ROLL CALL: Councilmen: Fawcett, Ortuno, Johnson Roll Call Romero, Memmesheimer City Attorney, City Engineer City Clerk The Light & Water Department submitted a letter granting permission to Southern California Edison Company to serve electrical energy to property at 130 - 134 S. Motor Avenue, in accordance with the terms of the contract. Moved by Councilman Ortuno, seconded by Councilman Johnson and duly carried that the Mayor be authorized to sign the letter granting permission to the Edison Company to serve electrical energy at this address. The City Clerk stated that the advertisement for bids for sewer work for South Orange and Louise Avenues would not be in the coming edition of the newspaper. MoVed:by Councilman Ortuno, seconded by Councilman Romero and unanimously carried that the motion authorizing the City Clerk to advertise for bids for sewer work on South Orange and Louise Avenues, bids to be opened 12/20/54, be rescinded. City Clerk announced that the advertisement for bids for regulators for the Light Department, bids to be opened 12/20/54 would not be published this week. Moved by Councilman Johnson, seconded by Councilman Ortuno and unanimously carried that the Council rescind the motion -authorizing the Clerk to adver- tise for regulators, bids to be opened 12/20/54. Rescind authoriza- tion to advertise for bids for regulators (bids to be opened 12/20/54) Moved by Councilman Fawcett, seconded by Councilman Adv, for bids (to Ortuno and duly carried that the City Clerk be be opened 1/3/55) authorized to advertise for bids for regulators for for regulators lighting system on Foothill Blvd., bids to be open- ed January 3, 1955. The Chamber of Commerce submitted a request for an advance of $2,000 on their quarterly payment. This amount is needed to meet bills sustained for Christmas decorations. Moved by Councilman Romero, seconded by Councilman Ortuno and unanimously carried that the Chamber of Commerce be advanced,the amount of $2,000 on their quarterly allowance account. The Chamber of Commerce submitted various samples of rugs and draperies for the Auditorium, this matter having been referred to them at a previous meeting. Moved by Councilman Romero, seconded by Councilman Ortuno and unanimously carried that the inspection of samples be tabled at this part of the meeting. The Accounting Officer, Mr. Scott, suggested in a letter to Council, that books now in the possession of Rulofson containing City affairs, be returned to the City. Advance on quarterly allowance to Chamber of Commerce granted. Rugs and drapery samples for Auditorium. Moved by Councilman Johnson, seconded by Councilman Romero and duly carried that Mr. Scott be authorized to have the books now held by Mr. Rulofson returned to .the City. Mr. Scott also suggested that the City terminate the Termination of agreement with Mr. Rulofson upon -his closing entries agreement with of the Cities business for the month of November. Rulofson. Moved by Councilman Johnson, seconded by Councilman Ortuno and unanimously carried that the City terminate the agreement with Mr. Rulofson upon the closing entries for the month of November. Moved by Councilman Fawcett, seconded by Councilman Ortuho and unanimously carried that Mr. Scott be Rulofson to be authorized to employe Mr. Rulofson in any matters employed for three of assistance needed for a period of three months, months. Supt, of Public Works recommended that Gregory Gutierez be appointed as Assistant Custodian on the 3rd step of the salary range at $256 per month effective December 1, 1954. Gregory Gutierez - Moved�by.Councilman Romero, seconded by Councilman appointed Asst. Ortuno and unanimously carried .that the Council Custodian accept the recommendation of the Supt of Public Works and that Gregory Gutierez be appointed at 3rd step of the salary range for Assistant Custodian at $256.00 per month, effective December 1, 1954, and that City Attorney be instructed to draw Reso- lution accordingly. A letter was received from the Hadley -Cherry Corp. Letter from Hadley - stating that due to the inability of the City and Cherry Corp. Hadley -Cherry Corp, to get together on annexation regarding annexa - matters, they felt that for the present, there will tions. • be no further negotiations for annexation by them. Mayor Memmesheimer stated that the letter which was received.did not present the actual facts as they were, and he requested permission from the Council to answer the letter from the Hadley -Cherry people. Councilman Johnson made the following statement for the records: "I have been a member of the City Council of Azusa since October 6, 1953. My