HomeMy WebLinkAboutOrdinance No. 2102 ORDINANCE NO. 2102 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING TITLE 2 , CHAPTER 2. 56 BY ADDING THERETO SECTION 2. 56. 105 RELATING TO PEACE OFFICER STATUS OF AUXILIARY POLICE OFFICERS. THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN AS FOLLOWS : SECTION 1. Title 2 , Chapter 2 .56 of the Azusa Municipal Code is hereby amended by adding thereto Section 2 . 56 .105 to read as follows : "Section 2. 56 .105. Peace Officer Powers . Notwithstanding the provisions of Section 2. 56.100 , a member of the auxiliary police force shall have peace officer powers as provided for in Section 832. 6 of the Penal Code. In addition thereto, a member of the auxiliary police force who is issued a level one reserve officer certificate before January 1, 1981, shall have the full powers and duties of a peace officer as provided by Section 830 .1 if the Chief of Police determines that such member is qualified to perform general law enforcement duties by reason of the person's training and experience. " SECTION 2. This Ordinance is adopted as an urgency measure to be effective immediately in order to protect the public peace, health, safety and general welfare. The facts justifying the adoption of this Ordinance as an urgency measure are as follows : The 1980 State Legislature adopted with approval of the Governor, Assembly Bill Number 3217 which was added to Statutes of 1980 as Chapter 1301. Said legislation amend- ed Sections 830 . 6 and 832 . 6 of the Penal Code to provide specific qualifications for reserve and auxiliary police officers to be effective January 1, 1981. In order to assure that certain auxiliary police officers in the City of Azusa continue to be qualified as peace officers based upon their training and experience it is necessary that this Ordinance become effective prior to January 1, 1981. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law.
