HomeMy WebLinkAboutOrdinance No. 2088 1 ORDINANCE NO. 2088 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA DECLARING A MORATORIUM ON THE ISSUANCE OF ANY BUILDING PERMIT FOR OR THE ESTABLISHMENT OF ANY USE WITHIN THE MEANING OF THE TERM "ADULT BUSINESS" PENDING THE ESTABLISHMENT OF ZONING REGULATIONS FOR SUCH USE BY THE CITY SAID ORDINANCE TO BE ADOPTED AS AN URGENCY ORDINANCE PURSUANT TO SECTION 65858 OF THE GOVERNMENT CODE. WHEREAS, certain businesses hereinafter defined as "Adult Businesses" are proposed for location and may be located within areas of the City which are zoned for commercial uses; and WHEREAS, experience in this City as well as in other portions of Southern California and other areas has demonstrated that such uses when located in immediate proximity to one another have operational characteristics which have a deleterious effect on immediately adjacent residential and commercial areas; and WHEREAS, the concentration of such uses substantially contributes to blighting and downgrading of adjacent residential and commercial areas; and WHEREAS, it is evident that special zoning regulations applicable to these and similar uses are necessary to preserve the integrity of existing commercial areas of the City and of residential areas of the City which are in close proximity to such commercial areas; and WHEREAS, the City Council and the Planning Commission propose to study special zoning regulations applicable to Adult Business and pending such study and implementation of special regulation it would be detrimental to the public peace, health, safety, and general welfare to have businesses which may be subject to such special regula- tions established; and WHEREAS, Section 65858 of the Government Code of the State of California authorizes the adoption of an interim Ordinance as an urgency measure prohibiting the usage of land which may be in conflict with a contemplated zoning proposal which the legislative body or Planning Commission is considering or studying or intends to study within a reasonable period of time; NOW, THEREFORE, the City Council of the City of Azusa does ordain as follows : SECTION 1. The issuance of any building permit for or the establishment of any use within the meaning of the term "Adult Business" as defined herein is prohibited pending the establishment of special zoning regulations to control said use. The term "Adult Business" for the purposes of this Ordinance shall mean any business which is conducted exclusively for the patronage of adults and as to which minors are specifically excluded from patronage thereat either by law or by the operators of such business . "Adult Business" shall also mean and include adult book stores , adult theaters, massage parlors and modeling studios , adult motels or hotels, but not including those uses or activities the regulation of which is pre-empted by state law. SECTION 2. This Ordinance is adopted as an urgency measure to protect the public health, safety, and welfare and shall take effect upon its adoption and shall continue in effect for a period of no longer than four months; provided, however, that after notice pursuant to Section 65856 of the Government Code and a public hearing the City Council may extend the effectiveness of this Ordinance for a period of eight months and thereafter for an additional period of one year. A statement of facts constituting the basis of such urgency is as above set forth. The legal authority for the enactment of this Ordinance is Section 65858 of the California Government Code and other applicable statutes. SECTION 3 . The City Clerk shall certify to the adoption of this Ordinance and cause the same to be published in the manner prescribed by law.