first knowledge of the proposed Hadley -Cherry development of part of the Foothill R nch, which is in county territory, was the newspaper publicity of November 1953. Since that time, and including tonight, no official or written communicaion concerning this development has EVER been presented to the City Council of Azusa. Late last summer, Mr. Frank Shipper, then secretary of the Azusa Chamber of Commerce, attended a Council meeting and demanded that the City approve annexation precisely as presented by Hadley -Cherry and without any change. He gave the Council thirty minutes to sign, or else "negotiations" would be terminated. The letter of December 2, 1954, again terminat- ing "negotiations", contains in its first paragraph all the reasons why Hadley -Cherry refused to annex their property to the City. These reasons still exist. It is my opinion that subdividers of property outside the City limits should FIRST contact the City so that the plan of development will at least conform to the minimum requirements of the laws of the City of Azusa. This early cooperation is the rule in nearly all other cities. C4 , CITY HALL AZUSA, CALIFORNIA DECEMBER 8, 1954 7:30 P.M. The simple presentation of a completed plan on a take-it'or leave -it basis does not constitute "negotia- tions",'and allegations of 'Insincerity or bad faith on the part of the City of .Azusa are totally unwarranted." Moved by Councilman Ortuno, seconded by Councilman Fawcett, and unanimously carried that the Mayor be authorized, "in conjunction with the City Engineer and the City Attorney, to answer the letter of the Hadley - Cherry Corp, dated December 2, 1954, and that carbon copies be forwarded to Council members prior to mail- ing of same. Discussion of the zoning Ordinance restricting lot sizes tc 7,000 square feet in the City of Azusa was held. The City Council was of the opinion that for the best interests of all, it would be permissible for territory to the East to construct a sewer line on Mason Street to connect with the Sanitation District's trunk line on Pasadena Avenue. Moved by Councilman Romero, seconded by Councilman Ortuno that an:agreement be made with the Sanitation District, or whomever necessary, to hook into the sewer line on Pasadena Avenue with the line con- structed on Mason Street. This motion passed by the following vote: 223 Sewer line on Mason Street to connect with Sanitation District's trunk line on Pasadena. AYES: Councilmen: Fawcett, Ortuno, Romero, Memmesheimer NOES: Councilmen: None ABSENT: Councilemen: None Councilman Fawcett stated that he had attended the Industrial Planning Association Meeting (East San Gabriel and Pomona Valley) in Los Angeles today, at which meeting it was estimated that the Ban Gabriel Valley will in a few years be made up of a population of about one million. At the present time there are about 8,000 acres for industrial purposes in the area, of which Azusa has probably about one-third of the total. A Bulletin was received from the National Safety Council setting forth safety rules for safe driving for Christmas time. A report was received from the State Highway Dept. stating the estimated gas tax revenues for this City based on the special census recently held would be $40,320.00 The Council of Industrial Development Conference is to -be held December 15th at the Statler Hotel. Warren Teasley of the Planning Cdmmission will attend. Mrs. Eleanor Warren of Sunset Avenue sent a letter to the City Council requesting that a policeman be on duty at the corner of Foothill and Azusa Avenue to assist elderly persons. It was recommended by the City Clerk that Dorothy Moskus, Steno -Clerk be placed on probationary period on the 1st step of salary range of Steno -Clerk, $271.00 per month, effective December 13, 1954. Moved by Councilman Fawcett, seconded by Councilman Johnson and unanimously carried that the Council accept the recommendation of the City Clerk and that the City Attorney be instructed to draw a Resolution placing Dorothy Moskus on 1st step of Steno -Clerk, effective December 13, 1954. Report on meeting of Industrial Planning Assoc. E. San Gabriel &'Pomona Valley National Safety Council. Estimated gas tax revenues. Industrial Develop- ment Conference. Request for a policeman at Foot- hill and Azusa. Dorothy Moskus probationary step - Steno -Clerk. 