HomeMy WebLinkAboutOrdinance No. 2426 ORDINANCE NO. 2426 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA ADDING SECTIONS 19 . 17 . 010, through 19 . 17 . 080 OF THE AZUSA MUNICIPAL CODE RELATING TO MULTIPLE FAMILY RESIDENTIAL OVERLAY ZONE THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN AS FOLLOWS: SECTION 1 . The City Council of the City of Azusa does hereby find, determine and declare as follows: A. The change in amendment to the Zoning Ordinance set forth below was duly initiated, and notices of public hearings thereon were duly given and published in accordance with applicable law. B. Public hearings were duly held by the Planning Commission of the City of Azusa on January 25, 1989 , February 22, 1989 , August 30, 1989 , and continued until September 27 , 1989 , and by the City Council of the City of Azusa on April 17 , and May 22, 1989 and continued until November 6, 1989 . C. On February 22, 1989, the Planning Commission of the City of Azusa by Resolution No. 89-7 recommended to the City Council that a change in the zoning ordinance be adopted. On September 27 , 1989 , after additional study and hearings. The Planning Commission recommended by Resolution 89-79 that Resolution 87-7 be revised as set forth below. D. The City Council has considered all of the information presented to it at the public hearings held on April 17 , May 22, 1989 , and November 6, 1989 , and finds , determines and declares that the public necessity, convenience, general welfare and good zoning practice require that the zone text amendment set forth in this ordinance be made. E. The City of Azusa has officially adopted a General Plan. The City Council finds, determines and declares that the zone text amendment set forth below is consistent with the objectives, policies and programs specified in the General Plan of the City of Azusa and the elements thereof . F. In taking this action the City Council considered the effects of the decision on the housing needs of the region in which the City is located and balanced those needs against the public service needs of the City residents and available fiscal and environmental resources. SECTION 2 . Sections 19 . 17 . 010 through 19 .17 . 070 of the Azusa Municipal Code are hereby added to read as follows : elh/ORD0608 11/20/89A -1- 19 .17 . 010 PURPOSE. The purpose of the Multiple Family Residential Overlay Zone is to promote higher quality multi-family development and improve the living environment and aesthetics of neighborhoods, by imposing more stringent standards on small R-3 zoned properties . 19 .17 . 020 OVERLAY ZONE ESTABLISHED. The R3-0, Multiple Family Residential Overlay Zone is hereby established. This zone shall be imposed over any R-3 zoned property the City Council deems appropriate, in accordance with Chapter 19 . 64 . Properties so zoned, shall be subject to all standards of the overlay zone and the underlying zone. Where in conflict, the overlay zone shall take precedence. 19 .17 . 30 DENSITY. A maximum of three ( 3) dwelling units shall be allowed on any single parcel. 19 . 17 . 040 YARD REQUIREMENTS. There shall be established and maintained: (1) A rear yard of not less than fifteen feet, except for detached accessory buildings, which may have a setback of not less than five feet. ( 2) A rear yard of not less than twenty feet for all garages which have access to the rear of the parcel from an alley. 19 . 17 . 050 USEABLE OPEN SPACE. For each dwelling unit on a lot, at least five hundred feet of useable open space, as defined by Section 19 . 16. 090 , shall be provided and thereafter maintained on the same lot . All areas not covered by structures or pavement shall be landscaped and at least fifteen percent of the lot area shall be properly landscaped for outdoor recreational use. All other requirements of Section 19 . 16. 090 shall be met . 19 . 17 . 060 ALLEY IMPROVEMENT. On all lots which have a public alley in the rear, the following improvements shall be made to private property: (1 ) At least fifty ( 50) % ) percent of the paved area of all driveways providing access from alleys shall be paved with stamped concrete paving to contrast the remainder of driveways . All driveway and parking areas shall be paved with concrete. No less than twenty-five ( 25%) percent of all rear yard setbacks shall be fully landscaped without requiring landscaping dividing driveway areas under a landscaping plan to be approved by the Public Works Director. ( 2) All buildings facing the alley shall be equipped with exterior lighting to provide illumination of rear access areas elh/ORD0608 11/20/89A -2- and adjoining alleys . Said lighting shall be aimed or shielded to prevent unwanted light or glare from affecting nearby residences and shall be actuated by a photocell . 19 .17 . 070 GARAGES. No more than one two-car garage shall directly face the primary frontage on a public street. "19.17 . 080 EXISTING MULTIPLE FAMILY BUILDINGS. Multiple Family buildings which were in existence on the date of the establishment of this R3-0 zone which were non-conforming residential uses or which became nonconforming as a result of its adoption may remain as permitted uses after the date of the establishment of the R3-0 zone by approval of a conditional use permit issued under the provisions of Chapter 19 . 60 . Said use permit may be issued only: (a) To multiple family structures located on San Gabriel Avenue between Second Street and Sierra Madre Avenue; and (b) If the Planning Commission determines that the apartment building has been maintained in good physical condition consistent with appropriate standards of health and safety; and (c) If the Planning Commission finds that the permanent continued use of this building is necessary to provide necessary housing in Azusa and is in harmony with the surrounding neighborhood. Said use permit shall be peridocially reviewed by the Planning Commission to determine the compliance with these provisions and any other conditions of approval which may have been placed on the permit. Said review shall be established by the Planning Commission, but shall not be less frequent than once every five ( 5) years . " SECTION 3 . The City Clerk hall certify to the passage of this Ordinance and shall cause the same to be published in the manner required by law. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AZUSA that the Negative Declaration for the Project attached hereto as Exhibit "A" and by this reference, incorporated herein, is hereby certified and approved and determined that this Negative Declaration shall be filed with the County Clerk of the County of Los Angeles.
