JOHNSON, DIRECTOR OF FINANCE DATE: JANUARY 22, 2019 SUBJECT: ADOPTION OF UPDATED CITYWIDE SCHEDULE OF FEES AND CHARGES BACKGROUND: On January 19, 2016, the City Council adopted several resolutions approving certain adjustments to the City’s Schedule of Fees and Charges. In addition, the City Council authorized Staff to adjust the schedule of fees and charges annually based on the change in the Consumer Price Index (CPI) or 2%, whichever was greater. The Los Angeles Area CPI change from September 2017 through September 2018 was 3.9%. Consequently, Staff has adjusted the majority of fees by 3.9% consistent with previous instructions established by the City Council. These changes are ministerial in nature and no further action is required by the Council in order to complete these fee updates. As part of the fee update, Staff would like to make other modifications to the schedule of fees and charges that fall outside of the parameters of the previous direction provided by the City Council. The proposed action requests the City Council to adopt the fee modifications outlined in Attachment 4 which includes three tables: 1) New fees proposed; 2) Fees proposed to be modified by an amount other than the previously directed CPI adjustment; and 3) Fees proposed to be lowered from the current fee amounts. RECOMMENDATIONS: Staff recommends that the City Council take the following actions: 1)Receive, review, and file the updated Citywide Fee and Charges Schedule; and 2)Open the Public Hearing, receive public testimony, and close the Public Hearing; and 3)Adopt Resolution No. 2019-C01, regarding development project services fees, to be effective 60 days from January 22, 2019 (March 23, 2019); and 4)Adopt Resolution No. 2019-C02, regarding fees for various municipal activities and services, to be effective on January 22, 2019. APPROVED CITY COUNCIL 1/22/2019 Approved as amended Adoption of Citywide Fees and Charges January 22, 2019 Page 2 ANALYSIS: California Government Code 66000 allows public agencies to impose fees to recover the costs of providing various public services to the community. In an effort to keep current with the cost of providing services, the City Council authorized Staff to implement the recommendations and fee adjustment from the fee study on January 19, 2016. The City Council also directed Staff to annually adjust the City’s Schedule of Fees and Charges by the change in the Consumer Price Index - Los Angeles Area (CPI) with a minimum increase of 2% and a maximum increase of 5% for most fee categories. This provision allows City fees to keep pace with increased costs for services without having to conduct a complete study each year. The CPI change from September 2017 through September 2018 was 3.9%; consequently Staff has adjusted the majority of fees by 3.9%. There are several fees that fall outside the parameter of the previous direction provided by the City Council. Specifically, eleven (11) new fees are being proposed (Attachment 4, Table 1) to reflect new programs and/or to enhance the City’s ability to provide services. The new fees include: 1) General Plan Fees - 10% of permit and plan check fees – In order to maintain sustainable, long term development under the General Plan, the City must complete a number of on-going planning efforts to implement the plan. The fee is used to recoup the cost of the general plan from landowners and/or developers who benefitted greatly from the infrastructure planning and environmental analysis conducted as part of the update. 2) Damage to Water Main Impact Fee - S131G c) - $1,500 – To recoup initial cost for damage to water main such as inspection and engineering. In addition to any water loss and other impacts on the system prior to repairs. 3) Cost of Repair & Water Loss - S131G d) - Actual Costs – To recoup cost of damage to water main and associated repairs and water loss, which is usually charged to individual(s) causing the damage. 4) Damage to Water Facilities Impact Fee - S131G e) - $1,500 – To recoup initial cost for damage to facilities such as inspection and engineering. In addition to any water loss and other impacts on the system prior to repairs. 5) Cost of Repair & Water Loss - S131G f) - Actual Costs - To recoup cost of damage to water facilities and associated repairs and water loss, which is usually charged to individual(s) causing the damage. 