HomeMy WebLinkAboutOrdinance No. 2110 ORDINANCE NO. 2110 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA DECLARING A MORATORIUM ON THE ESTABLISHMENT OF ANY USE INVOLVING THE SALE OF ALCOHOLIC BEVERAGES AT SERVICE STATIONS PENDING THE STUDY OF SAID USE BY THE PLANNING COMMISSION AND CITY COUNCIL; SAID ORDINANCE TO BE ADOPTED AS AN URGENCY ORDINANCE PURSUANT TO SECTION 65858 OF THE GOVERNMENT CODE . WHEREAS , there is proposed to be established in the City a proposed use involving the sale of alcoholic beverages at a service station; and WHEREAS, the City currently has no Ordinance either prohibiting or regulating the use of service stations for the sale of alcoholic beverages; and WHEREAS, the City Council desires to refer to the Planning Commission for study the prohibition or regulation of service stations selling alcoholic beverages; and WHEREAS, Section 65858 of the Government Code of the State of California authorizes the adoption of an interim Ordinance as an urgency measure prohibiting any usage of land which may be in conflict with a contemplated zoning proposal which the legislative body is considering or studying or intends to study within a reasonable period of time. NOW, THEREFORE, the City Council of the City of Azusa does ordain as follows: SECTION 1. No use shall be established in the City involving the sale of alcoholic beverages at service stations pending study by the Planning Commission and adoption by the City Council of regulations relative to said use. SECTION 2. This Ordinance is adopted as an urgency measure to protect the public safety, health and welfare and shall take effect upon its adoption and shall continue in effect for a period of no longer than four months provided, however, that after notice pursuant to Section 64856 of the Government Code and a public hearing the City Council may extend the effectiveness of this Ordinance for a period of eight months and successively thereafter for a period of one year. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law. PASSED AND APPROVED THIS7th day of July , 1981.
