THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN AS FOLLOWS : SECTION 1. Chapter 7. 08, Sections 7. 08 . 010, 7 . 08. 020, 7. 08 . 030, 7. 08. 040, 7 .08 . 050 , 7 . 08. 070, 7. 08 . 080, 7. 08.100, 7. 08 . 110, and 7 . 08 .130 of the Azusa Municipal Code are amended to read as follows: "Section 7 . 08. 010 DEFINED. 'Rubbish' means and includes any and all animal or vegetable waste resulting from the preparation of food, glass, crockery, bottles, tin cans, containers, and other combustible or noncombustible waste articles and materials which have been discarded or rejected by the owners thereof and set out or placed for collection. The term 'residential rubbish' shall mean all rubbish produced by and collected from residential units within the City. The term 'commercial rubbish' shall mean all rubbish produced by and collected from commercial and industrial establishments within the City. The enumeration of certain articles herein shall not act as elimination of other articles , but are used merely as a guide for the meaning of the term 'rubbish. ' However, 'resi- dential rubbish' shall not include rocks , dirt, substantial amounts of building materials, heavy trees or branches . The exclusion of heavy trees and branches herein is not meant to exclude lawn clippings or cuttings, weeds, shrubbery trimmings or other small trimmings . Ashes shall be included, provided they are placed in a wooden box or metal container, are wet down, and do not weigh more than fifty pounds per pick up. "No person shall remove or convey any residential or commercial rubbish upon or along any public street or alley, or other public place in the City; provided, however, that 'the provisions of this section shall not apply to any person in the employ of the City who shall be assigned by the Director of Public Works to the work of refuse disposal, or to any person with whom the City has entered into, or may hereafter enter into a contract for the collection, removal and dis- posal of refuse, or to any employee of such contractor, during the time the contract shall be in force. " "Section 7.08 . 020 COLLECTION - SCHEDULE. Residential rubbish shall be collected in various sections of the City in accordance with schedules now or which may hereafter be approved by the Department of Public Works, subject to approval of the Council. If rubbish day falls on any legal holiday, the pickup service will not operate that day, but will be picked up in accordance with a special schedule to be announced at the time. " "Section 7. 08 . 030 COLLECTION - EXCLUSION. Stones are not to be collected in residential rubbish. Commercial rubbish shall be picked up according to schedules agreed upon by commercial/industrial establishments in the City and the City' s contractor. " "Section 7. 08 . 040 CONTAINER - REQUIREMENTS. Residential rubbish shall be placed in covered containers and shall be set out not earlier than the day before and not later than seven- thirty a.m. on the dates set for collection. Containers shall be of metal, rubber, plastic or any combination thereof with a capacity of not less than ten nor more than thirty gallons . Each such container shall be water-tight and be provided with a handle or handles thereon, and a tight-fitting cover. In those parts of the City where there is an alley other than a blind alley, residential rubbish shall be placed neatly in the rear of the premises adjacent to the alley, in such portions that the collector shall have ready access thereto. In those port- ions of the City where there is no alley in the rear of the premises, or where the alley is a blind alley, residential rubbish shall be placed at the curb in such a manner that will not unduly interfere with auto or pedestrian travel or will not be blown about by the winds . " "Section 7. 08 . 050 CONTAINER - REMOVAL WHEN EMPTY. All residential rubbish containers shall be removed from the curb on the same date which they are emptied. " "Section 7. 08 .070 COLLECTION - RESIDENTIAL. The residential rubbish collection services provided for in Sections 17. 08 . 010 - 17. 08 .100 relate to collections from dwelling units only. The owners and operators of commercial, business, industrial and manufacturing establishments shall utilize the City ' s contractor for the collection of commercial rubbish. " "Section 7 . 08 . 080 RESIDENTIAL COLLECTION - FEES . A fee or such other charge as may be fixed from time to time by the City Council by resolution, is established as the fee to be paid to the city by the occupant or owner, as hereinafter set forth, for providing and making available a service for the collection of residential rubbish from each residential unit. The Light and Water Department of the City is designated as the agency -2- for the collection of such fees . A fee is established for each occupied residential unit, but no change of said charge shall be effective less than thirty days from the date of the resolution changing the rate or charge. Such charge shall be collected monthly upon billing by the Light and Water Department of the City and shall be payable upon presentation of statement and shall be delinquent thirty days thereafter. "This charge shall be included on the bill for electric service. Notwithstanding the imposition of this fee or charge upon the occupant, wherever the bill for electricity is paid or payable by the owner or other person, such owner or other person shall also be charged and pay the fee for rubbish collection service on behalf of the occupant or occupants. If the owner or other person pays such fee and he is not the occupant of some or any premises for which it is so paid, such owner or other person shall be entitled to reimbursement therefor from the occupant or occupants on behalf of whom such fee was paid by him. In cases where two or more residential units are served by the City with electricity through a common master meter, the person responsible for the payment of the bill for electricity shall also be responsible for the payment of the rubbish collection service fees for each occupied unit served by such meter and shall be entitled to reimbursement therefor from the occupant or occupants . "For all occupied residential units where only water service is furnished by the Light and Water Department the charge shall be included on the bill for water service. "For all occupied residential units where neither electricity nor water service is furnished by the Light and Water Department, the charge per month per: each occupied residential unit shall be payable by occupant bimonthly in advance upon presentation of a statement therefor by the Light and Water Department. "No person shall wilfully fail, neglect, or refuse to pay the fee herein prescribed or to reimburse any person entitled to such reimbursement within ten days after demand thereof. If less than the total amount of any bill for rubbish collection and for electric service or water service or both is paid, the amount received by the Light and Water Department shall first be credited to any amount due for the collection of rubbish and the balance of the payment, if any, shall be credited to the amount due for water service or electric service. -3- In addition to any other penalties, the City may discontinue the rubbish collection service for nonpayment of any such fee . In addition the fee shall become a civil liability and debt due to the City from any person upon whom the charge is imposed. " "Section 7. 08 .100 COLLECTION - BY OTHER THAN CITY EMPLOYEE. No person other than employees of the City directed so to do shall remove from any containers placed in, along or upon any street, any rubbish junk or any waste or refuse material. " "Section 7 .08.110 COMMERCIAL AND INDUSTRIAL - FEES . Collection of fees from commercial/industrial establishments in the City for commercial rubbish service shall be by the City' s contractor on the basis of the fee schedule set forth in the agreement between the contractor and the City. Payment of said fees shall be made direct to the contractor. " "Section 7. 08 .130 COMMERCIAL AND INDUSTRIAL - DAMAGING, REMOVING CONTAINER. A person not having the lawful authority to do so shall not tamper with, injure, destroy, or remove any container, bin or other equipment used for the storage of commercial rubbish. " SECTION 2. Section 7.08.120 of the Azusa Municipal Code is hereby repealed. SECTION 3. This Ordinance shall become effective July 1, 1980 . SECTION 4 . The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law.