6) Temporary Certificate of Occupancy (TCO) (60 days) - $450 – Provides contractor(s) and business owner(s) the ability to open a business prior to obtaining a Certificate of Occupancy provided; all City Dep artments have agreed the TCO may be issued. The 60 days will allow the developer additional time to ensure all department final comments have been addressed and within a timely manner. 7) Parking Lot Resurface Inspection - ($68 up to 10,000 square feet, $1 for each additional sq. ft.) – Varies. Inspections need to be performed in order to assure the lot conforms to the Adoption of Citywide Fees and Charges January 22, 2019 Page 3 parking requirements approved by the Planning Department, and that the slopes, drainage, and accessibility prescribed by the California Building Code are in place. 8) Event Permit (1 hr. minimum inspection time $93 plus plan check fee of $60.50) - rounded to $154 – To ensure conditions prescribe by the City Planning Department, Building & Safety Department, including the Health & Safety and Fire Department permit(s) are all in place and completed for any Special Event. Included inspections are; parking, electrical devices, portable toilets, ADA accessibility throughout, and other. 9) Audio/Video Custodial Services ($60 per Hour or Current Cost-After 4pm, Weekends) - $60/Hr. or Current Costs – Cost recovery of A/V and custodial services costs. 10) Personal Appearance - $275 – Allowable per Government Code Section 68096.1. 11) Production of Documents/Records - $15 – Allowable per Government Code Section 6253.9 (b). There are twenty seven (27) proposed fees that will increase more than the 3.9% CPI (Attachment 4, Table 2): 1) Water Meter Fee - S-131D c) (from $600 to $925) – The Cost of AMI smart meter is higher. 2) Water Meter Fee - S-131D b) (from $720 to $1,075) – The Cost of AMI smart meter is higher. 3) Water System Annexation Fees - S-131I a) (from $891 to $1000) – New accessory dwelling units (ADU) law will increase building and occupancy of AUDs, fee increase in anticipation of higher demand on engineers time. 4) Water System Annexation Fees - S-131I b) (from $0.40 to $0.45) – Commercial fees depends on the size of the project and is charged per sf, CPI does not apply. 5) Water System Annexation Fees - S-131I c) (from $0.17 to $0.25) – Industrial fees depends on the size of the project and is charged per sf, CPI does not apply. 6) Water System Annexation Fees - S-131I d) (from $3,454 to $3,600) – Increase in fee to recoup cost from Water master’s increase in admin cost from $50 to $70/Acre Foot. 7) Water System Annexation Fees - S-131I e) (from $1,581 to $1,650) – Increase in fee to recoup cost from Water master’s increase in admin cost from $50 to $70/Acre Foot. 8) Sign off Citations issued by External Agencies/Police Depts-S-070 b) (from $15 to $20) – CA Vehicle Code 40203.5. (a) The schedule of parking penalties for parking violations and late payment penalties shall be established by the governing body of the jurisdiction where the notice of violation is issued. To the extent possible, issuing agencies within the same county shall standardize parking penalties. 9) Improper Display of License Plates (CVC 5200 (a)) (from $48 to $58) – CA Vehicle Code 40203.5. (a) The schedule of parking penalties for parking violations and late payment penalties shall be established by the governing body of the jurisdiction where the notice of violation is issued. (a) The schedule of parking penalties for parking violations and late payment penalties shall be established by the governing body of the jurisdiction where the notice of violation is issued. To the extent possible, issuing agencies within the same county shall standardize parking penalties. 11) Blocking Driveway/Garage Entrance (CVC 22500 (e)) (from $48 to $58) – CA Vehicle Code 40203.5. (a) The schedule of parking penalties for parking violations and late payment penalties shall be established by the governing body of the jurisdiction where the notice of violation is issued. To the extent possible, issuing agencies within the same county shall standardize parking penalties. 12) No Parking on Sidewalk (CVC 22500 (f)) (from $50 to $58) – CA Vehicle Code 40203.5. (a) The schedule of parking penalties for parking violations and late payment penalties shall be established by the governing body of the jurisdiction where the notice of violation is issued. To the extent possible, issuing agencies within the same county shall standardize parking penalties. 