ORDINANCE NO. 2448
AN URGENCY ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF AZUSA AMENDING SECTION 8 . 36 . 020
RELATING TO THE DISCHARGE OF FIREWORKS WITHIN
CERTAIN AREAS OF THE CITY
THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN
AS FOLLOWS: .
SECTION 1. Section 8..36.020 of the Azusa Municipal
Code is hereby amended to read as follows:
"8. 36.020 Permitted Discharge of Safe and Sane
Fireworks
A. Annually on July-1, 2, 3 and 4 and on July 5
if that day is a legal holiday, safe and sane
fireworks may be discharged in any area within the
City zoned Single Family Residential (R-la, R-lb,
R-lc or R-ld) , Residential,,.Hills'ide Area
(R-i-h-10,000, R-i-h-20,000) , Residential
Agricultural (R-a) , Two Family Residential (R-2) ,
Multi-family Residential (R-3a, R-3b, R-3c) , Garden
Apartment Residential, (R-G-A) (as set forth on the
Official City Zoning Map described in Section
19.06.040) and within City parks, except as
provided in this chapter., Safe and sane fireworks
shall not be discharged at any other time nor in
any zone other than provided in this. section.
Regardless of the zone in which a `fireworks stand
is located, safe and sane fireworks shall not be
discharged within 100 yards of any such stand.
B. 'As used in this chapter, "safe and sane
fireworks" includes only those fireworks that have
been classified and registered as "safe and sane"
by the State Fireworks Law and the State Fire
Marshal. " '
SECTION 2 . Section 8.36.070(14) is hereby added
to the Azusa Municipal Code to read as follows:
"(14) With each sale of fireworks, the person
selling the fireworks shall personally hand to the
customer a warning sheet describing the provisions
of this chapter regarding the dates and locations
within the City of Azusa. where fireworks .inay be
discharged. The warning sheet shall be prepared by
the Chief of Police and shall describe the
provisions of this chapter and shall include a map
showing the various tones within the City where
fireworks may be discharged. The Chief of Police
shall distribute t9 each permittee on or before
June 15 of each year the warning sheet to be used
by the fireworks stands. Each permittee operating '
a stand shall be responsible for reproducing the.
warning sheet and distributing it to each customer
of the stand. It shall be unlawful for the
permittee of any stand or any person working at the
spe
stand to sell fireworks to any person without
personally distributing the warning sheet to each
customer. The failure of any person purchasing
fireworks to receive the warning sheet shall not
excuse their failure to comply with the provisions
of this chapter relating to the discharge of safe
and sane fireworks. "
SECTION 3 . In adopting this Ordinance, the City
Council of the City of Azusa does hereby find, determine and
declare that:
A. Over the last few years the City has
experienced a tremendous problem with the discharge
of fireworks in commercial and other nonresidential
zones within the City. The City has also
experienced tremendous problems with the discharge
of fireworks near fireworks stands.
B. The discharge of fireworks in commercial and
nonresidential zones and nearby to fireworks stands
is extremely dangerous. Commercial and
nonresidential zones are generally not well
populated during the Fourth of July holiday and,
therefore, the risk of an accidental fire going
unnoticed and becoming a major conflagration is
greatly increased. Additionally, the discharge of
fireworks near fireworks stands, particularly in
commercial shopping centers, has become
increasingly common and increasingly dangerous.
During the Fourth of July holiday period,
particularly on the Fourth of July, people tend to
congregate around the fireworks stands and if
fireworks are discharged in these locations, the
risk of physical harm to persons in the area is
greatly increased.
C. The provisions of this Ordinance are,
therefore, necessary to protect the health and
safety of the persons within the City of Azusa.
