.00.
Moved by Councilman Johnson, seconded by Councilman
-• Fawcett and unanimously carried that this matter be
referred to the City Attorney for his report back to
Council.

Letter was submitted from California State Polytechnic
College requesting permission to hold their annual
Christmas Dance at the Azusa Women's Club on Dec. 14th.
It was brought out in discussion that although the
dance would be properly chaproned, it would be well
to handle this through the Police Department.
Moved by Councilman Fawcett, seconded by Councilman
Romero, and unanimously carried that this matter be
referred to the Police Department.
Request was received from the First Presbyterian
Church of Azusa for the use of City equipment to erect
light poles for recreation purposes at their church
parking lot. They are willing to dig the holes and
pay for the services rendered by the city in erecting
these poles.
Moved by Councilman Fawcett, seconded by Councilman
Ortuno and unanimously carried, that this request be
granted and the Supt, of Lights be authorized to set
the poles, the church to pay for the labor and the
City to donate the use of the equipment.

A letter requesting permission to use the Easterly portion
of the Civic Center lawn as the site for a Nativity scene
was submitted from the Recreation Department. The letter
also listed the work to be done by the various churches,
City Departments and Civic Groups.
Moved by Councilman Fawcett, seconded by Councilman
Ortuno and unanimously carried that permission be granted
to use the Easterly portion of the Civic Center lawn as
a site for a Nativity scene, and City Departments to
cooperate.
Engineer Williamson stated he had a letter from the State
Highway Engineer stating that Azusa and a couple of the
other cities were the only ones who hadn't cooperated with
them in the matter of Christmas decorations being strung
across the streets. Further discussion was held regard-
ing Jones Company and the damage which was done to the
tree by their decorators.
Moved by Councilman Ortuno, seconded by Councilman Romero,
and unanimously carried that the City Attorney check
with the Chamber of Commerce to find out whether Jones
Company is giving the City the proper Public Liability
and Property Damage protection the City should have.
Letter was submitted to Council from Pacific Bible College
requesting permission to hold street meetings each
Saturday evening before 7:30 P.M. at which time their
Rally starts in the Civic Auditorium.
San Esterbloom, Student Chairman of the Project Committee
appeared before Council to further explain this request.
It is their intention to have a small group on the
street to do some singing and to give a short message
to induce the youth of Azusa to attend their Rally at
the -Auditorium.
Moved by Councilman Romero, seconded by Councilman Ortuno
that this matter be referred to the Police Department
with -power to act. Motion carried unanimously.

permission to land Santa Clause, via helicopter, in the be landed at Owl
parking lot adjacent to the Owl Drug Store at 601 East Drug Store by
Foothill Blvd. on December 11, 1954, as a publicity stunt helicopter -
sponsored by the Owl Drug. Dec. 11, 1954.
Moved by Councilman Fawcett, seconded by Councilman
Romero and duly carried, that this matter be referred to
the'Police Department with provision to be made for bond
to protect the City from any accident or such caused
by this event.
Letter was submitted from the Bureau of the Census
Bureau of Census
announcing the official population of the City of Azusa
Official Report
to be 15,087 as of October 29, 1954. There were 4170
on population of
occupied dwelling units as of the census day.

Moved by Councilman Ortuno, seconded by Councilman
Fawcett and unanimously carried that the official report
of the Census Bureau on the population of the City of
Azusa be filed.
The Park and Recreation Commission submitted a letter to
Monrovia May -
Council recommending their approval for permission for
flowers --
the Monrovia Mayflowers to collect voluntary funds and
permission to
sell -refreshments at the Baseball Diamond on Sunday
use ballfield -
afternoons. It was brought out in discussion that the
tabled.
Recreation Department did not use:the ball field on
Sunday afternoons, but due to the change in Recreation
Directors, it might be well to inquire if the new
Director -would have any future plans for the use of this
baseball field on Sunday.