13) No Parking alongside Parked Vehicle/Double Parking. (CVC 22500 (h)) (from $38 to $58) – CA Vehicle Code 40203.5 (a) The schedule of parking penalties for parking violations and late payment penalties shall be established by the governing body of the jurisdiction where the notice of violation is issued. To the extent possible, issuing agencies within the same county shall standardize parking penalties. 14) Fire Access way/Fire Lane (CVC 22500.1) (from $68 to $170) – CA Vehicle Code 40203.5. (a) The schedule of parking penalties for parking violations and late payment penalties shall be established by the governing body of the jurisdiction where the notice of violation is issued. To the extent possible, issuing agencies within the same county shall standardize parking penalties. 15) Parking 18 inches from curb/wrong way (CVC 22502 (a), AMC 74-441) (from $48 to $56) – CA Vehicle Code 40203.5. (a) The schedule of parking penalties for parking violations and late payment penalties shall be established by the governing body of the jurisdiction where the notice of violation is issued. To the extent possible, issuing agencies within the same county shall standardize parking penalties. 16) Parking in Disabled Zone (CVC 22507.8 (a)) (from $343 to $382) – CA Vehicle Code 40203.5. (a) The schedule of parking penalties for parking violations and late payment penalties shall be established by the governing body of the jurisdiction where the notice of violation is issued. To the extent possible, issuing agencies within the same county shall standardize parking penalties. 17) Fire Hydrant (CBC 22514) (from $48 to $56) – CA Vehicle Code 40203.5. (a) The schedule of parking penalties for parking violations and late payment penalties shall be established by the governing body of the jurisdiction where the notice of violation is issued. To the extent possible, issuing agencies within the same county shall standardize parking penalties. 18) Parking in excess of 72 hours (AMC 74-438 (a)) (from $38 to $45) – CA Vehicle Code Adoption of Citywide Fees and Charges January 22, 2019 Page 5 40203.5. To the extent possible, issuing agencies within the same county shall standardize parking penalties. 19) Parking for Purpose of Sale (AMC 74-439 (1)) (from $63 to $68) – CA Vehicle Code 40203.5. (a) The schedule of parking penalties for parking violations and late payment penalties shall be established by the governing body of the jurisdiction where the notice of violation is issued. To the extent possible, issuing agencies within the same county shall standardize parking penalties. 20) Not Parked within painted lines (AMC 74-443b) (from $28 to $44) – CA Vehicle Code 40203.5. (a) The schedule of parking penalties for parking violations and late payment penalties shall be established by the governing body of the jurisdiction where the notice of violation is issued. To the extent possible, issuing agencies within the same county shall standardize parking penalties. 21) 18" From Curb or Facing Wrong Way (AMC 74-441, CVC 22502 (a)) (from $51 to $56) – CA Vehicle Code 40203.5. (a) The schedule of parking penalties for parking violations and late payment penalties shall be established by the governing body of the jurisdiction where the notice of violation is issued. To the extent possible, issuing agencies within the same county shall standardize parking penalties. 22) Parking on Private Property without Consent (AMC 74-463 (b)) (from $38 to $52) – CA Vehicle Code 40203.5. (a) The schedule of parking penalties for parking violations and late payment penalties shall be established by the governing body of the jurisdiction where the notice of violation is issued. To the extent possible, issuing agencies within the same county shall standardize parking penalties. 23) Parking on Front Yard Prohibited (AMC 74-468) (from $38 to $49) – CA Vehicle Code 40203.5. (a) The schedule of parking penalties for parking violations and late payment penalties shall be established by the governing body of the jurisdiction where the notice of violation is issued. To the extent possible, issuing agencies within the same county shall standardize parking penalties. 24) Traffic Collision Report S-032.5 b) (from $12 to $20) – CA Vehicle Code 40203.5. (a) The schedule of parking penalties for parking violations and late payment penalties shall be established by the governing body of the jurisdiction where the notice of violation is issued. To the extent possible, issuing agencies within the same county shall standardize parking penalties. 