AN URGENCY ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF AZUSA REPEALING AND
AMENDING SECTION 8.66.060 MUNICIPAL CODE
SECTION 8.66.040 RELATING TO CAMPAIGN
DISCLOSURE AND CONTRIBUTION LIMITATIONS
IN CITY ELECTIONS AND DECLARING THE
URGENCY THEREOF
WHEREAS, the City Council has adopted an ordinance
adding Chapter 8.66 to the Municipal Code enacting campaign
contribution limitations; and
WHEREAS, upon experience and consideration certain
changes and corrections are needed to meet the City
Council's intent in enacting such limitation; and
WHEREAS, this is an urgency ordinance needed for
the immediate preservation of the public health and safety
in that limitations on campaign spending are vital to all
citizens.
NOW, THEREFORE, the City Council of City of Azusa
does ordain as follows:
SECTION 1. Section 8.66.060 is amended to read as
follows:
Section 8.66.060 Cash Contributions. No
person shall make, and no candidate for
elective office, or campaign treasurer,
or committee controlled by a candidate,
shall solicit or accept any cash contri-
butions of $100.00 or more. Notwith-
standing the foregoing, a person may make
and a candidate for elective office, or
campaign treasurer, or committee
controlled by a candidate, may solicit or
accept (1) a cash contribution of $.01 to
$24.99 without providing a written
receipt; or (2) a cash contribution of
$25.00-$99.99 upon providing a written
receipt to the person.
SECTION 2. Urgency. This is an urgency ordinance
pursuant to Government Code Sections 36934 and 36937 whose
immediate enactment is necessary for the immediate
preservation of public peace, health, safety and general
welfare and shall be effective immediately. The facts
constituting the need for such urgency ordinance are that
the City has adopted a Campaign Contribution Ordinance which
is in effect for the municipal election to be held on the
second Tuesday in April. The current provisions relating to
small cash contributions have been found to be unduly
burdensome and unfair to candidates and citizens.
Therefore, it is necessary for this ordinance to become
effective immediately in order to meet the needs of the
citizens for the April, 1990 election.
SECTION 3. The City Clerk shall certify to the
passage of this ordinance and shall cause the same to be
published as required by law.
