HomeMy WebLinkAboutOrdinance No. 2404 ORDINANCE NO. 2404 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING A ZONE CHANGE FROM C3 (GENERAL COMMERCIAL) TO R3a (MULTI-FAMILY RESIDENTIAL) FOR THE PROPERTY LOCATED AT 1901 NORTH SAN GABRIEL CANYON ROAD ( ZONE CHANGE CASE NO. Z-89-2) THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of Azusa does hereby find, determine and declare that : A. The applicant, D&D Development Company/Johnny E. Johnson/Speckert Family Trust has applied to the City for a change of zone of the subject property from C3 (General Commercial) to R3a (Multi-Family Residential) . The subject property is generally described as 1901 North San Gabriel Canyon Road and legally described as : Those Portions of Lots 61, 62, 74 and 75 of Subdivision #2 of Azusa Land and Water Company, in the City of Azusa, County of Los Angeles, State of California, as per Map recorded in Book 43, Pg. 94 of Miscellaneous records in the Office of the County Recorder of said County and as shown on a Map on file with the Planning Commission. B. The change and amendment to the Zoning Ordinance set forth below for the subject property was duly initiated, and notice of public hearings thereon were duly given and published in accordance with applicable law. C. Public hearings on the Zone Change were duly held by the Planning Commission of the City of Azusa on April 26, 1989, and by the City Council of the City of Azusa on June 19, 1989. D. On April 26 , 1989, the Planning Commission by Resolution No. 89-30 recommended to the City Council that the zone change classification proposed for the subject property be approved. SECTION 2. Having considered all the written and oral information presented to it at the public hearing of June 19, 1989, the City Council finds that: A. The subject property consists of two parcels containing a total of 8.96 acres of land along San Gabriel Canyon Road. A fraternal lodge (Moose Lodge) is located on the southern parcel while the northern parcel is vacant . A 57-unit detached condominium project is proposed for the site. The Planning Commission has approved Conditional Use Permit No. C-89-6 and Precise Plan of Design No. P-89-49 in conjunction with this project. B. The public necessity, convenience, general welfare and good zoning practice require that the zone text amendment and zone change set forth in this Ordinance be made. The proposed residential use is compatible with the surrounding land uses. The moderate density of the project would insure that the area is not overdeveloped or create unnecessary impacts on the vicinity. The project will also create additional single-family residences, which helps fulfill a need for this type of housing in Azusa. C. The granting of the zone change set forth in this Ordinance is consistent with surrounding land uses and zoning patterns in the area. D. In taking this action, the City Council considered the effects of the decision on the housing needs of the region in which the City is located and balanced these needs against the public service needs of the City residents and available fiscal and environmental resources . SECTION 3 . The City Council of the City of Azusa does hereby approve the change of zone classification and the amendment of the Azusa Municipal Code and the Official Zoning Map referred to therein so as to change the subject property from C3 (General Commercial) to R3a (Multi-Family Residential) . SECTION 4. Upon the effective date of this Ordinance, the Director of Community Development shall revise the Official Zoning Map of the City of Azusa to reflect the change in zoning of the subject property. SECTION 5. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law. PASSED AND APPROVED this 7th day of August 1989 .