224 CITY HALL AZUSA, CALIFORNIA WEDNESDAY, DECEMBER 8, 1954 City Clerk requested that Mrs. Joan McKinney, Steno - Clerk in the office of the City Clerk be allowed one week's salary in lieu of vacation which she has been unable to take due to press of business. It was brought out in discussion that this was not the policy the Council would like to see carried on. Moved by Councilman Johnson, seconded by Councilman Fawcett and unanimously carried that this -request for salary in lieu of vacation be denied, and that all future. --requests for salary in lieu of vacations be denied. The Chief of Police recommended that the City purchase a uniform for Mrs. Hunter who is encployed in the Police Department and handles all cases involving females. Moved by Councilman Ortuno, seconded by Councilman Romero and unanimously carried that the City supply a complete uniform, consisting of a skirt, jacket, hat and hat piece for Mrs. Hunter, Police Matron, and that the City Attorney be instructed to draw Resolution accordingly. City Clerk submitted a request for permission to buy an A. B. Dick Mimeograph machine at an estimated cost of $710.00. Moved -by Councilman Romero, seconded by Councilman Johnson that the City Clerk be authorized to purchase an A. B. Dick Mimeograph, Model #437. This motion was unanimously carried. Statements submitted against the Light Fund by Ralph Brooks for _payment of work connected with obtain- ing easements at Lee School, Wheelcraft Corp., in the amount of $10.00, dated February 1, 1954; and a statement against the Water Fund for map and descrip- tion and sketch and description in the amount of $37.50 dated•Febr-nary 1, 1954; and statement against the Light Fund dated March 1, 1954, for legal description - Lee'School and pole line easement - in the amount of $42.50, were submitted to Council for payment. These statements;had previously been before Council but no definite action had ever been taken. It was the opinion of Councilman Johnson that Ralph Brooks had been overpaid on the percentage fee on the-- contract he-contract price of the tennis court project, as the project as completed was about $3,000 less than the original contract price. City Clerk was instructed to -check the payments made to Brooks on the tennis court deal and to further check the statements as submitted. 225 7:30 P.M. Request for salary in lieu of vacation denied. Uniform for Police Matron approved. Purchase of Mimeo- graph approved. Statements sub- mitted by Ralph Brooks to be checked further. City Attorney stated that he had looked over the contract with'the State Retirement System for the Actuary Survey which had been requested by the City for the possible amendment of the State Retirement System contract. State Retirement Moved _by Councilman Ortuno, seconded by Councilman System - Actuary Romero that the City proceed with having the Actuary Survey Survey made, and that the Mayor be authorized to sign the,contract with the State Retirement System in the amount of $308.00. Motion carried by the following vote: AYES: Councilman: Ortuno, Johnson, Romero, Memmesheimer NOES: Councilman: Fawcett ABSENT: None 0 C4 u CITY HALL AZUSA, CALIFORNIA DECEMBER 8, 1954 It.wad,brought to the attention of the Council that the dance permit requested by Battery B of the State National Guard was to be held in conjunction with the Cruiser's Club. Moved•by Councilman Johnson, seconded by Councilman Fawcett and duly carried that the Council rescind the previous motion regarding granting of a dance permit to Battery B for New Year's Eve. Councilman Ortuno abstained from voting. Moved'by Councilman Ortuno, seconded by Councilman Romero and unanimously carried that the Council grant permission to Battery B and the Cruiser's Club.to hold a New Year's Eve Dance, with restrictions as specified by the Police Department. A letter of resignation from Gilbert Trujillo as Reserve Policeman was received. Moved -by -Councilman Fawcett, seconded by Councilman Ortuno and unanimously carried that City Council accept the resignation of Gilbert Trujillo, Reserve Policeman, effective December 13, 1954, and the City, Attorney be instructed to draw a Resolution accordingly. Moved by Councilman Johnson, seconded by Councilman Ortuno, and unanimously carried that the following bills -and requisitions be paid. Councilman Ortuno stated that in his opinion the City should amend the Ordinance to allow 6,000 square foot lots in'the City of Azusa. _Moved by Councilman Ortuno, seconded by Councilman Romero that the City Attorney be instructed to prepare an Ordinance amending Ordinance No. 409 as amended, and the square footage of lot size be reduced to a 6,000'square foot minimum. The motion passed by the following vote; AYES: Councilmen: Ortuno, Romero, Memmesheimer NOES: Councilmen: Fawcett, Johnson ABSENT: None Moved by Councilman Ortuno, seconded by Councilman Adjournment Johnson and unanimously carried that the meeting adjourn.