25) Ball Field/Diamond Rental: S 41.1 a) Field/Diamond Rental No Lights (from $32 to $45) – Restructuring the park space for rent. Previous year's costs were not fully recovered. 26) Ball Field/Diamond Rental: S 41.1 b) Field/Diamond Rental with Lights (from $45 to $66) – Restructuring the park space for rent and to reflect the appropriate rate for higher utility cost. Previous year's costs were not fully recovered. 27) Gazebo At City Hall - S-48 (from $300 to $500) – Current market rate and to reflect the appropriate rate for higher staff costs. City of Azusa Schedule of Fees and Charges (Municipal Activities and Services) GIS MAPS 41 Attachment 2 RESOLUTION NO. 2019-C01 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, APPROVING AND ADOPTING A REVISED SCHEDULE FOR CERTAIN DEVELOPMENT PROJECT FEES AND SERVICE CHARGES WHEREAS, under the police power granted by Article XI, Section 7 of the California Constitution, the City of Azusa is authorized to impose fees, charges and rates for certain municipal services; and WHEREAS, in addition to the authority granted by the California Constitution, Chapter 8 (commencing with section 66016) of Division 1 of Title 7 of the California Government Code establishes a procedure for adopting fees or service charges for development projects; and WHEREAS, pursuant to Resolution No. 2016-C5, adopted on January 19, 2016, the City currently imposes development related fees upon applicants to recover the costs of staff time, inspection, copying costs and other expenses related to the review and processing of applications for property development; and WHEREAS, many of the City's current fees charged for development services no longer reflect the actual cost of providing such services; and WHEREAS, Government Code sections 66016 and 66018 provide that the City may adopt new development fees or increase existing fees after providing notice and holding a public hearing; and WHEREAS, notice of a public hearing on the establishment of new and revised fees was published in accordance with provisions of section 6062a of the California Government Code; and WHEREAS, notice of public hearing was mailed to all interested parties who filed a written request for a mailed notice with the City, or a waiver of notice was obtained; and WHEREAS, on January 22, 2019, at the time and place specified in the published and mailed notices, the City Council held a public hearing as required by law to allow oral or written presentations prior to levying new development fees or service charges and prior to approving an increase in existing development fees or service charges; and WHEREAS, at least ten (10) days prior to the commencement of the hearing, there was made available to the public a report containing the cost, or estimated cost, of providing the service for which the fee or service charge will be levied, and the revenue sources for providing such services; and WHEREAS, based upon evidence provided, the City Council hereby determines that Attachment 2 the development services fees set forth in the Schedule of Fees and Charges attached hereto and incorporated herein by reference will not exceed the estimated reasonable cost of providing the property development services for which the fee is charged; and WHEREAS, the proposed fees are statutorily and categorically exempt from the requirements of the California Environmental Quality Act since these fees fit within the statutory exemptions for local agency decisions involving the adoption and collection of rates, tolls and other charges, pursuant to Public Resources Code Section 21 080(b) (8) and Section 15273 of the California Environmental Quality Act Guidelines. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Azusa, California does hereby find, determine and declare as follows: SECTION 1. Adoption of Schedule of Fees. The City Council hereby approves and adopts the Schedule of Fees and Charges attached hereto as Exhibit "C" and incorporated herein by reference. The adopted fee schedule shall supersede any fees and charge schedule previously adopted. SECTION 2. Repeal of Prior Resolution. Resolution No. 2018-C08 is hereby repealed in its entirety. SECTION 3. Findings. The City Council finds that the fees and charges set forth in the Schedule attached as Exhibit "A": (1) have a reasonable relationship with the City's costs in providing those services; and (2) are necessary to enable the City to continue providing the services to which they relate. SECTION 4. Effective Date. This Resolution shall become effective sixty (60) days from its adoption.
