HomeMy WebLinkAboutOrdinance No. 2429 ORDINANCE NO. 2429 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING ZONE CHANGES FOR PROPERTY GENERALLY LOCATED WITHIN THE AZUSA AVENUE AND SAN GABRIEL AVENUE CORRIDOR BETWEEN FIRST & SIERRA MADRE AVENUE (CASE NO. Z-88-6, SUBAREA 4) THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of Azusa does hereby find, determine and declare that: A. The City of Azusa duly filed with the Planning Commission a petition for change of zone requesting zone changes for the following properties within the Azusa Avenue and San Gabriel Avenue corridor ( "Subject Properties") to help alleviate existing piecemeal zoning patterns and create a more consistent and cohesive land use pattern. The zone changes are as follows: (1) The rear portion of parcels along Azusa Avenue and San Gabriel Avenue between Sixth Street and Foothill Boulevard which are now zoned P, along with the P zoned parcel on Azusa Avenue north of Foothill Boulevard, to CBD; (2) Both sides of San Gabriel Avenue from Second Street to Sixth Street from R3c, P, C2 and CBD to R3c, with an overlay zone of R3-0; (3) The CBD and P zoned parcels on the east side of Azusa Avenue from the railroad tracks to north of Ninth Street, on the west side of Azusa Avenue and the east side of San Gabriel Avenue from Foothill Boulevard to Ninth Street, from CBD and P to C2; (4) The parcels along Azusa Avenue and San Gabriel Avenue between Foothill Boulevard and Tenth Street which are now zoned R3c, with the exception of the condominium complex at the corner of Ninth Street and Azusa and San Gabriel Avenues, to add an overlay zone of R3-0; (5) The R3c parcels along Azusa Avenue between Tenth Street and Eleventh Street from R3c to R1c; (6) The R1 zoned parcels on San Gabriel Avenue between Twelfth Street and Sierra Madre Avenue from Rib and R3c to Ric; 1-11-90 (7) The C2 zoned parcel at the southeast corner of Azusa Avenue and Sierra Madre Avenue from C2 to Rib; (8) The FS zoned parcels north of First Street along Alameda Avenue, Dalton Avenue and Soldano Avenue, with the exception of the southern half of the west side of Alameda Avenue, from FS to R2; and (9) The FS zoned parcels north of First Street along San Gabriel Avenue and Angeleno Avenue, with the exception of the parcel at the southeast corner of San Gabriel Avenue and Second Street, from FS to R1c. B. On February 22, 1989, the Planning Commission held a duly noticed public hearing on said application, at which time the Planning Commission recommended to the City Council by Resolution No. 89-5 that the zone change classification proposed for the subject properties be approved. C. Subsequent to February 22, 1989, the City Council held several public hearings and referred a portion of the study back to the Planning Commission for further analysis. On September 27, 1989, after holding public hearings, the Planning Commission adopted its Resolution 89-70 recommending the following revisions to the original recommendations to deal with the high number of multi-family residences on San Gabriel Ave. between Second and Sixth Streets and to allow continued recognition of these buildings as an integral part of their surrounding neighborhood: D. The Council held a duly noticed public hearing on the matter, and including the Planning Commission's September 27, 1989 recommendation, on November 6, 1989. SECTION 2 . In consideration of all the oral and written evidence presented at said public hearings, the City Council finds that: A. The subject properties are located within the Azusa Avenue and San Gabriel Avenue corridor, and as further shown on a map on file with the Planning Commission (hereinafter "Subject Area") . The Subject Area is a mixed density residential and commercial area. B. Under City Council direction, a zoning study of the Subject Area was undertaken for purposes of examining whether the Subject Area could or should be rezoned. The zoning study revealed the following with respect to the Subject Area: (1) A additional specific plan should be developed for Azusa Avenue between Second Street and Foothill Boulevard to analyze the downtown area in detail. The specific plan -2- pmt/ORN50181 1-11-90 would set development standards, necessary improvements and land uses for this area, and would give the City an effective tool in the effort to revitalize downtown Azusa. (2) The Ri parcels on Azusa Avenue north of Twelfth Street were analyzed, and the current zoning recommended to remain after it became apparent that these parcels could not be split into two lots under their present zoning. (3) The viability of the few commercially zoned parcels on San Gabriel Avenue south of Fifth Street were reviewed, and the R3-0 zone was considered to be more compatible with the predominantly residential surroundings of the area. The R3-0 zone for other residential parcels on San Gabriel Avenue between Fifth and Sixth Street was also analyzed and confirmed. (4) The zone change and general plan amendment would be a closer match between the land uses and zoning in this area of Azusa. Existing piecemeal zoning patterns would be removed, creating a more easily identifiable and understandable zoning scheme. (5) The imposition of the R3-0 zone would create higher development standards for the small lot R3 parcels in the study area. (6) These zone changes will ultimately lead to better residential and commercial development along the Azusa Avenue and San Gabriel Avenue corridor. C. In taking this action, the City Council has considered the effects of the decision on the housing needs of the region in which the City is located and balanced those needs against the public service needs of the City residents and available fiscal and environmental resources. D. The change in the text of Title 19 proposed by this Ordinance is consistent with the general plan of the City of Azusa and the elements thereof. E. The public necessity, convenience, general welfare and good zoning practice require that the zone change set forth in this Ordinance be made. SECTION 3. The City Council of the City of Azusa does hereby approve the change of zone classification and the amendment of the Azusa Municipal Code and the Official Zoning Map referred to therein, as shown on Exhibit A attached hereto and incorporated herein by reference, so as to make the following changes in the Subject Area: -3- pmt/ORN50181 1-11-90 (1) [Intentionally Omitted] ; ( 2) [Intentionally Omitted] ; ( 3) [Intentionally Omitted] ; (4) Within Subarea 4, defined as the area on Azusa Avenue from Ninth Street to Twelfth Street and San Gabriel Avenue from the railroad tracks to Twelfth Street, the following changes are made: (a) The parcels along Azusa Avenue and San Gabriel Avenue between Foothill Boulevard and Eleventh Street which are now zoned R3c, with the exception of the condominium complex at the corner of Ninth Street and Azusa and San Gabriel Avenues, to add an overlay zone of R3-0; subject to adoption of Azusa Municipal Code Section 19. 17.080, which provides a conditional use permit process for both current nonconforming residential uses and uses made nonconforming by this zone change; (b) The CBD zoned parcel at the northeast corner of Azusa Avenue and Ninth Street shall be changed to C2; (c) The CBD zoned parcels on the east side of San Gabriel Avenue between the railroad tracks and Ninth Street shall be changed to C2; (5) [Intentionally Omitted] ; (6) [Intentionally Omitted] . SECTION 4. Upon the effective date of this Ordinance, the Director of Community Development shall revise the Official Zoning Map of the City of Azusa to reflect the change in the zoning of the Subject Area. SECTION 5. This ordinance is a re-enactment of Ordinance No. 2425 adopted on December 4, 1989 due to certain errors in the description of the properties which would be subject to the zone changes proposed. Accordingly, Ordinance No. 2425 is hereby repealed. SECTION 6. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law.
