HomeMy WebLinkAboutOrdinance No. 2403 ORDINANCE NO. 2403 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING A ZONE CHANGE FROM R3a (MULTI-FAMILY RESIDENTIAL) TO C2 (RESTRICTED COMMERCIAL) FOR THE PROPERTY LOCATED AT 1171 WEST ARROW HIGHWAY (CASE NO. Z-89-1) THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN AS FOLLOWS: Section 1. The City Council of the City of Azusa does hereby find, determine and declare that : A. An application was duly filed with the Planning Commission by A.M.C. Clinical Laboratory, Inc. requesting a zone change from R3a (Multi- Family Residential) to C2 (Restricted Commercial) for the property located at 1171 West Arrow Highway ( "Subject Property" ) . B. On April 12, 1989 , the Planning Commission held a duly noticed public hearing on said application, at which time the Planning Commission recommended to the City Council by Resolution No. 89-26 that the zone change classification for the Subject Property be approved. Section 2 . After due notice and public hearing held by the City Council on June 19 , 1989, and in consideration of all the oral and written evidence presented at said public hearing, the City Council finds that: A. The Subject Property is generally described as 1171 West Arrow Highway within the City of Azusa and legally described as: A portion of Section 3, T1S RlOW, and as shown on a map on file with the Planning Commission. The Subject Property is currently vacant and covers 8, 250 square feet in area. The applicants propose to construct a medical laboratory building on the site. By Resolution Nos. 89-27 and 89-28 the Planning Commission approved Precise Plan of Design No. P-89-44 and Variance No. V-89-8 for the construction of this laboratory building with minor reductions in side and rear landscaped setbacks . B. The public necessity, convenience, general welfare and good zoning practice require that the zone change from R3a to C2 for the Subject Property be made. Although commercial development in the area is located only to the west of the Subject Property, residential construction on the Subject Property would be inappropriate. A small multi-family residential building on the site would expose its residents to very busy traffic patterns on Arrow Highway. The proposed medical building, on the other hand, is consistent with the small office building located to the west and other commercial activities west of the Subject Property. C. The granting of the zone change set forth in this Ordinance is consistent with surrounding land uses and zoning patterns in the area, and provides consistency with the long term land use goals of the Azusa General Plan. The zone change would be most appropriate for this site and is consistent with the principles of providing for orderly development contained in the Land Use Element of the General Plan. D. In taking the action set forth in this Ordinance, the City Council considered the effects of the decision on the housing needs of the region in which the City is located and balanced these needs against the public service needs of the City residents and available fiscal and environmental resources. E. All medical-related uses on the Subject Property must provide and maintain garbage bins that are locked at all times. Section 3 . The City Council of the City of Azusa does hereby approve the change of zone classification and the amendment of the Azusa Municipal Code and the Official Zoning Map referred to therein, so as to change from R3a to C2, the Subject Property at 1171 West Arrow Highway. Section 4. Upon the effective date of this Ordinance, the Director of Community Development shall revise the Official Zoning Map of the City of Azusa to reflect the changes in zoning of the Subject Property. Section 5. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law. PASSED AND APPROVED this 7th day of August 1989 .