Moved by Councilman Ortuno, seconded by Councilman Romero
that this matter be tabled to investigate if there will
be any change in the policy concerning Sunday recreation
activities, and to be referred back to the Park and
Recreation Commission for their meeting of November 23rd,
Motion carried unanimously.
Letter was submitted from the Citrus Union High School
District requesting that the:City of Azusa take the
appropriate legal steps to annex the proposed Azusa
High School site into the City of Azusa. Mayor Memme-
sheimer announced that a letter was also received from
the Elementary School District asking that the sites
of,proposed elementary schools be annexed into the City
of Azusa also.
Moved by Councilman Johnson, seconded by Councilman
Ortuno, and unanimously carried, that the City Engineer
and City Attorney proceed with necessary steps of
annexation to include both the High School site and
the elementary school sites, and take in as much other
property as possible.
The City Clerk was instructed to advise the Citrus Union
High School District and the Elementary School District
of the action taken by the City Council.
Supt, of Light and Water Department submitted request
for permission for Mrs. Maybelle A. Porter and Russell F.
Benshoff, employees of the Light and Water Department to
accumulate their vacations until the summer months.
Moved by Councilman Ortuno, seconded by Councilman
Johnson, and duly carried that the request of thelSupt.

to accumulate their vacations until the summer months.
Mayor Memmesheimer read a letter received from the
United States National Commission for UNESCO concerning
announcement of Human Rights Day, December 10th, and
Human Rights Weeks, December 10 - 15th.
Moved by Councilman Fawcett, seconded by Councilman
Romero and duly carried, that the letter announcing
Human Rights Day, Dec. 10th be filed.
The City Engineer submitted for Council's approval
two sketches showing provisions to be made for the Chief
Accounting Officer's office space. Alternate #2 pro-
vided for space in -the City Clerk's Office, Alternate
#1 provided space in the Office of the Water and Light
Department. Mayor Memmesheimer stated it was his opinion
that the place for the new Chief Accounting Officer was
in the office of the City Clerk, as according to the
interpretation of the State Law by the City Attorney,
the City Clerk is the accounting officer and would have
Jurisdiction over the new officer.
Mr. A. Rulofson, City Auditor, spoke to Council, stating
he too was of the opinion that the new officer should be
located in the=City Clerk's office. He stated that to
begin with, the new officer would probably want to first
review -the records the city maintains, spend several
days reading the Minutes of the last couple of years,
spend time getting acquainted with the city employees
and,the city accounting system. All this would take
probably a year or longer before he would be able to
come up with recommendations of changes in the system.
He stated he would be very happy to meet with Mr. Scott
and give him all the assistance he %)ossibly could to
acquaint him with the present accounting system.

Councilmen Johnson and Fawcett were of the opinion the
Chief Accounting Officer should have his office in the
Department of Light and Water office.
Moved by Councilman Ortuno, seconded by Councilman
Romero that Alternate #2 be accepted as site for the
Chief Accounting Officer's Office.
Motion passed and adopted by the following vote:
AYES: Councilmen: Ortuno, Romero, Memmesheimer
NOES: Councilmen: Fawcett, Johnson
ABSENT: None
Moved by Councilman Johnson, seconded by Councilman
Ortuno and carried unanimously, that the City Engineer
be instructed to proceed with the necessary work and
also obtain the necessary equipment for the office of
the Chief Accounting Officer.

Mayor Memmesheimer asked for cooperation from all Depart-
ments and employees who will in any way be connected with
the work of the new Chief Accounting Officer.
Mayor Memmesheimer stated that he has had a discussion
with Chief of Police Kendrick regarding the use of his
personal car for police work. It was his opinion this
should be considered an emergency vehicle and that the
same arrangement should be made for him as was made for
the Fire Chief, that is, to allow himl$60.00 per month
for the use of his car.

Moved by Councilman Fawcett, seconded by Councilman Ortuno
and duly carried that the City Attorney be authorized
to draw up Resolution similar to the one for the Fire
Chief concerning reimbursement for the use of his car.
Mayor Memmesheimer announced that a Safe Driver's Day

of.all States to have all Mayors of Cities and Boards of
December 15,1954
Supervisors appoint a man to give the necessary publicity
to -the Safe Drivers' Day - December 15th. The object is
to -try and have a 24 hour period that would be free of
fatal accidents, and free of accidents in general, if
possible. The general idea is to extend the same thing
over the year, but this is probably impossible in his
opinion, but'the effort is worthwhile.
The Mayor announced that Sedley Peck has been appointed
for this particular day.
It was announced by the Mayor that with the coming holiday
season and in connection with the general safety program

The Mayor would like to have 5500 of these printed and
mailed. The total cost of the proposed letter would be
$225.50 less $10.00 or $215.50. Just the folded letter
message would run about $178.00. City Attorney suggested
adding,"May the same spirit of care and consideration
prevail throughout the year" to the proposed letter.
Moved by Councilman Ortuno, seconded by Councilman Fawcett,
and unanimously carried, that this recommendation be
accepted on condition that the cost be kept down to $250.
The City Attorney reported that Gilfillan Brothers were Change in lease
