HomeMy WebLinkAboutOrdinance No. 2106 ORDINANCE NO. 2106 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, DECLARING A MORATORIUM ON THE ISSUANCE OF ANY BUILDING PERMITS IN COMMERCIAL ZONES WITHIN THE REDEVELOPMENT AREA OF THE CITY PENDING COMPLETION OF A STUDY BY THE PLANNING COMMISSION OF APPROPRIATE LAND USES WITHIN SAID ZONES WITHIN THE REDEVELOPMENT AREA; SAID ORDINANCE TO BE ADOPTED AS AN URGENCY ORDINANCE PURSUANT TO SECTION 65858 OF THE GOVERNMENT CODE. WHEREAS, the City ' s Planning Commission in order to protect the public health, safety and welfare is undertaking a study of appropriate uses in commercial zones within the Redevelop- ment Area of the City; and WHEREAS, the City Council has determined that there should not be established any new construction in commercial zones within the Redevelopment Area pending completion of the study of the Planning Commission; and WHEREAS, Section 65858 of the Government Code of the State of California authorizes the adoption of an interim ordinance as an urgency measure prohibiting any usage of land which may be in conflict with a contemplated zoning proposal which the legislative body is considering or studying or intends to study within a reasonable period of time. NOW, THEREFORE, the City Council of the City of Azusa of the State of California does ordain as follows: SECTION 1. No building permits for commercial zoned properties within the Redevelopment Area shall be issued pending completion of the study by the City relating to appropriate uses of commercial zoned property within the Redevelopment Area of the City of Azusa or until this ordinance or any extension thereof has expired. SECTION 2 . Provided, however, any proposed development during the period of the moratorium can be submitted to the Planning Commission for review, and if the Planning Commission determines that the proposed development is consistent with the objectives of the Planning Commission and City Council relative to uses within the Redevelopment Area, that the Planning Commission can then approve such development with a right of appeal, on denial by the Planning Commission to the City Council . SECTION 3 . This ordinance is adopted as an urgency measure to protect the public safety, health and welfare and shall take effect upon its adoption and shall continue in effect for a period of no longer than four months provided, however, that after notice pursuant to Section 65856 of the Government Code and a public hearing the City Council may extend the effectiveness of this ordinance for a period of eight months and successively thereafter for a period of one year. SECTION 4. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law.
