HomeMy WebLinkAboutOrdinance No. 2107 ORDINANCE NO. 2107 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA DECLARING A MORATORIUM ON THE ISSUANCE OF ANY BUILDING PERMITS FOR THE ESTABLISHMENT OF MANUFACTURED HOUSING PENDING THE ORDINANCE REGULATING SAID USE BECOMING EFFECTIVE; SAID ORDINANCE TO BE ADOPTED AS AN URGENCY ORDINANCE PURSUANT TO SECTION 65858 OF THE GOVERNMENT CODE. WHEREAS, the City' s Planning Commission recommended to the City Council the adoption of an Ordinance amending various provisions of the Municipal Code relative to the establishment of mobile homes or manufactured housing on permanent foundations; and WHEREAS, the City Council has introduced said Ordinance but the same will not become effective until August 5, 1981; and WHEREAS, if the City does not have an Ordinance limiting the establishment of mobile homes or manufactured housing on permanent foundations by July 1, 1981, such uses may be established inconsistent with the proposed Ordinance regulating such uses; and WHEREAS, Section 65858 of the Government Code of the State of California authorizes the adoption of an interim Ordinance as an urgency measure prohibiting any usage of land which may be in conflict with a contemplated zoning proposal which the legislative body is considering or studying or intends to study within a reasonable period of time. NOW, THEREFORE , the City Council of the City of Azusa does ordain as follows : SECTION 1. No building permits authorizing the establishment of mobile homes on permanent foundations or manufactured housing shall be issued if such permit is inconsistent with the provisions of the Ordinance under consideration by the City Council relative to such use. SECTION 2. This Ordinance is adopted as an urgency measure to protect the public safety, health and welfare and shall take effect upon its adoption and shall continue in effect for a period of no longer than four months provided, however, that after notice pursuant to Section 64856 of the Government Code and a public hearing the City Council may extend the effectiveness of this Ordinance for a period of eight months and successively thereafter for a period of one year. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law. PASSED AND APPROVED THIS 15th day of June, , 1981.
